In the name of God Amen I John Eagles of [the parish of Deerhurst in the Cou]nty of Gloucr yeoman being somewhat sicke & weake in body, but of good & pte [memorie (prayse God the]refore) doe make & ordeyne this my last will and testament in manner [and forme followinge Inprimis I] bequeath my soule into the hands of allmightie God my maker & Creator & of J[esus Christ my saviour & redeem]er by whose merits I expecte remission of my sins & salvacon of [my -------------------------- & my] body to the earth whereof yt was made to be buried in a decent & Christianlike [manner & as touching my worldly esta]te wch God hath lent unto me, whereof he hath made me steward I dispose [thereof in manner as here in after ment]ioned and expressed. Inprs I give and bequeath unto John Eagles my [sonne --------------------------- with the] apprtenances and every part & prcell thereof, which I late purchased of [-------- --------- & ----------- At]twell als Wells, or eyther of them to me and my heires for ever. [To have and to hold unto] the sayd John Eagles my sonne and to the heires of his body [lawfully to be begotten for ever.] And for want of such yssue Then to and for the use and behoofe [of my daughter Joane Eagles and to] the heires of her body lawfully to be begotten for ever. And for want of such [yssue Then to and] for the use and behoofe of my daughter Hester Eagles &to the heires of he[r body lawfully to be] begotten for ever. And for want of such yssue then to and for the use & [behoofe of my daughter] Grace Eagles & the heires of her body lawfully to be begotten for ever And [for want of such yss]ue to & for the use & behoofe of my daughter Ellyenor Eagles & the [heires of her body lawfull]y to be begotten for ever. And for want of such yssue then to and for the use & behoofe of my kinsman Richard Barly & the heires of his body lawfully to be begotten for ever. And for want of such yssue Then to and for the use & behoofe of the right heyres of me the said John Eagles prty to these prsents for evermore. unto & for no other use intent or prpose Provided all wayes & my will & meaning is That Grace Eagles my wyfe shall or lawfully may have hold & enioy all my sayd lands, and have receive & take the rents yssues & prfite thereof to her owne use & behoofe for & towards the breeding & bringing up my said sonne John and my said daughters until my sonne John Eagles shall happen to come to the full age of one & Twenty yeeres, yf my sayd wyfe soe long happen to live, without any accompt or recompence to be therefore made or yielded, any thing before herein conteyned to the contrary in any wise not withstanding. Itm whereas Henry Cassy esq by his Indre of lease bearing date the Twentyeth day of July 1633 did demise & grant unto me A certeyne Messuage or Tenemt now in my occupacon together wth certeyne lands & Rudges & half an acre of meadow ground thereunto belonging To have & to hold from the ensealing & delivry of the said Indre for the terme of Fowerscore and nynteene yeeres next insuing, yf I the said John Eagles, and Grace Eagles & Ellyenor Eagles my daughters or any of us shall soe long happen to live for & undr the yeerely rente of Tenne shillings payeable at the fowre usuall Feasts of St Mary day, Midsomer, Machaelmas & Christmas by equall porcons, as by the same appeth, My will & meaning is, that the said Grace my now wyfe shall forthwith after my decease have & ---- receive and take, the rents yssues and prfite of the said demised prmisses during soe long tyme of the contynuance of the estate thereby grannted as shee my said wyfe shall live sole & unmarryed. And from & after hir decease or the day of her marryage, which shall first happen to be them my will and meaning is that my Daughter Grace & Ellynour shall hold & enioy the said demyssed prmisses, & receive the rents yssues & prfits thereofe successively as they were named in the sayd lease, during the residue of the continuance of the estate thereby grannted, according to the tenor thereof Shee my said wyfe and my said daughters yielding paying & prforming such rents covents & agreemnts as are therein on my part to be held & prformed Item I give unto my said daughter Grace Eagles the summe of Nyne pounds of lawfull money of England when shee shall atteyne unto the age of Twenty yeeres, Itm I give unto my daughter Ellyenour the summe of three pounds when she shall atteyne unto the age of Twenty yeeres Itm I give unto my daughter Johan the summe of Fourteen pounds when she shall atteyne unto the age of Twenty yeeres. Itm I give unto my daughter Hester Eagles the summe of Fifteene pounds when she shall atteyne unto the age of Twenty yeeres, My will & meaning being That yf any or eyther of my said daughters shall happen to dye before shee or they atteyne to the said age of Twenty yeeres That then her or their legacy in money soe given aforesaid, shall be & remayne to the sole use & behoofe of the sd Grace my wyfe, All the rest of my goods cattles & chattels reall & prsonall moveable & unmoveable (not before hereby given or bequeathed, my debts being payd & my funerall expences discharged) I give & bequeath unto my welbeloved wyfe Grace Eagles before named, whome I make sole Executrix of this my last will & testament In witness whereof I have hereunto put my hand & seale the seaventh day of March Anno dni 1637.

Memorandm that whereas I have not so fully explained somthinge in this my Will above specified. I desyre therefore to annexe this Codicile wch is further to make known my Will, that if it shall please God my wife Grace shall die before all or any of my children shall accomplish their severall ages specified in this my Will for the enjoyment of their sevrall porcons. And any of them (after the decease of my said Wife) shall also die before the enjoyment of their sayd porcons, then the porcon or porcons of the deceased, my will is, shall remaine unto my survivinge children to be equally divided amongst them. Itm also my Will further is that if it shall please God my Wife Grace shall die before my sonne John shall accomplish the age of sixteene yeeres my Will is that my daughter Grace & if she die before that time, the my daughter Elenor, to whom I have assigned my Lease of the Livinge called B— livinge, shall bring up & educate my sayd sonne John, till he shall accomplishe the age of sixteene yeeres, his owne rents helpinge towards his maintenance and education. |
