William Neast the younger of Twyninge, gent

 

In the name of almightye God and in his feare I William Neast the younger of Twyninge in the Countye of Gloucr gent beinge somewhat infirme in body but of good & perfect mynde thanks be therefore given unto God doe make & ordaine this my last Will and Testament the seaven & twentith daye of Marche anno dni 1632 in manner & forme followeinge that is to say Firste I commende my Soule unto my Lorde & Savior Jesus Christe by whose only merritts & throughe whome I doe assuredlye believe that my Synnes are pardoned and that I shalbe an Inheritor of the kingdome of Heaven And my Body I comytte to the Earthe whence it came to be buried at the discrecon of my Executors here in after named And as touchinge my worldlye estate wherewith it hathe pleased God to blesse me in a liberall mannr I give & dispose of the same in manner followinge Firste I give unto my loveinge & deare Father whoe hathe dealte kindly wth me one Annuytye or yearlie Rentcharge of Twenty pounds to be yssueinge oute of all my messuages Lands Tenements and Hereditaments in Twyninge & Tewkesburye in the County of Gloucr wch I purchased of John Carr and Dorothye his wife & Ralphe Sadleir esquire or any of them and of Anne Lornn[?] als Sumer that were sometymes the Inheritance of the said Ralphe Sadleir The same to contynue for Fowrty yeares if my said father shall love soe longe and the same to be payed at the fower moste usuall feastes or Termes in the yeare (that is) at the Feaste of the Nativitie of or Lorde and Savior Christe the Annunciacon of ort blessed Lady the Virgin Marye S John the Baptist and St Michaell tharchangell by even and equall porcons The First payment thereof to begynne at the firste of the said Feasts that shall firste happen next after my decease And if it shall happen the sayd Annuytye or yearlie Rentcharge to be behynde & unpayde by the space of three days next after any of the said Feasts at or in wch the same owghte to be payde and be lawfullie demaded at or in my dwellinge howse That then it shall & maye be lawfull to & for my sayd Father & his assignes into the sayd premises or any parte thereof to enter & distreyne and the distresse & distresses there founde & taken to ympounde & the same in Pounde to deteyne & keepe until he my sayd Father shalbe satisfied & payde not only the sayd Annuytye so behynde but alsoe the somme of Fowrtye shilling of currant money (nominee pænæ) forfeited for everie suche defaulte And my will and meaninge is that my sayd father shall have the free use of that prte of my dwellinge howse as is called the Parlor and the Chamber over the Hall for soe many yeares as he shall live and fower indifferent Loades of Wood to make him fyer wth free ingresse egresse & cogresse for him and his servants in by & throughe all convenient wayes and passages to and from the sayd Roomes But my desire is that my sayd Father & wife & Children sholde cohabitte and dwell together in suche manner as formerlie have done and to accepte of his dyett and washinge and suche money as formerlie I have caused of late to be payde him Item I give and bequeathe unto Margarett my lovinge wief all my said Messuages Lands Tenements & Hereditaments wch were sometymes in the occupacon of the said Mr Carr and Anne Lornn[?] als Sumer or either of them or of their or either of their assigne or assignes Leassee or Leassees as alsoe my Rent of Fowertene nobles a yeare reserved by agreeament of the Tent nowe in the possession of one John Higgins for & duringe and until my heires shall attaine unto the age of Five and twenty yeares for & towards the educacon & bringinge upp of my Children yf shee shall soe longe keepe herselfe a widdowe & unmarried But if she marrye after my decease Then my Will and meaninge is that shee have noe more interest or propertye in any of my sayd Messuages Lands Tenements Rents or Hereditaments whatsoevr I have formerlie granted unto hir or to hir use wch is an Annuytye of Threescore poundes per annm to be yssuynge out of certaine of my Lands in Twyninge aforesaid Alsoe my will and meaninge is that shee shall have the free use of all my Plate & Howshold stuff until my said heire shall attaine unto the sayd age of Five and twenty yeares yf shee shall keepe hirselfe soe longe a widdowe But yf shee shall marrye shee shall have noe further use thereof but that then the same shall come ymmediatelie to my heire And if incase shee keepe hirself a widdowe until my said heire shall attayne the sayd age of Five & twentye yeares and soe contynewe duringe hir lyfe Then my will and meaninge is that my sayd wief shall have added unto that Annuytye already granted unto hir or to hir use one other Annuytye of Tenn pounds per annm to be yssuyinge out of my sayd Lands duringe hir lyfe the same to be payde quarterlye at the fowre moste usuall Feasts or Termes in the yeare And shall lykewise have the free use & occupacon of one halfe of my nowe dwellinge & of my sayd Plate & Howshold stuff therein duringe the residue of hir lyfe yf shee soe longe contynue widdowe And whereas I have an estate for yeares in