I, James Winton have this day bargained and sold and do hereby transfer and convey to Wm.C. Overstreet his heirs and assigns forever for the consideration of one hundred dollars Twenty five dollars of which is to be paid on or by the first day of April 1863 and the other seventy five is to be paid on or by the first day of January 1864 for which he has this day executed his promissory Notes or Bill Single of this date a certain tract or parcel of land. Located in the State of Tennessee Grundy County Civil district No fifth on Cumberland Mountain on the head waters of the midle (sic) prong of Collins River and includes and is the place where Charles J. Stone Resided on the Chattanooga and McMinnville Stage Road. Said land is to be Run out so as to Includ (sic) the house Spring and and (sic) orchard so as to Includ (sic) one hundred acres to have and to hold the aforesaid tract of land to the Said Wm.C. Overstreet his heirs and assigns forever But a Lien is expressly retained on Said Land for punctual payment of the purchase money and I do covenent for myself my heirs and assigns to warrant and defend the title of Said land against the lawful claim or claims of all persons whatever this 24 December 1862
