This is the last Will and Testament of me John Flook of Hanham in the Parish of Bitton in the County of Gloucester Victualler I give and Bequeath unto Sarah the wife of William Wilkins (but who has for many years resided with me as my wife and passed under my name) All my monies securities for money household furniture linen stock of liquors and all other my goods chattels and effects whatsoever and wheresoever to and for her own absolute use and benefit she paying thereout my debts (not being a mortgage debt) funeral and testamentary expenses I give devise and bequeath unto Jeremiah Bevan of Hanham aforesaid Cordwainer and Robert Brittan of the same place Stone Cutter All my messuages lands whatsoever and wheresoever which I shall be possessed of at the time of my decease and every part thereof To hold the same unto and to the use of them the said Jeremiah Bevan and Robert Brittan and their heirs forever unto them their Executors administrators and assigns for all my Estate and Interest therein as the case may be Upon the following trusts that is to say Upon trust that they my said trustees or the survivor of them his heirs Executors or administrators do and shall receive and take the rents issues and profits thereof and every part thereof and pay the same unto the said Sarah Wilkins or otherwise permit and suffer her to receive the same to and for her own absolute and exclusive use and benefit for the term of her natural life free from the debts or control of the said William Wilkins or any other person or persons whomsoever And I hereby declare that the receipts of her the said Sarah Wilkins alone shall be good and sufficient discharge s to my said Executors for the same And from and after the decease of the said Sarah Wilkins I give devise and bequeath All my said messuages lands tenements and hereditaments whatsoever and wheresoever which I shall die possessed of aforesaid unto my half Brother Daniel Gage To hold the same unto and to the use of Daniel Gage his heirs and assigns for ever or unto him his Executors administrators and assigns for all my Estate and interest therein as the case may be And I do hereby declare and direct that it shall be lawful for the trustee and trustees for the time being of this my Will from time to time to deduct to and for himself and themselves respectively all such costs charges and expenses whatsoever as they or either of them shall bear sustain expend or be put into in or about the execution of the said trusts or any of them or in the execution of this my Will or in anywise relating thereto And further that the shall be answerable severally for themselves only and not the one for the other or for the acts or defaults of the other or others of them but each for himself only and for his own acts and defaults and that they or any or either of them shall be charged or chargeable with or for such sums or sums of money only as shall actually come to his or their own respective hands by virtue of any of the trusts aforesaid And lastly I hereby appoint the said Sarah Wilkins and the said Jeremiah Bevan and Robert Brittan and Executrix and Executors of this my last will and testament In witness whereof I the said Testator John Flook have hereunto set my hand and seal that is to say my hand to the first and my hand and seal to this second and last sheet of paper the eighth July one thousand and eight hundred and thirty
