D. 13 Ky Cav June 8, 1889 Sir: I have the honor to request that you will furnish from the records of the War Department a full report as to the service, disability, and hospital treatment of Joab Rigley, who, it is claimed, enlisted July 25, 1863, and served as Sergant in Co. D. 13 Reg't Ky Cav., and was discharged at Camp Nelson, Ky, Jan. 10, 1865. While serving in Co. D, 13 Reg't Ky Cav. he was disabled by indigestion and costiveness resulting in piles, heart & lung disease contracted on or near Burksville, Ky in Spring of 1864 and was treated in hospitals of which the names, locations, and dates of treatment are as follows: If claimant is charged with desertion can said charge be removed. Co. D. 13 Regt. Ky Cav. On this day 5th day of May, A.D. 1890, personally appeared before me (blank), in and for the aforesaid County, duly authorized to administer oaths, Joab Rigney a resident of (blank), in the county of Casey, and State of Kentucky, whose Post Office address is Bright Ky. well known to me to be reptable and entitled to credit, and who, being duly sworn, declares in relation to aforesaid case, as follow: That he is unable to comply with the requirements of the Pension Office as to furnishing affidavit of commissioned Officer Co. D. The Capt. Thomas Watson and Second Lieut George T. Rigney are both dead. The 1st Sergt Jessie C. Newell moved to Missouri whose address I have been unable to obtained, and there fore I pray the Department to accept the affidavits of other Commissioned officers and comrades. Claimant further states that he is unable to give affidavits from Dr. Bennett who was Regimental Serg and Dr. Perryman who was Hospital stewart of Sd. Rgt. and he further prays the Department to accept affidavits of comrades, neighbors & family physician. That he is unable to prove his condition from date of discharge, up to the year 1874 by medical testimony, for the reason that I was not confined to room or bed and I thought it more economical to follow origional treatment or prescription, and use paitent medicans. I further state without oath = That I was not treated in any hospital, but was treated (during service) by Dr. Bennett of 13th Ky. Cavl in the month of April (1861) I think = His post office address was Russellville Ky, but I learn that he is dead I was also treated by Dr. Perryman whose post office address is Stratsville (?) Adair Co., KY during July or Aug (1864) as I recollect = That I do not recollect Dr. Bennetts nor Perryman's given names. = That since the war I have been treated by Dr. J. T. Wesley, whose Post Office is Middleburg, (Casey Co) Ky. That I was treated by sd Wesley as far back as 1870 or thereabouts and at various times since. I was treated by Dr. H. Brown in 1883 in June I believe whose Post Office address is Hustonville KY=That my disease has continued with me since comtracted; some times in a very heavy and sometimes in a lighter degree. I was almost entirely disabled from manual labor in 1865 and 1866.I was unable to perform but very little labor from 1866 to 1873 when my health improved to some extent and was able to do more work until 1881 when my health begain to decline having symptoms of heart trouble and kidney disease from that time 1881 until present time 1889. These diseases resulting from my origionaldisease, Dispepsia or indgestion Costiveness. I resided in Rantoul Champain Co., IL from about 10th of April 1865. I resided in Green Co., Ind from about 15th of May 1865 to March 1st 1866. My Post Office address while in Green Co., Ind was Owensburg sd County and State. I returned home in March 1866 since which time, my post office has been Poplar Hill Casey Co., Ky but is now Bright Casey Co., Ky though my residence has not been changed. I am living now, where I was born and raised. I have followed my anreation(?) that of farming all this while; teaching a few classes in penmanship (ten day terms) now and then. I have also taught a few public schools, during the fall of the year, taught two five month terms, near Middleburg Casey Co., Ky (in the year 1870 & 1871.) Which place is nine miles from my place of residence. I have hired the greatest portion of my work done. I worked in a store (one month 1865) while I stoped in Rantoul Ill with one Mr. Dodge, whose given name I do not remember.= And while in Green Co., Ind 1865 I cultivated about one and one half acres of sorgum & instructed a few classes in penmenship (ten day terms each). In this 20th day of June 1889. Personally appeared before me the undersigned authority within and for the County & State aforesaid. Joab Rigney the above Claimant and declares on oath.