THE LAW APPLICABLE TO THE CLAIMS.

    The following additional claims for damages were filed with the Comptroller yesterday:

    The law of 1855 in respect to payment of damages caused during a riot, makes both cities and counties responsible, and requires a notice of a claim after the expiration of twenty days from the time of the damage, and also requires a lapse of three months before a suit can be commenced. The act of 1860, specifying the manner and in what Courts to sue the Corporation of the City of New-York required a second notice to the Comptroller, at least twenty days after the first notice, before a suit can be commenced, if the Comptroller has in the meantime failed to adjust the claim. The power of the Comptroller to decide in such matters is contained in the Charter, and authorizes him to "settle and adjust all claims for or against the Corporation." Suits against the City must be carried on in the Supreme, Common Pleas or Superior Court of the First Judicial District. The Comptroller is required to pay upon the rendering of a judgment against the City. Mr. Brennan has not yet decided whether he will "settle or adjust" the riot claims or let them be sued for.
