WILL OF THOMAS MASCERY* OF MARCHINGTON


6 SEPTEMBER 1708

In the name of God Amen I Thomas Mascery of Marchington in the parish of Hanbury and County Stafford, Yeoman being weak in body but of sound and perfect mind and memory praised be God for the same and knowing the uncertainty of this life on earth and being desirous to settle things in order do make and ordain this my last will and Testament in manner and form following. And first, and principally I commend my soul into the hands of Almighty God my Creator hoping for mercy and salvation through Jesus Christ, my redeemer, and my body I commit to the Earth from whence it was taken, to be buried in such decent and christian like manner as to my Executors hereinafter named shall seem meet and convenient.

And as to my worldly estate which the Lord in mercy hath lent me, I dispose hereof as follows and first I will that all my debts and funeral expenses be paid and discharged and also that the sum of five pounds which was left to my grandson James Read by my sister Ellin Mascery and now remains in my hands be well and truely paid to the said James Read within three months after my decease.

Item I give and bequeath to my daughter Elizabeth Read one house barn orchard and croft which I heretofore bought of late George Vernon Esq deseased lying and being in Marchington aforesaid for and during the term of her natural life. And after her decease I give and bequeath the said house barn orchard and croft with appurtenances to my gradson James Read, his heirs and assigns for ever but for want of issue of the said James Read then I give and bequeath the same immediately after his decease to the brothers and sisters of the said James and their heirs forever equally to be divided amongst them.

Moreover it is my mind and will and I do hereby charge the said James Read with the payment of five pounds a piece to his brothers and sisters (to wit) George Read, Margaret Read, John Read, Mary Read and Edward Read out of the said estate in manner and form following that is to say to the eldest then living or to his and her lawful issue the sum of five pounds within one year after the decease of his said mother Elizabeth Read and five pounds yearly afterwards to the other young children until each one has received five pounds always preferring the older and his or her lawful issue.

If the said James Read shall so long live or leave behind him lawful issue for the enjoying of the said estate; but in case the said George and John who are now beyond sea or either of them do not return into this kingdom before the time that their respective sums of five pounds a piece shall become due aforesaid, then I do order of the said James Read or his heirs to his or their own use and the other moiety to be equally divided amongst his other brohters and sisters or their lawful issue then living.

Item It is my further mind and will that if at any time any of the said younger children being sole and unmarried shall be desolate of a habitation that then such child or children shall have free liberty to inhabit the kitchen and of the said house with the chamber over it at his, her or their wills and pleasure.

Item I give and bequeath unto my daughter Anne Deavill during her natural life the interest of forty pounds which is now due to me upon bond from Robert Isolt of Kingstone and after her decease I give and bequeath the said sum of forty pounds unto the children of my said Anne Deavill that shall be living at that time equally to be divided amongst them or if any of the said children shall be then dead having left lawful issue then the first born of each shall have a proportional share of said monies. And I do hereby appoint the said Robert Isolt trustee for the said sum of forty pounds desiring him to pay the interest thereof yearly to my said daughter Anne as the same shall become due. And after her decease to pay the said sum of forty pounds into the hands of Robert Smith of Sudbury whom I do make overseer of this my last Will desiring him to see the same faithfully and equally divided amongst the said children of the said Anne Deavill according to the true intest and meaning of this my last Will and Testament.

Item All the rest residue and remainder of my substance not heretofore bequeathed I give and bequeath unto my said two dauthers Elizabeth Read and Anne the wife of Luke Deavill to be divided equally between them and do hereby constitute and make the said Elizabeth Read and Anne Deavill joint executrices of this my last Will and Testament revoking and making void all former wills or will by me at any time heretofore made in witness whereof I have hereunto put my hand and seal this twenty sixth day of September Anno Domini 1708

