Richard Piffe of Tewkesbury yeoman

 

In the Name of God Amen I Richard Piffe of Tewkesbury in the County of Gloucester yeoman being weak in Body but of Sound and Disposing Mind Memory and Understanding Do Make publish and Declare this my Last Will and Testament in manner and form following (that is to say) First and principally I resign my Soul to the Mercy of Almighty God who gave it and my Body to the Earth to be decently Buried at the Discretion of my Executor hereinafter Named, And Touching my Worldly Estate I dispose thereof as follows, that is to say, I Give and Devise (Subject to the Proviso hereafter mentioned) All those my Freehold Lands Tenements and Hereditaments with their Appurtenances which I lately purchased of Thomas Woodcock of Hasfield in the County of Gloucester aforesaid yeoman and which are situate in the Parish of Hasfield aforesaid and now in the occupation of the said Thomas Woodcock unto my Nephew George Piffe of Hatherley in the said County of Gloucester Yeoman and to his Heirs and Assigns for Ever Chargeable with the Payment of all and every Sum and Sums for which the same shall stand Mortgaged at the Time of my Death And It is my Will also that the said George Piffe shall pay to my loving Wife Elizabeth Piffe the Sum of Five Pounds Yearly and every year at Half Yearly Payments for and during the term of her Natural Life, The first payment thereof to begin and be made at the End of Six Months next after my Decease, And I do hereby Charge my Two Closes of Pasture Ground or Orcharding called by the several Names of Far Wyre and the Two Lands with the Payment thereof Which said Closes are part of the Estate Devised to the before mentioned George Piffe.  Item I give (Subject to such Proviso hereafter mentioned) my Freehold Close of Pasture Ground called Gaudy Croft situate in Apperly in the Parish of Deerhurst and County of Gloucester aforesaid which is now in the occupation of William Dipper of Apperly aforesaid yeoman unto my Kinsman Richard Piffe of Fruckington in the County of Gloucester aforesaid Yeoman and to his Heirs and Assigns for Ever.  Item I give and devise (Subject to the Proviso hereafter mentioned) All other my Freehold Messuages Lands Tenements and Heriditaments whatsoever and wheresoever situate lying and being in the County of Gloucester or elsewhere whereof or wherein I am Seized of Estate of Inheritance either in Possession Reversion Remainder or Expectancy and have power to dispose of by this my Will unto my Grandson John Pope now servant to Mary Whithorn of Apperley aforesaid Widow and to his Heirs and Assigns for Ever.  And It is my Will also that the said John Pope shall pay to my said Wife Elizabeth Piffe the Sum of Six Pounds Yearly and every year at half yearly Payments for and during the term of her Natural Life, the first payment thereof to begin and be made at the End of Six Months next after my Decease, And I also charge the Estates Devised to the said John Pope with the payment thereof Which said Annuitys of Five Pounds and Six Pounds I give to my said Wife in lieu of Dower and Thirds which if she will not accept of on such Condition, then the Devise of such Annuitys to be Null and Void.  Item I give to Ann and Sarah Pope Daughters of William Pope late of the Leigh in the County of Gloucester aforesaid Yeoman deceased the Sum of Fifty Shillings a piece to be paid them respectively within Six Months next after my Decease.  Item I give to                       Pope widow Mother of the said John Pope the sum of Five Pounds to be paid her within Six Months next after my Decease.  Item I Give and bequeath unto my said Wife the Third part of all and Singular my Household Goods and Linnen.  And Lastly I Give and Bequeath (Subject to the Proviso hereafter mentioned) All the Rest and Residue of my Goods Chattels Rights Credits and personal Estate whatsoever after payment of my Funeral Expenses Debts and the above Legacys of Fifty Shillings, Fifty Shillings and Five Pounds unto the said John Pope, And I do hereby make and constitute him sole Executor of this my Will (Subject to the Proviso hereafter mentioned) hereby revoking all former Wills by me made Provided always that if I should have any Child or Children living at the Time of my Death, or if my said wife shall be Ensient of any Child or Children at the Time of my Death, It is my Will that the above Devises to the said George Piffe, Richard Piffe and John Pope shall be Null and Void, And I Do Give and Devise all and every the before mentioned Estates devised to them the said George Piffe, Richard Piffe and John Pope their Heirs and Assigns respectively as aforesaid unto such Child or Children which shall be then living and of which she shall be Ensient at the Time of my Decease and to his her or their Heirs and Assigns for Ever, as Tenants in Common and not as Jointenats, Chargeable Nevertheless in manner aforesaid with the said Annuitys of Five Pounds and Six Pounds to my said Wife, But if all and every such child shall dye without Issue before the Age of Twenty One Years It is my Will and I do hereby Devise the said Estates to the said George Piffe, Richard Piffe and John Pope their respective Heirs and Assigns in manner as the same are respectively before Devised to them, And Subject to such Annuitys as aforesaid And It is my Will and Devise that if I shall leave any Child or Children or my Wife shall be Ensient as aforesaid at the Time of my Decease, that such Child or Children shall have and I do hereby Give and Bequeath the rest and residue of my Goods Chattels Rights Credits and Personal Estate after payment of my Funeral Expenses Debts and Legacys to such Child or Children if more than One in equal Shares, And is such case the Bequest thereof to the said John Pope shall be Null and Void, And I do in such case appoint such Child or Children Executors of this my Will and my appointment of the said John Pope Executor as aforesaid shall Cease and Determine, But if such Child or Children shall dye without attaining the Age of Twenty One Years and without leaving any Child or Children Then It is my Will and Devise that the said John Pope shall have such Residue and be my Executor in manner before mentioned.  In Witness whereof I have to this my Last Will and Testament contained in Two Sheets of paper, to the first Sheet thereof set my Hand and to this the Second and Last Sheet my hand and Seal this Twenty Sixth Day of January in the Thirty first Year of the Reign of our Sovereign Lord George the Second by the Grace of God of Great Britain France and Ireland King Defender of the Faith and so forth And in the Year of our Lord One Thousand seven hundred and Fifty Eight.