= That he contracted the diseases named in his declaration as follow: Dispepsia or indigestion and Consti?ness, at or near Burksville Kentucky in the spring of 1864 in the month of April or May, as best I can recollect, at least these diseases appeared in force then, so as to cause great suffering, but the casuses may have reached back - some two or three months = That these diseases were caused by exposure, food poorly or improperly cooked, eaten or taken at unregular periods, performing duty immediatly after eating, laying on damp ground along the Cumberland River and its tributaries, which river is noted for heavy, cold and damp fogs = That the encampment of his company was usually in low bottoms and very muddy places surrounded by or adjacent to swamps or lagoons on Morrowbone a tributary of the Cumberland and also on the Cumberland during the winter & spring of 1864. That he was with the company on scouts and raids and forced marches, both night and day. That he performed his duty as orderly or 1st Sgt and also done almost all the official business of the company, such as writing mustering for pay rolls, Quarter Masters returns, Ordinance Reports etc etc. That he was frequently exposed to cold, so much so, that he could not sleep of nights = That all the preceding, had a tendency to bring about my diseases. That from the time I contracted said diseases untill discharged from service, I bought at least three fourths of my provisions. That he was a sound healthy person from childhood to manhood and up to date of entering service. State of Kentucky County of Casey On this 28th day of March, A.D. one thousand eight hundred and eighty nine personally appeared before me, Clerk of the Casey County Court, a court of record within and for the county and State aforesaid, Joab Rigney, age 48 years, a resident of the (blank) of (blank) county of Casey State of Kentucky, who, being duly sworn according to law, declares that he is the identical Joab Rigney, who was enrolled on the 25th day of July, 1863, in Company D of the 13 regiment of Ky Vol Cav commanded by Thomas Watson, and was honorably discharged at Camp Nelson on the 10th day of January, 1865; that his hair, Black; eyes, Black; That while a member of the organization aforesaid, in the service and in the line of his duty at or near Burksville, in the State of Kentucky during the Spring of 1864, he contracted Dispepsia or indigestion and Costipation. That he has not been employed in the military or naval service otherwise than as stated above. That since leaving the service plicant has resided in the County of Casey (except the year 1865 I resided one month in Champaign Co., Ill the remainder of the year in Green Co., Ind.) in the State of Kentucky and his occupation has been that of a Farmer. That prior to his entry into the service above named he was a man of good, sound physical health, being when enrolled a Farmer. That he is now greatly almost entirly disabled from obtaining his subsistence by manual labor by reason of his injuries, above described, received in the service of the United States; and he therefore makes this declaratonhpurpose of being placed on the invalid pension- roll of the United States. Godbey do certify that I am personally and intimatly acquainted with sd. claimant and have known him for about eighteen years. I came to his house in the summer of 1876 and lived with him some over three years and slept with him frequently of knights and know that he complained of Dispepsia & Indigestion & costiveness and restlessness of knights, and that when he performed any labor during the day that he could not rest but very little of knights, even from 15 to 18 years ago. Since then I have been with him more or less and lived near to him and heard him complain of same diseases & piles & pain in muscles and small of back and trouble about his heart a great deal and he looks badly or very feeble. I am not able to say just what his diseases are, but I can see the results of them very plainly. And that I do not believe he is able to perform but very little if any labor and do himself justice. I know these facts from reasons stated above, and furthermore I dictate the above matter and read them before I assigned them. April 20th 1895 I have no interest in this claim. J.F. I know these facts from having been with him in the service and frequently since I was member of above regiment and I am not interested in this matter. Wm R. Dec 15th, 1890 Sir: To further aid this Bureau in determining the merits of the above entitled claim for pension, be kind enough to answer in your own handwritting the following questions, giving more complete details than your affidavit affords. Very Respectfully ___? B Raum N.B Portman Liberty, KY When did you first see claimant after he returned from the army, and how do you fix the date? Answer: Some time in Jan or Feb 1865. Immediatly after we returned from service after we were discharged. Of what disability did he complain, and how was he affected? Answer: Dyspepsia & costioness (?) & piles. pains in stomach could eat no strong diet. How frequently have you seen him since your first acquaintance? Answer: Sometimes once every two or three months, in other years two or three times a year. If he has continued to suffer with such disability, please describe the symptoms which were apparent to you, and state to what extent he has been disabled for manual labor thereby during each year? Answer: When I first saw him he was reduced in flesh much debilitated weakly could not rest or sleep of nights great trouble to get up when down. He seems to have declined each year. I do not thing he can do scarcely any labor now at all. My means of knowing the facts of the case are these: Being well acquainted and known him all my life and with often. Very Respectfully, N.B. Vol. in the war aforesaid. That while in the military service & in the line of duty an or near Burksville Ky. during the spring of 1864. Contracted dispepsia or indigestion & costivenep(?) from exposure and hardships and was greatly troubled with sd disease, during the remander of his turn of service = That since he was mustered out of service, he has been sufering & complaining very much with same disease, and that I have heard him complaining during later years, of heart disease & kidney trouble = That his health seems to be gradually declining, so much so, I do not believe he is able to do, but very little manual labor. Joab Rigney, who he understands is an applicant for a pension, and who was a 1st Sergt. in Co. D. 13. Regt. Ky. Cav. Vol. in the war of 1861. The deponent further states= That he has lived in close proximity to sd claimant before and since the war of 1861. That sd Joab Rigney was a sound healthy man up to his enlistment. That he never heard of him being sick at all, not a single day prior to his term of service in late war.= That since claimant was discharged from service he has been constatly complaining of Dispepsia or Indigestion and Costiseness(?) and a trouble about the regins of his heart and kidney disease as he thought, but which I learn his Physician terms Lumbago. That I have heard him complain of piles very much during this period and all the while since he was discharged from the service. That he does not believe that sd claimant has ever been able to perform more than half manual labor any time since discharge and that for seven or eight years past he has not been able to perform but very little manual labor or scarcely any labor. Answer: In Jan. 1865 Few days after we returned home we were discharged 10 Jan 1865. Came home part way together. Of what disability did he complain, and how was he affected. Answer: Dyspepsia, Costiveness & Piles pains in stomach, weakness great trouble to have stools. How frequently have you seen him since your first acquaintance? Answer: Raised up with him. Many times since the war, live near him. If he has continued to suffer with such disability, please describe the symptoms which were apparent to you, and state to what extent he has been disabled for manual labor thereby during each year? Answer: At time of discharge was quite weak, has continued to decline in health and strength each year seemingly very much. Can not be positive as to degrees. Sixteen years ago could not do more than half labor. For 10 or 12 years scarcely any to do himself justice. My means of knowing the facts of the case are these: Answer: Served in same Co. been with & worked with since. Has been all the time much reduced in flesh complexion sallow & splotched - counld not eat strong diet, kind of spells that he could not stand up - Kind of smothering about heart could not sleep well of nights - has to set up of nights. War of 1861 No. 696.514 Comrades certificate Filed by Joab Rigney Claimant Bright Casey Co., Kentucky State of Kentucky County of Casey SS In the matter of the invalid pension claim of Joab Rigney No. 696.514 on this 14 day of Feb. 1890 personally appeared before me=the undersigned authority written and for the county and state aforesaid Timothy C. Godbey a private Co. D. 13th Regt. Ky. Cavl. Vol. in the war of 1861 and now a resident of Casey Co., KY whose Post Office and address is Bright Casey Co., KY. Who being duly sworn according to laws=On oath declares=That he is intimately acquainted with Joab Rigney whom he learns is an applicant for an invalid pension and who was orderly as 1st Sergeant of Co. D. 13th Regt. Ky. Cavl. Vol. in the war of 1861. The deponent further declars= That while the said Joab Rigney was stationed at Burksville, KY or near there in the military service and in line of duty during April or May in spring of 1864 he was attacked with Dispepsia or indigeston and costiveness(?). That he obtained a prescription from Dr Bennett our first sergeon, and during the summer was treated by Dr. Perryman in July, or thereabouts as well as I reccollect=That he carried medicines and took them dayly through our term of service. That I heard him complaining a great deal afterword and very frequently. That he was not able to eat such rations as we drew, or a portion of them, at least= And that he bought at least about three fourths of his rations wshen it was possible to do so. So I carried frequently to him such things as he could eat or would suit his stomach.= That he performed his duty as orderly sergt. and nearly all the offical business of the Company. That he was frequently on scout's and raids, marching night & day.=That I have heard him complaining very much since his discharge of dissepsia or indigestion & costiveness and pains in breast under left nipple; The pain being so sever he could not rest in sleep at nights Which pains and irregular action of the heart he thought was heart disease. Further I have heard him complaining frequently of pain in small of back about his kidney which he thought was kidney disease=That I hav heard him complain very often of piles and very much troubled and weakened by them. That these latter diseases-The trouble about the heart, and smal of back and piles, I have heard him complain of them for several years I do not know just how long. - That he was a sound and healthy man physically before the war even from childhood up I never knew him to be sick a day untill after he became a soldier. I do not believe that he has been able to perform more than half manual labor since he was discharged up to seven or eight years ago and since then, but very little or scarcly any. These facts I know from having been intimatily acquainted with him from childhood up to present time. That he is not directly or indirectly concerned in the prosecution of this claim. Timothy C.