WILL OF FRANCIS MASKREY OF SHIRLEY

8 AUGUST 1736

In the name of God, Amen, I Francis Maskrey of Shirley in the county of Derby Yeoman being weak of body but perfect in mind and understanding thanks to God do Make and ordain this my last will and testament in manner and form following My soul I recommend into the hands of the Almighty God, my creator. And my body I commit to the earth to be decently buried at the descretion of my executors herafter named And to touching My worldly goods which it hath pleased almighty God to bless me with I thus bestow them First of all I give devise and bequeath to my Loving wife Ellen Maskrey all my worldly goods cattle chattle and personal estate whatsoever and whosoever my debts and funeral expenses being first shall be paid and discharged Only if it is my will for my daughter Elizabeth to have two cows off the home of her mother for six months but if she continue with her mother she must have nothing Likewise if my son John set up with his trade before the decease of his mother if it is my will and desire for him to have either a hore or a mare and if he doth not set up his trade before the death of his mother it is my will and desire that nothing else be disposed of during her lifetime And at her decease it is my will and desire that for all the goods to be equally divided among my two younger children Francis and Joseph only paying my eldest son Smauel Maskrey 40 shillings but if my wife Ellen should take to her a second husband that she shall take nothing away from Francis and Joseph. And I do hereby constitute and appoint Francis and Joseph to be my executors along with their mother of this my last will and testament and I do declare this is my last will and testimony and I have put my hand to this on 8 Aug 1736

WILL OF JOHN MASKERY OF NORBURY

2 JULY 1765

In the name of God Amen, I John Maskery of the parish of Norbury in the County of Derby, yeoman, being of sound and disposing Mind and Memory do make this my last Will and Testament in manner following. That it is to say. First I give and bequeath all that my Leasehold Estate lying in the Liberty of Norbury aforesaid and now in my own possesion unto my dear wife Margaret Maskery. To hold unto her for and during the Term that is yet to come and unexpired in the Lease thereof made to my Father the late John Masery and by him bequethed to me by his last Will and Testament if she so long happen to live But if in case my said wife shall happen to die befoe the expiration of the term to me granted in the Lease thereof as aforesaid then I give and bequeath the Remainder therof unto my Sons John Maskery and William Maskery to hold unto them and their Assigns as Tenants in Common Also that my Third part of an undivided Messuage House and Land lying and being in the parish of Caverswell in the County of Stafford and now in the possession of Joseph Heath I give and divise unto my said Sons John Maskery and William Maskery to hold unto them as Tenants in Common and not as Joint tenants their Heirs and Assigns for ever. All other my Freehold Estate which lies in the parish of Norbury aforesaid I give and devise unto my said two Sons John Maskery and William Maskery to hold the same unto them as Tenants in Common and not as Jointenants their Heirs and Assigns forever. The Use of all and Singular my Goods Chattles Effects and personal Estate of whatever kind or Value the same may be of I give and bequeath unto my dear wife Margaret Maskery during the Term of her natural Life and from and immediately after her decease then I give and bequeath the same unto such of my Children or their representatives as shall happen to be living at the Decease of my said wife, equally to be divided amongst them Share and Share alike. I hereby nomainate and appoint my said wife Margaret and my said Son John Maskrey Executrix and Executor of this my last Will and Testament thereby revoking disannulling and making void all and every other former Will and Wills by me heretofore at any time made. In Witness whereof I have to this my last Will and Testament set my Hand and Seal this Second Day of July in the year of our Lord God One Thousand Seven Hundred and Sixty Five.

