Katherine Cooke of Apperley, widdow

 

In the name of God Amen The first day of September in the yeare of our Lord according to the stile of England one thousand six hundred and fifty and six: I Katherine Cooke of Apperley in the Parish of Deerehurst and County of Gloucester widdow, being weake in body, but of an able disposeing memory (thanks be unto  god therefore) doe make and ordaine this my last will and testament in manner and forme followinge: First I commend my soule into the hands of Allmighty god my maker, restinge on the alone merritts of Jesus Christ my redeemer fro the Salvacion thereof And my body I commend to the earth whence it was taken beleiving the resurrection thereof at the last day And for my worldly goods haveinge divers children my desire is to have a motherly care of them accordinge to mine ability First I give unto my sonne John Cooke the remainder of the lease of meadow ground belonging to the Margaretts Hosspitall in Gloucester he payeing the annuall rent And I desire my Landlords thereof that they will grant a further estate to my said sonne John And I give unto my sonne John Cooke my bay mare with her Suckinge Colt Alsoe I give him all my tack for husbandry as Carts Ploughes wheeles geeres irons harrowes and the rest of the same nature Alsoe I give him one Coffer at the truckle beds feete, And though my eldest sonnes porcion farre exceeds all the rest yet I give him the Coffer that was his fathers And whereas I have five daughters I give all the rest of my goods and cattels unto them all to be equally devided amongst them And For as much as my three youngest daughters are worst able to shift for themselves Therefore my will is that when my goods aforesaid are soe devided as aforesaid these three youngest daughters porcions shalbe forty shillings a peece better than their elder sisters and this to be deducted out of their said elder sisters parts of the said goods, And if anie of my Children shall dye before they receive their porcions by mee given or that the same be not spent in their educacion Then my will is that the porcion of the deceasinge shalbe and remaine to my surviveinge daughters to be equally devided amongst them And whereas I have a Chattle lease in my power to dispose of and am willinge me eldest sonne should have the same accordinge to the terme therein expressed and my other Childrens porcions are but small therefore upon cnsideracion of my assureinge the said lease unto my eldest sonne Robert Cooke which I doe fully and effectually by this my last will if I should not live to make anie further assignment And that dureing ye terme in the said Chattle lease expressed upon condicion that my said sonne Robert shall pay tenn pounds a peece to his two eldest sisters, and thirteene pounds a peece to his three youngest sisters and five pounds to his brother John And six pounds as a debt which I stand ingaged for which makes up Threescore and tenn pounds in the whole And that for this summe my said sonne Robert Cooke shall give a bond of Seavenscore pounds of lawfull english money to William Lane of Apperley gent and Thomas Flucke of the said towne which condicion for the payment of the said Sixe pounds debts and the consideracion thereof within one quarter of a yeare after my decease And the remainder of the Summer to his sais severall sisters within two yeares after my decease And if the said Robert Cooke my sonne shall marry sooner then to pay the said moneys to his brothers and sisters within three months after his said marriage for the secureinge whereof my said sonne shall bind his freehold land to the said William Lane and Thomas Flucke: And That all things may be done effectually according to this my last will I make constitute and ordaine my sonne John Cooke sole Executor of tis my last will and testament And I allow unto my sole Executor six moneths after my decease for the riddinge of the Liveinge wherein now I live being the Chattle Lease formencioned And I nominate an intreate my very loveinge neighbours William Lane and Thomas Flucke aforesaid as overseers of this my last will desireinge their friendly helpe In Witnes whereof I have to this my last will and testament sett mine hand and seale The day and yeare first abovewritten Katherine Cooke her marke These beinge witnesses Robert Lankington William Lane Tho: Flucke

 

This will was proved at London the Fowerth day of the month of May in the yeare of our Lord 1657: Before the Judges for pbate of wills and grantinge administrations lawfully authorized by the oath of John Cooke the sonne of the said deceased and sole Executor named in the said will to whom was committed administracion of all and singular the goods Chattles and debts of the said deceased Hee the said John Cooke beinge first sworne in due forme of law by vertue of a Commission well and truely to administer the same.
