Jamison, Examining Clerk NEXT DOCUMENT (my page #14) NOTE: there are missing pages here, so I begin the transcription from the top of the two pages which are present. ..... rolls and of obtaining a new Pension certificate such as she may be entitled to under existing laws. Reference being made to the Pension Office to substantiate her original claim. And she hereby appoints C.S. Bundy, Esq. of Washington, D.C. her true and only lawful attorney to prosecute in her name the said claim and to receive the Pension Certificate for her, and I certify that the contents of the foregoing was read over by me in the presence and hearing of the applicant and that she fully understood what she was signing. NOTE: What looks like two full sentences are too pale on the copy to read but there is Nancy Rigney (x) her mark in this part. Also personally appeared (a name here to pale to read) and Noah Rigney resident of Carroll County, Virginia, persons whom I certify to be respectable and entitled to credit who beikng by me duly sworn say that they were present and saw Mrs. Nancy Rikgney make oath and subscribe to the foregoing declaration and they further swear that they are and have been well acquainted with the said Mrs. Nancy Rigney for (this is very pale-but appears to be the word ten) years last past. That they have read over the foregoing application signed by her and swear that the statements therein made are severally and altogether true, except that as to her age which we believe to be true. And they further swear that they have no interest in the prosecution of this claim and they further swear that the said Nancy Rigney still remains the widow of Isham Rigney, never having been married since his death. NEXT DOCUMENT (my page #15) Letter datged Nov. 22, 1866 from Office of C.S. Bundy & Co. In Washington, D.C. To: Hon. J.H.Barrett, Commissioner of Pensions Dear Sir, On the 9th of August 1866, we filed the claim of Mrs. Nancy Rigney widow of Isham Rigney, a Revolutionary Pensioner-for Restoration to the Pension Rolls. We have never received any acknowledgement of its receipt nor any actions of the Department in relation thereto. The old lady seems ambitious to live long enough to get back onto the pension rolls, but she is getting discouraged. Will the commissioner have the kindness to cause this claim to be reported. Bundy NEXT DOCUMENT (my page #16) From Hillsville, Virginia December 7, 1866 The application of Mrs. Nancy Rigney of Carroll County Virginia for restoration on the Pension roll was made some three months since through Mssrs. C.S. Bundy Esq. Of Washington City. Nothing heard from it since. Will you be so kind as to inform me of what action has been had on it. NEXT DOCUMENT (my page #17) From: Departement of the Interior Pension Office (dated either Oct. 7, or Dec. 7, 1867) (This date could be 1861-but I don't think so) Sir-In the claim of Nancy Rigney widow of Isham for restoration of pension, I have to inform you that there is (illegible word here) satisfactory proof of loyalty. Of Pensions Sir, In reply to you inquiry of the 11th instant, I have to state that the pension of Nancy Rigney (Richmond Virginia roll act 3, June 1858) appears by the books of this office to have been last paid to 4th September 1860. Signed Very Respectfully John Wilson Auditor NEXT DOCUMENT (my page #19) WIDOW'S CLAIM TO FIVE YEARS HALF PAY Act of 16, April 1816 and 3rd Feb. 1853 STATE OF VIRGINIA COUNTY OF CARROLL On this 15 day of March, A.D. 1854, personally appeared before me a Justice of the Peace within and for the county and State aforesaid, Nancy Rigney aged 63 years, a resident of CARROLL County, in the state of VIRGINIA, who being duly sworn according to law, declares that she is a widow of ISHAM RIGNEY, deceased, who was a private in the company of JAMES HOGE in the Regiment of Virginia Militia commanded by (blank) in the war with Great Britain of "1812". That her said husband vounteered in MONTGOMERY COUNTY, VIRGINIA on or about the 16th day of July, A.D., 1814, for the term of six months and died at Norfolk, Virginia on the 14th day of January 1815, as will appear by the muster rolls of said company. She further states that she was married to the said ISHAM RIGNEY in MONTGOMERY COUNTY, VIRINIA on the twenty second day of December A.D., 1808, by one Robert Jones, a Baptist Minister, and that her name before marriage was NANCY HOWELL, that her said husband died at Norfolk, Virginia on the 14th day of January 1815, that she is still a widow; and she further declares that she had by her said husband THREE children, and the following is now living, viz: JINCY and ANDREW RIGNEY. She makes this declaration for the purpose of obtaining the half pay, to which she may be entitled under the acts of Congress of 16 April 1816 and 3rd Feb 1853, never having rec'd half pay under said acts. She hereby revokes all powers of attorney or papers heretofore executed by her, and appoints H. Hogan Helfer her attorney to receive and receipt for the same. ATTEST: L.M. Johnson and Delia Johnson-residents of said county who being sworn according to the law declare that the family Bible of Mrs. Nancy Rigney have this