WILL OF WILLIAM MASKERY OF NORBURY

MARCH 1766

In the name of God Amen. I William Maskery the older of the Parish of Norbury in the County of Derby Yeoman being of sound and disposing Mind and Memory do make this my last Will and Testament in manner following First I give and bequeath unto my sons John Maskery and Joseph Maskery each the sum of One Hundred pounds to be paid unto them at Twelve Kalendare Months after my Decease The possession of the Brick Kiln at Birchwood Moor I give unto my son John Maskery. Also I give unto my two daughters Margaret Maskery and Mary Maskery each the sum of One Hundred Pounds but not payable before they shall respectively attain the age of Twenty One years The possission of the Farm I hold and enjoy under Hugo Meynell Esq I give with his Approbation unto my said Son Joseph Maskery All that my third part of an undivided Messuage House and Tenement lying and being at Caverswall in the County of Stafford the same into three parts equally to be divided and now in the Occupation of Joseph Heath as Tenant to the same I give and divise unto my dearly beloved wife Margaret Maskery To hold unto her my said wife during the term of her natural life and after her decease then my Mind and Will is that the same shall be sold in convenient time for the most Money that can be got and that the Money arising from the sale therolf shall be equally divided amongst my sons herein aforenamed share and share alike All that my Leasehold Estate lying in the parish of Norbury aforesaid I give and bequeath unto my son Thomas Maskery To hold unto him his Executors Administrators and Assigns during all the Time that is yet to come and unexpired in the Lease therof granted to my late father John Maskery and by him bequeathed to me by is Last Will and Testament to my said son out of the issues and profits therof finding and allowing unto my said dearly beloved wife sufficient and decent maintenance during her natural life if she shall so long remain unmarried and shall chose to live with him and also finding and allowing unto my two daughters Margaret Maskery and Mary Maskery a sufficient and decent maintenance until they shall respectively attain the age of Twenty One years if they shall chose so long to live with him All the Rest, Residue and Remainder of my personal Estate of whatsoever nature or Kind the same my be of I give and bequeath unto my said son Thomas Maskery to his own proper Use and Behoose forever And I fully trust and hereby make it my earnest Request that not only he but all my other children wil behave with all due decorum to my dearly beloved Wife their mother and yield unto her all the filial duty honour and obedience which so indulgent a parent may claim as her just due I also most ardently pray that Union Harmony and Concord may forever dwell and reign amongst my Children and that they will at all times and upon all questions muutually to the best of their power promote the Wellfare and Interest of each other I nominate and appoint my sons Thomas Maskery John Maskery and Joseph Maskery Executors of this my last Will and Testament herby revoking and making void all oter Wills by me at any time herbefore made.

WILL OF BARTHOLOMEW MASKRY OF WIRKSWORTH

29 MAY 1808

In the name of God, amen. I, Bartholomew Maskry The Elder of Gorsey Bank in the Parish of Wirksworth in the County of Derby, Stone Mason, being of sound and disposing mind, memory and understanding do make and ordain this my last will and testament in manner and form following: First, I will and direct that all funeral expenses and just debts shall be paid by my executors as soon as conveniently may be after my decease. First, I give and devise unto my son Anthony Maskry and his heirs and assigns forever all that uppermost house and garden in the front with all the appurtenances thereunto belonging situated at Gorsey Bank aforesaid and now in his occupation. Secondly, I give and devise at the decease of my wife Mary Maskry all that house and a square piece of land at the end of my son John Maskrey's house unto my two daughters Mary Maskry and Ann Maskry equal share and share alike and their respective heirs and assigns forever. And also I give and devise at the decease of my said wife Mary Maskry the yard before the said house unto my said two daughters Mary Maskry and Ann Maskry and their respective heirs and assigns forever equal share and share alike. Thirdly, I give and devise unto my son Bartholomew Maskry and his heirs and assigns forever all that messuage or dwelling house and premises with all the appurtenances therunto belonging and also, the garden in the front of the house as my son John Maskry lives in, also all the garden in the front which the said
Bartholomew lives in at this time.
Also I give and devise unto my son John Maskry and his heirs and assigns forever all that messuage or dwelling house with all the appurtenances thereunto belonging with all the garden at the back of the house now in the occupation of my said son John Maskry all these said houses as situated at Gorsey Bank aforesaid in the parish of Wirksworth and county of Derby. Also I give, devise and bequeath unto my two said daughters Ann Maskry and Mary Maskry equal share and share alike all my household goods of what nature and kind soever and their respective heirs and assigns forever. And lastly, I do hereby nominate, constitute and appoint my two sons Bartholomew Maskry and John Maskry joint executors of this my last will and testament hereby revoking all former and other wills by me made. I publish and declare this to be my last will and testament. In witness whereof, I the said testator Bartholomew Maskry the Elder the testator have hereunto set and put hand and seal this thirty first day of July in the year of our Lord One Thousand Eight Hundred and Three.