the Messuages Landes and hereditaments that are or late were in the possession or occupacon of William Darke & Morgan Davies wch was soe granted unto me for securitie of divers sommes of money wch I have payde unto and disbursed for them & for theire debts & by theire appoyntemt Nowe for that it hathe appeared unto me that the said William Darke is satisfied certaine monye by William Deacon and that in consideracon of the same monye the sayd William Deacon shoulde have certaine Landes in the lower Rye Field wch I have agreed unto And because I have made him the sayd Deacon noe assurance thereof I doe give and devise unto the said William Deacon & his assignes all my estate right title interest and Terme of yeares wch I have in the sayd Lands in the lower Rye Field agreed by the said William Deacon to be conveyed to the said William Deacon & his assignes Alsoe my will & meaning is that whereas I have divers somes of monye amountinge to the some of Fower hundred pounds & upwards oweinge me by the said William Darke & Morgan Davies for securities whereof I have estates for the yeares in the Messuages Lands Tenements and Hereditaments nowe in theire sevrall possessions And whereas I have made an agreement wth the said William Darke to accepte of certaine of his Lands & hereditaments (that is) the Grounde called Harberwood eleaven acres of errable Land in the Middle Grove & Little Grove and on the top of Windmyll Hill and the one halfe of his Meadowe and Pasture & Comon throughoute for one Yardeland and have agreed to accepte of theis prmisss in satisfacon for Seavenscore poundes Nowe my will & meaninge is that in consideracon thereof and soe as the sayd Darke dothe relinquishe all agreements contracts & trusts reposed in me touchinge my estate in theis Landes and that he procure[?] the Inheritance of theis Lands to be conveighed as I shall hereby direct that the I do accepte of theis prmisss for the said Seavenscore poundes And I doe hereby appoynte my executors to abate hime the said Darke oute of the debt he oweth me the sayd Somme of Seavenscore poundes And my will & meaning is that according to an agreement formerlie made by me) my executors do conveighe all such Interest as I have in the said Harberwood unto John Freeman of Bushley gent & his assignes Soe as he paye unto them One & fourtye pounds uppon the sealinge & use for the same from Michmas last until the sealinge Alsoe I direct & appoynte my said executors to conveighe to Thomas Maryman & his assignes all my estate that I have in the errable Land in the sayd Middle grove & Little grove & Wyndmyll Hill wch were the said Darkes soe as he paye for the same the somme of Five & fiftie pounds as at Michmas last The residue of that I have agreed to have from the sayd William Darke (that is) the one halfe of his Meadowe wch is one longe halfe acre and two sharrowes[?] and the Pastures in the Somer[?] Loaze the Meadow and in Brockridge Comon for one yardlande and throughoute My will & meaning is that the same shalbe for the benefitte of my heire for some helpe towards his maintenance Item I give & bequeathe unto Richard Neast my seconde sonne the somme of Two hundred poundes And to Thomas Neast my thirde sonne Two hundred poundes And to Elizabeth Neast my daughter Two hundred pounds & The same sevrall somes to be forthwth ymployed for the good of my Children and for the increase of their porcons But my will & meaning is that soe longe as my wief remayneth that if shee fyndeth the burthen and charge of my said Father & children to be greater then my sayd Livinge will fitly provide for That then shee be allowed Fortye shillings a peece for eache of my sayd Children towards theire mayntenance But if my said wife shalbe married againe to another Man after my decease the Remaynder of the profits of my sayd Lands sometymes Carres and Somers over and above the Threescore poundes pr annm grannted unto hir or to hir use and the Twenty pounds pr annm grannted unto my sayd Father shalbe ymployed for the mayntenance and educacon of all my Children and for the setlinge of them & evrye of them in some course or trade of lyfe for theire better Lyvelyhood until my heire shall attaine unto the age of One & twenty yeares and then eache of my younger children to be maynteyned oute of his or hir sayd porcon But my will is that my heire shalbe kepte at schoole and bredde up in learninge yf it shall please God that he shall desyre and therefore a better prte of his Mayntenance Also my will & desyre unto my loveinge Father is that he wille content wth the Rent reserved on the Lease wch I have made to Mr Jackeman wch I doe hereby give unto him duringe his lyfe Item I give and bequeathe unto William my eldest sonne my Interest that I have in Combes Crofte to helpe to rayse a Stocke for him for his better supporte hereafter Alsoe I give and bequeathe unto my sayd sonne William my Lease & Leases and all my estate and interest that I have in the Messuages Lands tenements & hereditaments that were sometymes Carres and Sumers or either of them charged wth suche estates as I have hereby limited unto my sayd