Staton & Letitia Staten …Robert Marshall and Mary E., his wife, are non-residents of the State of Tennessee …order Robert Marshall and Mary E., his wife, appear at or before the next Chancery Court on 4th Monday of August nest… R. Farquharson, Clerk and Master Warren Beasley of Wake County, NC by deed of gift gave two slaves, Orpha and Madison to his two children, George and Margaret; one slave named Cynthia to his daughter Mary E. and one slave named Aley to his daughte compl’t Martha J. that subsequently slaves Orpha and Madison were sold to pay debts existing at time the said deed of gift were made. The office, books, and papers where the deeds of gift were recorded, were destroyed by fire. Said Warren Beasley died intestate about 20 years ago in said County of Wake, leaving his four children above named, all minors, and their mother, Letitia, his only heirs distri…, Compl’t do not certainly know, but charge that one Ezekiel Hilliard adm’r upon his estate, who shortly thereafter died and some person of Compl’ts unknown was appointed guardian of said infant children, who afterwards removed with her four children and said slaves Cynthia and Aley to Limestone County, Alabama. After paying the debts of said Warren Beasley, there remained a Negro boy, Alfred, said Letitia as guardian, obtained possession of said boy, and caused him to be removed to Alabama, Mary F. intermarried with Robert Marshall, who resides in Madison County , Alabama, who with the assent of said Letitia obtained possession of the slave Cynthia and have ling since sold her. Said Letitia removed to Lincoln county, Tennessee and brought her three children, George and Margaret who intermarried with Archibald Hilliard and Matha J. who intermarried with Compl’t Seabird Pigg, together with said slaves, knowing they were conveyed to her children, and that she has, or had possession of deeds of gift; compl’ts were prevented from discovering that they had title to said slaves by the fraudulent conduct and conflicting statements of said Letitia. Aley has had since one child, aged about 18 months, Cynthia has had several children, number not known to compl’ts. About March last, Letitia intermarried with William Staten who is now in possession of said slaves Aley and her child, Alfred. Compl’ts insist that said Staten and wife be compelled to bring Cynthia and her children of this county. Said Staten conveyed one fourth part of said slaves, Alfred and Aley and Child, To Anderson C. Martin, which conveyance is not bona fide by merely colorable for want of any adequate consideration. Said Martin had notice of compl’ts title to said slaves and is now endeavoring fraudulently to assist said Staten and wife to remove them beyond the jurisdiction of this court. Said Letitia is accountable for Cynthia and her children, and said Martin obtained no other or better title than held by Staten and wife. PRAYER – THAT SAID Staten and wife, Marshal and wife, Hilliard and his wife, George Beasley and said Martin may answer, and that by a decree, the conveyance to said Martin may be declared void. Said Alfred sold and the proceeds equally divided and for an account of hire & e. –Or the event that the whole of said slavers should be equally divided, that Staten and wife, said Martin and said Marshall and wife account for said Cynthia and her children and the hire of trhe whole of said slaves, and that they be sold & e. and for other and further relief.