Codicil to the Will of Bartholomew Maskry

Also, I give and devise at my decease unto my two grandsons Benjamin Maskry and John Maskry and their heirs and assigns forever the sons of my son Anthony Maskry the shop that was built before my said Anthony Maskry's door equal share and share alike. also, I give and devise at my decease all my common right of allotment lately allotted to me at Gorsey Bank aforesaid in the Parish of Wirksworth and County of Derby which said allotment is divided in four parts the first part or allotment lying eastwardly I give and devise unto my grandson Benjamin Maksry, the son of Anthony Maskry and his heirs and assigns forever. The next and second allotment I give and devise unto my two daughters Ann Maskry and Mary Maskry equal share and share alike and their heirs and assigns forever. The third part I give and devise unto my grandson William Maskry the son of Bartholomew Maskry and his heirs and assigns forever. And lastly, the fourth part I give and devise unto my son John Maskry and his heirs and assigns forever, I the testator Bartholomew Maskry do confirm and add this as a codicil to my will which I made on the thirty first day of July One Thousand Eight Hundred and Three. In witness wereof I have hereunto set my hand and seal this Twenty Fifth day of August in the year of our Lord One Thousand and Eight Hundred and Five.

WILL OF BARTHOLOMEW MASKERY OF WIRKSWORTH

26 SEPTEMBER 1815

This is the last will and testament of me, Bartholomew Maskery of Gorsey Bank in the parish of Wirksworth in the County of Derby mason made this twelfth day of May in the year of our lord One Thousand Eight Hundred and Fifteen. First I will and direct that all my just debts funeral expenses and the expense of proving this my will be fully paid and dscharged by my executrix and executor hereinafter named as soon as conveniently may be after my decease. And I give divise and bequeath all that my dwelling house or tenement wherein I now reside with all the apurtenances thereto belonging and all the shop in the garden contiguous thereto and all and every my household furniture goods chattels and personal estate and effects whatsoever unto my loving wife Martha and her assigns for and during the term of her natural life and from and immediately after her decease then I give and devise and bequeath the said dwelling or tenement garden shop and household furniture unto and equally amongst my six children William, Ann John, Bartholomew, Benjamin and Mary their heirs executors administrators and assigns forever equally share and share alike and in case any of them shall happen to die before he she or they shall attain their age or ages of twenty one years then the share or shares of him her or them so dying to go to the survivor or survivors of them my said children their heirs executors administrators and assigns forever. And it is my will and mind that all my said children while they keep single and unmarried shall reside in the house with my said wife if they shall be minded and desirous so to do but not otherwise. And lastly I hereby nominate and appoint my said wife and son William joint executrix and executor of this my will hereby revoking all former wills by me at any time heretofore made and publish and declare this only to be my last will. In witness I the said testator Bartholomew Maskery have hereunto set and put my hand and seal the day and year first above written.

WILL OF JOSEPH MASKREY OF GORSEYBANK

1813

In the name of God, Amen. I Joseph Maskrey of Gorsey Bank in the parish of Wirksworth and county of Derby being weak in body but of sound and disposing mind and memory do appoint this my last will and testament in the manner and form following, that is to say I give and bequeath unto my loving wife the house and appurtenances unto me belonging for and during her natural life subject to pay all my just debts and funeral expenses. Secondly, I give unto my son Joseph the house that I now live in and 1/2 of the gardens with the pantry adjoining to his proper use and benefit for ever subject to the following conditions and particulars, that is to say the sum of 12 pounds within 12 months after her decease and that sum to be equally divided among my three daughters Grace, Mary and Dorothy share and share alike. Thirdly, I give and bequeath unto my son John all that end called the Smith end with all the stone ground and materials and also the other half of all the gardenings subject to the following conditions and particulars, that is to pay the sum of three pounds with 12 months after her decease and that sum to be divided among my three daughters share and share alike.
