Thomas Mathews of Saint Martin Hereford Gentleman

 

In the Name of God Amen I Thomas Mathews of Putstone Stile in the parish of Saint Martin within the Liberties of the City of Hereford Gentleman being mindful of my Mortality Do make and publish this my last Will and Testament in Writing in manner following (that is to say) First I give and bequeath unto my Sons in Law William Fluck of Moorhampton in the County of Hereford Yeoman and William Baskerville of the parish of Fownhope in the County of Hereford Yeoman All my ready money and Securities for money and all monies due and owing to me upon Bonds Notes of hand Mortgages in Fee and for Years or otherwise To Hold to them their Heirs Executors and Administrators Upon the Trusts and to and for the Uses Intents and purposes following (that is to say) In Trust to place out replace and continue at Interest all such Sum and Sums of Money as are now in my house or now due and owing to me as aforesaid upon some good real Security or Securities and from time to time call in and revise the same as Occasion shall require and to apply the same and the Interest thereof in payment of my just Debts Funeral Expences Charges of proving this my Will and of the several Legacies by me hereinafter given and bequeathed Also I give devise and bequeath unto my Daughter Mary Fluck now the Wife of the said William Fluck All that my Messuage or Dwelling House wherein I now live with the Outbuildings Garden and Piece of Meadow Ground thereto adjoining and belonging situate lying and being at Putstone Stile aforesaid To hold to her and her Assigns for and during the term of her natural Life She and they keeping the same in tenantable Repair and from and immediately after her decease I give devise and bequeath the same to her son Thomas Fluck To hold the same to him his heirs and assigns for ever / Also I give devise and bequeath unto my Daughter Margaret Morris now the Wife of Richard Morris of the Parish of Much Birch in the County of Hereford Carpenter All those my two Messuages Dwelling houses with the Buildings Gardens Lands and Hereditaments thereunto belonging called the Holly Bush situate lying and being in the said Parish of Much Birch in the said County of Hereford To hold to her and her Assigns for and during the term of her natural Life She and they keeping the same in tenantable Repair and from and immediately after her decease I give devise and bequeath the same to her eldest son

Thomas Morris To hold the same to him his heirs and assigns for ever Also I give and bequeath unto my Grandson Thomas Mathews the Sum of One hundred Pounds To his Brother John the Sum of Twenty Pounds To my Grandaughters Mary and Catherine Mathews the Children of my late Son Thomas Mathews deceased the Sum of Twenty Pounds a piece to b paid to them when they shall respectively arrive to the age pf Twenty one Years with lawful Interest for the same respectively in the mean time to be applied towards their Maintenance and Education And it is my Will that in Case of the Death of either of my said Grandchildren before the shall attain to the said Age of Twenty one Years that then and in such case the Legacy or Legacies so to them respectively given as aforesaid shall go to and be equally divided between the Survivors or Survivor of them share and share alike Also I give and bequeath unto William Fluck the Younger of the Red Hill the Sum of Fifty pounds And to my Granddaughter Mary now the Wife of Mr William Watkins the like sum of Fifty Pounds to be paid to them as soon as conveniently can be after my decease by my Executors hereinafter named And that the receipt of the said Mary alone shall be a sufficient discharge for her Legacy Also I give and bequeath unto my Grandson Henry Fluck the Sum of Fifty Pounds And also to my other Grand children Thomas Ann Elizabeth Sarah Eleanor and John Fluck Sons and Daughters of my said Son in Law William Fluck by Mary his now Wife the Sum of Twenty Pounds a piece to be paid to them when they shall severally and respectively arrive to the Age of Twenty one Years with lawful Interest for the same respectively in the mean time to be applied towards their Maintenance and Education And it is my Will that in Case any or either of my said Grandchildren Henry Thomas Ann Elizabeth Sarah Eleanor or John Fluck shall happen to depart this Life before he she or they shall arrive to the said Age of Twenty one Years that then and in such case the Legacy or Legacies of him her or them so dying shall go to and be equally divided between the Survivors or Survivor of them share and share alike Also I give and bequeath unto Thomas Morris Son of the said Richard Morris the Sum of Fifty Pounds And to Nancy

