 Suffolk County court case number #1501 - Bastian v/s Coxe

 To the honorable John Lingit Esq. Govenor and the rest of the honorable magistrates and deputies the Honorable general court assembled this tenth day of Oct. 1676.

 The humble petion of Robert Coxe in behalf and concerning his negro Caleb Bastian humbly showed that whereas the petioned negro is not only accused but also condemed and sentenced to death for a rape done and on the body of the daughter of the petitioner which proceed? therein the petition hathnot? call to apprehend? any injustice in the honorable court such evidence and information being given his attempt cannot be denied but for any such action as might penetrate whereby the child Riff reconed any wrong is and was manifestly apparent which was by several woman known: who are of good esteem sig Elizabeth Weeden midwife Elizabeth Smith her School  Dramo? with many other Godly women who some of them have tendered there Ahroy? already and the rest are  ready if Rogniered? there and into the child though not of three years old went about as formerly as if nothing had been done towards her and still to this day through the favor of the covtings.

 

Might it therefore please this honorable court to concider the case the child is not wrongd the person offending hath not the languidry to answer for it? If so that as might express contrary to his det? is the petitiod slave bought with his money and has been demanding to the understanding of the petitioner educated so that if the sentence to be executed it will not or only be a defamation to his child but a great loss and himself having dispursed greatly upon him yet not that of the petitioner would find in any some or punished upon him for his attempt not for his romon all of the country if so by your honorable selves thought moot but for his life the petitioner humbly begs which being obtained from your honorable selves shall and will oblige this petition not only to acknowledge ____________ artifull favor  to him in this case but ever to pray            HIS MARK -  RTC

Suffolk County Court Case number # 1254 - Broy #1

The examination of Peter Broy (Croy) aged about 20 years confesseth he met with Sarah Lambert (her sister Mary being nearby) on Thursday was ___night? in the fields and that he was  with Sarah being asked whether He did not thrown her down and lie upon her and lie with her, he made no answer, being asked whether he did not pull up her coats he said no, whether he did not stop her breath when she cried he said no, being asked whether he asked her to lie with her and whether she consented, he answered nothing.

The Testimony of John Nirsi, about 13 years of age. Saith that on Thursday was joaw___night? towards night he went  with Peter Croy to fetch up cows coming nearer meadows (Mr. Wade's) lott up said Peter said he would go that way to fetch a horse and bid thy servant to go another way with him did and having found the cows as he was bringing them towards the highway he heard one scream out 4 or 5 times and coming to the highway said Peter appointed to meet him, he called up said peter, and he answered I come presently and but came he not. I stood still and heard one say you from up carr lott meadow, soon after I went toward the place I heard the voices and I saw Peter Croy brushing his Hat with his head and Sarah Lambert was rising from the ground, and went away, homeward, when I called to Peter I said to him, you have been playing the rouge with P_____?'s girls. He said no, I swear I have not, and as we came home, Peter Croy bid me say nothing, because fellows would say he had been playing the rouge with P____?'s girls.

Suffolk County Court Case number # 1254 Broy #2

 

The examination of Sarah Lambert aged about 12 years.       

 

Saith that on Thursday was  j_____nights being in the fields looking for her missing cows Peter Croy called to her and took her by the middle and throw her down on the ground (cross out) and took up her coates and lay upon her belly there cried out to her sister that was not far off and he stopped her breath with His hand on her throat he lay upon her a long time and she felt His member in her body which did hurt her and afterward she felt wet upon her shift and that her private parts did burn.

The testimony of Mary Lambert aged about 15 years.

 

Saith that on Thursday was joausnnight? towards night being in the fields looking for calves together with her sister Sarah Lambert she saw Peter Croy take her sister Sarah and throw her down on her back and took up her coats and lye upon her belly and when my sister cried out he took her by the throat with his hand and stopped her breath I bid him come off her and hhe said he would presently any? bid me hold my tongue or after he would  pass my coats I saw his naked privities and the agitation and thrashing of his body upon my sister and after a considerable time he rose from my sister and went away and afterwards I saw the print of his nails on my sister's throat.

 

Taken upon oath before me Oct. 31 1673 Daniel Dennison deposed in op[en court this 11th November 1673 as attested  Edward Rawson.

As to said Indictment I plead Not Guilty

I will be tryed by the Bench & Jury

I confesse I would have been naught said wench? whether she would or no, but was hindered from having all knowledge of her body by reason John Syes (Nirsi) come  and called to me, which made me ___leap? before I could committ an act nor can it be conceived that I could ins that home? easily committ an act.

1. because my clothes were all up & I was not naked with her nor did I even fully enter her body

2. her sister or rev Jeffe? might easily have hindered

3. these were no signs of her being deflowered that were seen or offered

4. if I had committed the act I humbly conceive I could not legally be charged with it by Sarah Lambert or her dame Pod?.

1. because Sarah never spoke of it either to John Seyers when he came up to us or to any else

2. nor did she speak of it to her dame till  the next morning

3. her dame did not complaine to any officer till four days after and that was only for fear she thought prove with child, then she should be undone   for ever as the fair.

 

This paper was given m__to the court by Peter Croy 11th November 1673 to be recorded as his phrase with hr__d eprod? and at it was heard whi__ geny? _om he being absent whip___ he would stand by it  he says no: As A___ cow Rawson Jockey?
