This is the last Will and Testament of me Hester Fluck of Tewkesbury in the County of Gloucester Widow for the Disposition of that Estate in the World that I have a tight to dispose of, first I Order and Direct that all my just Debts and Funeral Expences shall be fully paid and satisfied by my Executors hereinafter named out of my personal Estate, And I Give and Bequeath unto my Daughter Mary Gardner, Wife of William Gardner of Tewkesbury aforesaid Stone Mason All my Wearing Apparel of what nature or kind soever the same may be wheresoever being to be delivered unto her as soon as conveniently may be after my Decease by my Executors And all the Rest of my Linnen I Give and Bequeath unto and amongst the said Mary Gardner and my son Abraham Fluck in two equal Shares and Proportions, And as to all the Rest Residue and Remainder of my Goods Chattels, Money, Securities for Money, Debts, Implements of Household, and all and singular other my personal Estate and Effects of what nature, kind or sort soever the Same may be or wheresoever the same now are or may hereafter at any time be situate lying or being I Give Devise and Bequeath the same and every part or parcel thereof unto my Son Abraham Fluck and my Son in Law the said William Gardner To Hold unto them their Executors Administrators and Assigns Upon the trusts following (that is to say) Upon Trust that they the said Abraham Fluck and William Gardner or the Survivor of them his Executors or Administrators do and shall with all convenient speed after my Decease collect and get in all my Debts and Sums of Money as may be due and owing unto me and Sell and Dispose All my household Goods Chattels and Effects of what nature or kind soever the same may be For the most Money and best price and prices that can be procured for the same, and after payment of All Costs and Expences attending such Sale I Give and Bequeath the monies thence arising And also All and Singular my Personal Estate and Effects not hereinbefore by me disposed off and so given upon Trust as aforesaid in Three equal Shares and proportions unto and amongst my Children (namely) the said Mary Wife of the said William Gardner, My Son Abraham Fluck and The Children of my Son in Law John Warner by my late Daughter Hester Warner deceased at their Ages of Twenty One Years, And It is my Will that my Executors shall be at Liberty to satisfy and reimburse themselves for the Trouble and Expence they may be put into in the Execution of this my Will, and that they or the Survivor of them or the Executors or Administrators of such Survivor shall not be answerable for the Loss of any part of my Personal Estate not occasioned by their willfull neglect or default, nor shall one of them be answerable for the other of them, nor for the Acts or Receipts of the other of them And Lastly I Nominate Constitute and Appoint the said Abraham Fluck and William Gardner Joint Executors of this my last Will and testament In Witness whereof I have to this my last Will and Testament written upon two Sheets of paper annexed together to the first Sheet set my hand and to this second Sheet my Hand and Seal this Third Day of September in the year of our Lord One Thousand Eight Hundred and Three |