Catherine and Susannah Morris daughters of the said Richard Morris the Sum of Twenty Pounds a piece to be paid to them respectively at the End of Twelve Months after my decease And to Elizabeth another Daughter of the said Richard Morris the Sum of One hundred Pounds to be paid to her when she shall arrive to the Age of Twenty one Years with lawful Interest for the same in the mean time for and towards her Maintenance and Education but if in Case She shall happen to depart this Life before she shall arrive to the said Age of Twenty one Years then I will that the same shall go to and be equally divided between the Survivors or Survivor of her said Brothers and Sisters them share and share alike Also I give and bequeath to my Granddaughter Nancy the Daughter of my late Son William Mathews deceased by his Wife Mary the Sum of Two hundred Pounds to be paid to her when she shall arrive to the Age of Twenty one Years with lawful Interest for the same in the mean time for and towards her Maintenance and Education But if She shall happen to die before she shall arrive to the said Age of Twenty one Years Then I do hereby order and direct that the said Sum of Two Hundred Pounds shall go to and be divided between my three Daughters the said Mary Fluck Margaret Morris and Elizabeth Baskerville and to such of their children as shall be then living share and share alike Also I give and bequeath unto my said Daughter Margaret Morris the like Sum of Fifty Pounds to be paid to her at the End of Twelve Months next after my decease and her Receipt alone shall be sufficient Discharge for the same Also I give and bequeath unto my good Friend Henry Collier the Elder of the City of Hereford Malster the Sum of Ten Pounds as a small acknowledgment for his kindness to my said Granddaughter Nancy and hopeing at the same time he will render her what Services is in power Also I give and bequeath unto my

Brothers George and Jonathan Mathews and to my Sister Margaret Rice Widow and to my kinsman Thomas Mathews the Sum of Ten Pounds a piece to be paid to them as soon as conveniently can be after my Decease Also I give and bequeath unto my said Grandson Thomas Fluck my clock and case Also I give and bequeath All my Household Goods and Furniture of all Sorts Beds Bolsters Pillows Sheets Blankets Quilts Bedsteads Hangings Pewter Brass China Earthen War and Brewing utensils and all other my Household Goods and Furniture both Linen an Woollen unto my said Daughter Mary Fluck and the said Elizabeth Morris to be divided between them Share and Share alike (the said Mary Fluck to have the first choice) But if they cannot agree on the paring of the same then I will and direct that the same shall be appraised and sold and the Money arising from the Sale thereof to be equally divided between the said Mary Fluck and Elizabeth Morris share and share alike And as to my Vessels and all the Rest and Residue of my personal Estate and Effects not by me herein before disposed off after payment of my Debts Legacies Funeral Expences and Charges of proving tis my Will I give and bequeath the same and every part thereof unto the said William Fluck the Elder and William Baskerville their Executors and Administrators equally to be divided between them share and share alike Provided always and it si my Will and desire that the said William Fluck the Elder and William Baskerville and the survivor of them or the heirs Executors or Administrators of such Survivor shall not be charged or chargeable with or answerable or accountable for any more Money than what he or they shall actually receive by Virtue of the trust hereby in him and them reposed Nor with or for any Loss that shall or may happen of the Trust money or any part thereof or of any Security or Securities whereon the same shall be lent or placed out so as the same happen without their or either of their wilful Default Nor with or for any Defect or Insufficiency in the Title of the Messuage Messuages Lands Tenements or Hereditaments whereon the same shall be placed out at Interest as aforesaid And that it shall and may be lawful for them or

Either of them to retain and reimburse to him and themselves all such reasonable Costs and Expences that they or either of them shall be put unto or expend in the Execution of the Trust by me in them reposed And lastly I do hereby nominate and appoint the said William Fluck the Elder and William Baskerville my Trustees and joint Executors of this my Will And I do hereby revoke and make void all former and other Wills by me at any time heretofore made and do declare this only to be my last Will and Testament In witness whereof I have to this my last Will and Testament contained in five sheets of paper to the four first sheets set my hand and to the fifth and last sheet my hand and Seal this Ninth day of march in the Year of Our Lord One thousand seven hundred and Ninety Eight Thomas Mathews Signed sealed published and declared by the Testator Thoms Mathews as and for his last Will and Testament in the presence of Us who in his Sight and presence and at his request and in the presence of each other have subscribed our Names as Witnesses hereto John Rowland Richard Taylor Wm Forster

 

Proved at Hereford the 18th day of August 1798 before the venerable Nathan Wetherell D:D: Dean Etc by the Oaths of William Fluck the Elder and William Baskerville the Executors To whom etc.
