Mary Fluck of Cheltenham, widow

 

This is the last Will and testament of me Mary Fluck of Cheltenham in the County of Gloucester Widow First I direct that all my just debts funeral and testamentary expenses be paid by my Executors hereinafter named I give and bequeath my wearing apparel bed linen and table linen unto my daughter Margaret Hall absolutely I give devise and bequeath unto Anthony Ellis Arkell of Cheltenham in the County of Gloucester Gentleman and my son James Mathews of Cheltenham aforesaid Builder All and singular my real Estate (except Estates vested in me as trustee or mortgagee) and All and singular my personal Estate and Effects (save and except those by me hereinbefore specifically given and bequeathed) of what nature or kind soever or wheresoever situate To hold the same unto the said Anthony Ellis Arkell and James Mathews their heirs executors administrators and assigns Nevertheless Upon the trusts to and for the ends interests and purposes hereinafter mentioned expressed and declared of and concerning the same that is to say Upon trust to sell my real and such other of my personal estate not hereinbefore specifically given and bequeathed together or in parcels by public auction or private contract and to dispose of the net moneys to arise from the sale of such real and personal estate in the manner following that is to say Upon trust to pay apply and divide the same into four equal parts or shares and to pay one equal fourth part or share thereof unto my son James Mathews for his own absolute use and benefit one other equal fourth part or share thereof unto my son John Mathews for his own absolute use and benefit one other equal fourth part or share thereof unto my said daughter Margaret Hall the wife of Edwin Hall of Cheltenham aforesaid Boot closer for her own absolute use and benefit and the remaining equal fourth part or share thereof unto my Grandson Charles Mathews son of my late son Charles Mathews deceased on his attaining his age of twenty one years I give devise and bequeath unto the said Anthony Ellis Arkell and James Mathews All such Estates as are or at the time of my decease shall be vested in me as a Mortgagee or as a Trustee thereof and according to my Estate right title and interest therein To hold the same Estates unto them the said Anthony Ellis Arkell and James Mathews their heirs executors administrators and assigns respectively upon the trusts and for the ends intents and purposes upon and for which the same respectively shall be held by me at the time of my decease And I hereby declare that the receipt and receipts of the said Anthony Ellis Arkell and James Mathews their heirs executors administrators and assigns shall be good and sufficient discharges for all or any moneys which may come to them under or by virtue of this my Will And I further declare that the said Anthony Ellis Arkell and James Mathews shall not be answerable for each others acts or receipts nor for any losses happening without their own respective default and shall be at liberty to retain and allow to each other all expenses incident to the execution of the trusts and powers of this my Will and that notwithstanding any or either of them shall be an Attorney or Solicitor And I hereby nominate and appoint the said Anthony Ellis Arkell and James Mathews Executors of this my last Will and testament and revoke all other Wills by me at any time heretofore made.  In witness whereof I the said Mary Fluck have hereunto set my hand this seventh day of February in the year of our Lord one thousand eight hundred and fifty seven.

 

Signed and declared by the said Mary Fluck the Testator as and for her last Will and testament in the presence of us present at the same time who at her request in her presence and in the presence of each other have hereunto subscribed our names as witnesses
