The Trial started April 3, 1944, in Corning, Honorable John C. Wheeler, Supreme Court Justice presiding. The action was brought by the widows against:
Keeshin Motor Express Co., Inc.

The Widows sought judgment of $75,835.00 with interest from December 14, 1943.
Before the trial was over Keeshin And Seaboard settled for a total of $95,000.00. Charges against the companies and Maroney were dropped. The jury also awarded a judgement against William Platt, owner of the Bus, of $36,405.00 . However Platt appealed and the Appeals Court set aside the judgement on the basis of the facts that showed no negligence or fault on Platt's part.
The widows , of course testified at the trial. The Widow of Malcolm Ferguson received a settlement of $16,500.00