day been presented to them, and that the following is true and correct copy of the marriage of Isham and Nancy Rigney and births of their children. VIZ: "Isham Rigney and Nancy Howell was married 22nd December 1808". Jincy Rigney was born 11 September 1809 Andrew Rigney was born 2nd October 1811, David Rigney was born on 11 October 1813. They further declare that David Rigney is now dead, they further declare that the said record of said marriage of the said ISHAM and NANCY, and births of their children be genuine, and that said record is in the hand writing of DAVID HOWELL, the grandfather of the said children. NEXT DOCUMENT (my page #21) DECLARATION TO OBTAIN THE PROVISIONS OF AN ACT TO EXTEND AN ACT ENTITLED "AN ACT TO CONTINUE HALF PAY TO CERTAIN WIDOWS AND ORPHANS" APPROVED FEB. 3, 1853. STATE OF VIRGINIA COUNTY OF CARROLL On the twenty fourth day of April A.D. 1860, personally appeared before the subscriber, a Justice of the Peaces in and for the county NANCY RIGNEY, a resident of the County & State aforesaid in the county of CARROLL, AGED SEVENTY years, who being first duly sworn according to law, doth on her oath make the following declaration in order to obtain the benefits of the provision made by the act of Congress passed the 3d June, 1858, granting the renewal of half-pay to certain widows and orphans. That she is the widow of ISHAM RIGNEY who was a solider in the company commanded by Captain (forgotten) in the regiment commanded by Colonel (forgotten) in the war with Great Britain. That she is the identical person, who was pensioned under the First section of the act of 3d February, 1853, at the rate of $3.50 per month: which said pension she received from the agent for paying pensions in RICHMOND in the State of VIRGINIA. That her former pension certificate has been surrendered. She further declares that she is still a widow. She herby constitutes and appoints P.M. Henry, of Washington, D.C. her true and lawful attorney, hereby authorizing him to prosecute this her claim for a renewal of her pension, and to receive the certificate to be issued thereon. TATE of CARROLL and credible witnesses and who being by me first duly sworn, deposed and say that they are well acquainted with NANCY RIGNEY who subscribed and sworn to the above declaration in their presence; that they have known her for at least 8 years last past. That she is the widow of ISOM RIGNEY who served in the company and regiment above mentioned; that she is the identical person to whom a pension has heretofore been granted, at the rate of $3.50 per month; and that she is still a widow. NEXT DOCUMENT (my page #22 STATE OF VIRGINIA, COUNTY OF CARROLL I a Justice of the Peace and one of the Justices composing the County Court of the County and state aforesaid do hereby certify that NANCY RIGNEY who appeared before me some time since and made application for Bounty Land and pension is so very poor that she cannot attend Court without great inconvenience. I also certify that she lives on the east side of the Blue Ridge in said County which would increase the trouble, inconvenience and expense of getting to Court. She is almost entirely destiture of every comfort of life, and would have to depend upon some neighbor to convey her to court - which could not be convenietly done at this season of year. NEXT DOCUMENT (my page#24) RESTORATION BRIEF IN THE CASE OF NANCY RIGNEY, WIDOW OF ISHAM RIGNEY IN CARROLL COUNTY AND STATE OF VIRGINIA ACT JUNE 3, 1858 THE CLAIM OFR NEW PENSION CERTIFICATE. PROOF EXHIBITED. A suspnded pension rolls of VA at $4.00 per month paid Sept. 4, 1860. She have returned her _--? Certificate and claims restoration having made the required proof of identity, loyalty and widowhood. Restored July 11, 1867 to a pension of $4.00 per month comencing Sep. 1860 Name and residence of agent C.S. Bundy, Esq. Present COURT APPLICATION OF NANCY RIGNEY FROM ORDER BOOK 19, COUNTY COURT ORDER BOOKS PAGE 97 On the motion of NANCY RIGNEY, widow of ISOM RIGNEY deceased of the County of Montgomery and State of Virginia, it is ordered to be certified to the Pay Master General of the United States that it was proven to this court by the oath of a respectable witness that he was present at the time NANCY RIGNEY was married to ISOM RIGNEY about eight years ago and it was further proven to the courth by the oath of WILSON OLIVER, a respectable witness that he marched in Company with said ISOM RIGNEY from the county of Montgomery Virginia to Norfolk in the service of the United States the month of July 1814, both being privates in the Company of JAMES HOGE and the said ISOM RIGNEY departed this life about the sixteenth day of January, 1815 while in the service of the United States at Norfolk. It is further ordered to be certified that the said NANCY RIGNEY has three children one named JINSEY, seven years old the 30th day of September last, one named ANDREW, five years old the 2nd day of the present month and one named DAVID who will be three years old the 11th of the present month. And it is further ordered to be certified that the said NANCY RIGNEY still remains a widow, all which facts offered by respectable evidence.
