This is the last Will & Testament of me Thomas Pensam of Corse in the County of Gloucester Gent which I do make publish and declare in manner & form following that is to say whereas under the settlement made by my wife with Richard Newman certain Lands & premises in the parish of Corse aforesaid & Eldersfield in the said County of Gloucester & Worcester are limited after the death of my self & my wife to the use of such of the younger children of my self & my wife as I shall appoint now I do hereby direct that the lands & premises shall after the death of my wife remain & be to the use of my son James and the heirs of his body I give devise & bequeath unto my wife Mary all my lands heredits & premises whatsoever wheresoever to hold & to her assigns for and during the term of her natural life & from after her decease I dispose thereof as follows viz I give devise & bequeath to my eldest son John in addition to the settled Estate at Corse which is limited to him all those forty acres or thereabouts of Land lying on the West side of the Turnpike road leading from Gloucester to Upton upon Severn being heretofore parcel of Corse Lawn & also five or six acres of Land lying upon the Homestead being bought of Samuel Grubb and a small piece of Wood Ground called Ra[?] about four acres in all situate in the parishes of Corse & Eldersfield in the Counties of Gloucester & Worcester to hold the same respectively unto my said eldest son his heirs & assigns for ever I give devise & bequeath unto my son Edward all my lands & heredits in the parish of Corse aforesaid being on the Eastern side of the Turnpike road leading from Gloucester to Upton upon Severn containing in the whole about one hundred & two acres to hold to my said son Edward & his heirs & assigns for & during the term of his natural life & from after his decease I give & bequeath the same unto my said son John my son Joseph and my son in Law John Rayer of Forthampton in the County of Gloucester Farmer and their heirs in trust that they or the survivors or survivor of them or his heirs shall as soon as may be after the death of my said son Edward sell & dispose of the same & devise the money from thence arising among all the children of my said son Edward now living in equal proportions & I declare that the respective shares of the said children shall be vested in trust immediately after my decease altho’ the actual payment is delayed until the death of my said son Edward and I also declare that the purchaser or purchasers of the said Estate shall not be bound to see to the application of the purchase monies but that the receipt or receipts of my said Trustees or Trustee shall be sufficient discharge for the same I give & devise unto my said son Joseph all my Farm Lands and heredits in the parishes of Leigh & Norton in the said County of Gloucester to hold to my said son Joseph his heirs & assigns for ever I give & devise unto my said son James a piece of ground bought of Prosser and others called Reifeld[?] containing about four acres a piece of pasture ground late part of Corse Lawn about four acres & a small piece of Land bought of the Earl of Coventry containing about half an acre called the forty acres all situate in the parishes of Corse & Eldersfield aforesaid & lying near the premises hereinbefore appointed to him to hold to my said son James his heirs & assigns forever I give & bequeath to my said wife all my household goods & chattels to hold to her & her assigns for the term of her natural life & after her decease to such persons as shall by will direct & all my monies securities for money personal estate & effects of what nature kind or sort soever I give to my said sons John & Joseph and the said John Rayer upon trust that they so thereout in the first place my debts Funeral & Testamentary Expences & place out the whole residue at interest in their names on Government or real securities during the life of my said wife and pay the whole interest & produce thereof to my said wife or her assigns for her life & after her decease do & shall stand possessed of the sum of one thousand pounds stocke three percent consolidated …… annuities upon trust to pay the dividends & proceeds thereof to my said son James during his life & after his decease to sell the same & divide the proceeds thereof among the children of my said son James in equal proportions the heirs of such children to become vested immediately on the decease of their father & I direct that my said Trustees or the survivors or survivor of them out of the residue of my personal estate to pay the following legacies after the death of my said wife that is to say to each of my Grandchildren except my Grandchildren William & Mary the son & daughter of my son Edward and my grandsons William Cother & Charles Cother the sum of one hundred pounds and I declare my will to be that such legacies will become vested in the several legatees immediately after my decease alltho’ the actual payment is postponed till the death of my said wife and I charge my real estate with the payment of the said legacies & as to all the remainder of my real & personal estate & effects not hereinbefore disposed of I give devise & bequeath the same unto my said four sons John Edward James & Joseph to hold to them their heirs Exors Admors & assigns for ever in equal shares & proportions and I declare that my said Trustees shall not be answerable for each other nor for any more money than shall come to their respective hands nor for any involuntary loss which may happen to the said trust effects & I appoint my said wife and also my said sons John & Joseph & the said John Rayer Extrix & Exors of this my will hereby revoking all former wills by me made In witness whereof I have hereunto set my hand & seal the twenty fourth day of July in the year of or Lord one thousand eight hundred and thirteen - Tho Pensam – Signed sealed published & declared by the said testator This is a codicil to my will which I desire may be annexed to & taken as part thereof Whereas I have in & by my said will given & devised to my son John Pensam forty acres or thereabouts of Land lying on the west side of the Turnpike way leading from Gloucester to Upton upon Severn now I do hereby charge the said Lands with the payment of the sum of four hundred pounds to my son in law John Rayer of Forthampton in the County of Gloucester yeoman to be paid to him within twelve months next after my decease I also give devise & bequeath unto my said son in law John Rayer all that piece or parcel of ground situate in the parish of Eldersfield in the County of Worcester called Hawlings[?] containing by estimation six acres or thereabouts to hold to him his heirs and assigns for ever also I give devise & bequeath unto the six children of my daughter Sarah Cother all that piece or parcel of Meadow Ground containing by estimation six acres and a half situate in the Parish of Ashelworth in the said County of Gloucester to hold to them their heirs & assigns forever as Tenants in Common Whereas I have in my said will given and devised unto my son Edward all my lands & herdits in the parish of Corse lying on the Eastward side of the Turnpike road leading from Gloucester to Upton upon Severn to hold to him and assigns for life & after his decease I devised the same to Trustees the real monies for the benefit of the children of my said son Edward now I do hereby revoke the said devise & bequest & in lieu thereof I give and devise to my said son Edward the said lands & herdits in the parish of Corse aforesaid to hold to him his heirs & assigns absolutely forever subject to the payment of the following legacies that is to say to his son William the sum of three hundred pounds to his son John the sum of two hundred pounds and to his sons Philip and Joseph the sum of one hundred pounds each such legacies to be paid them on their severally attaining the age of twenty one years I also bequeath the following legacies in addition to the several legacies bequeathed by my said will that is to say to my Grand daughter Susanna Pensam the sum of three hundred pounds to my Grand daughter Mary Cother the sum of three hundred pounds to my Grand children William Thomas John Charles and James Cother the sum of one hundred pounds each also one annuity or yearly sum of thirty pounds to by paid by my son towards the support maintenance and education of my Grandson John the son of my son James until he attains the age of twenty one years and I rectify & confirm my said will in all other respects In witness whereof I have hereunto set my hand & seal the twenty seventh day of November in the year of our Lord one thousand eight hundred & fourteen – Thos Pensam – Signed sealed published & declared by the said Testor Thomas Pensam as and for a codicil to his last will & testament in the presence of us who at his request in his presence and in the presence of each other have subscribed our names as witnesses – John Stephens – John Fowler – Lydia Griffiths