wief and Father And I doe desyre my Frends in whose names I have bought the Inheritance of the sayd Lands to conveighe the same to my sayd sonne William & his heires Alsoe I give and bequeathe unto my sayd sonne William all my Plate & Howshold stuff my sayd wief & his mother havinge the use thereof accordinge as I have formerlye herein before limited the same And my will & meaning is and I desire my executors that my debts payde & Funerall expenses discharged and the said somme of Six hundred poundes beinge likewise raised out of the monyes oweinge unto me by the said Darke & Davies and my Stocke of Corne & Cattell & other monye that is oweinge unto me they doe ymploye the residue of my personall estate for the good of my heire in procureinge his Wardshippe for his good & benefitte And lastly I doe nominate & appoynte my verye loveing father in lawe Phillipp Franklyn gent and my Brother in lawe Thomas Surman to be my sole and whole executors of this my will in whome I doe putt my greatest trust and confidence for the good of my wief and children And I doe desyre them that theire care & industrie maye not be wantinge therein and I doe give unto eache of them for his paines takinge herein a Ringe of goulde of the valowe of Fourtye shillings And I doe make overseers of this my Will my deere and loving Father and my loveinge kinsman William Neast of Seaverne Stoke & my lovinge Brother John Neast desyringe them to be aydinge advisinge & comfortinge my said wief and Children & helping & assisting my said executors in the performance of this my last Will accordinge to the true meaning thereof And for theire paynes therein I give unto eache of them a Ringe of goulde of the valowe of Twenty shillings And in testimonye that this is my last Will and testamt I have written it everie word wth my owne hand And I doe alsoe give and forgive unto my said brother John Neast one debt of Six pounds wch is due unto me for a Gueldinge he had of me Alsoe whereas my said brother oweth mee a debte of Fiftie poundes upon bonde and I do owe upon accompte to Anthony Stratford whome I have hitherto bredde up since the deathe of his Father that & more my meaninge is that he paye for the same after the rate of Six pr Cent for suche tyme as he hathe or shall holde the same Alsoe my meaninge is that the debt that my sister Little oweth me doe give also in prte of finishinge that accompte and likewise the debt that my brother in lawe Theophilus Hollands oweth me wch as I take it dothe well nighe make even that accompte Alsoe I have in my handes Six pounds three shillings beinge the Remayndr of a somme received of divers of the Inhabitants of Twyning and likewise the somme of Six pounds received upon the sale of Taylers lands wch sommes my meaninge is my executors be accomptable for the said Twininge money alloweinge somewhat for my paynes takinge in all theire busynes Item my will and meaninge is and I doe hereby direct & appoynte my said executors that they make unto John Higgins a lease of the Tent & Pter of yarde land nowe in his possession for Fowerscore yeares if he & his wief & Robert theire sonne shall soe longe live at the Rent of Fower poundes thirteen shillings & fower pence payeable halfe yearelye at Alhollantyde and Maye daye & under suche reasonable Covenants as shalbe indifferent for the well husbandinge of the prmisss Alsoe my will and meaninge is that when the said Darke & Davies have satisfied suche monyes as they doe trewly owe unto me that then I direct that oute of the sayd monye payde by Darke his the said Darks wief shall have given unto her Three poundes wherewith hir husband shall have nothinge to doe And likewise I direct that oute of the sayd monye payde by Davies his eldest sonne shall have Forty shillings wherewith his Father shall have nothinge to doe Alsoe I doe direct & appoynte my sayd executors to grannte and assigne unto my sonne William all the interest that shall come unto them in the sayd Higgins Tent & prmisss his mother having firste had suche Interest therein as I have formerlie limited unto hir Wm Neast Published sealed and subscribed in the presence of Richard Baughe William Deacon Thomas Maryman William Darke

 

Memorand that whereas I William Neaste the younger have given by my last Will and Testament bearing date the seaven & twentith daye of Marche anno 1632 unto my sonnes Richard Neast Thomas Neast and my daughter Elizabeth Neast the sevrall sommes of Twoe hundred pounds a peece to be payde them as by my sayd Will is limited Nowe I doe further declare that my meaninge is that if any or either of my three Children aforesaid shall fortune to departe this prsent lyfe before he or shee shall accomplishe the sevrall ages of Twenty one yeares or be married that then the porcon of Two hundred of such Childe or Children soe deceasing shall remayne to the survivor or survivors of them to be equally divided And I desyre this noate to be added to my sayd Will as a Codicill Wm Neast // This was declared to be the meaninge of thabove William Neast in the prsens of us Phillippe Franklyn William Neaste the elder and divers others
