Book W, p 474, Section 10, Tp 49, R 7, 40 acres, Recorder of Deeds, Callaway County, Mo

	To all whom it may concern know ye that I Daniel C. Hays have announced 
suit in the Circuit Court of Callaway County Missouri as plaintiff against 
Charles Helen, Tyra Bishop, David Bishop, Daniel Bishop, Addison Bishop, Mrs
Ginia Oliver, Iletha Oliver, Mary Peery, Albert Peery, Virginia Turk, Robert 
Turk, Saml Bishop, Beverly Bishop, John Bishop, David Bishop and Granville
Bishop as defendants brought to the April term 1867 of said Court the object
of which is to correct a mistake in a deed made by Saml Bishop the ancestor of
the aforsaid Bishop and made to Charles Helen and a mistake in a deed from said
Helen to Daniel C Hays as follows, to wit:  said Bishop the ancestor sold to 
said Helen the North West Quarter of SW Qtr of Section 10 Township 49 Range 7.
But through mistake said Bishop conveyed to said Helen the North West Qtr of the 
South East Qtr of Section 10 same township and range that afterwards I and 
Daniel C Hays purchased of said Helen the SE Qtr of the NE Qtr of Section 9 
also SW Qtr of NW Qtr of Section 10 Also fifteen acres off the North end of
NE Qtr of SE Qtr of Section 9 Also fifteen acres off the North End of the 
NW Qtr of SW Qtr of Section 10 all in Township 49 Range 7.  That through mistake
the said Helen conveyed to said Hays the following land instead of the 
aforsaid disoviled? lands to wit:  The East half of the North East Quarter of 
Section 9 fifteen acres off the North End of the West half of the SW Qtr of
Section 10 also fifteen acres off the West End of the East half of SE Qtr of
Section 9 all in Township 49 Range 7  Daniel C Hays has commenced the suit
aforsaid to correct the mistake in said deed and to cause the title of said
defendants in said lands so purchased by him to be vested in him that he may 
have the legal title in the lands as purchased by him.
