Last Will and Testament Of Ephraim Willson Sr.

 

 

I, Ephraim Willson, the Elder, of the Town of Berlin, in the County of Waterloo and Province of Ontario, Gentleman, being of sound and disposing mind, memory and understanding as to make, publish and declare this to be my last Will and Testament, in manner and form following:____________________________________________________________________

First. I will that all my just debts, funeral and Testamentary expenses be paid out of my Estate by my hereinafter named Executors and Executrix and the residue of my property I give devise and dispose thereof as follows:

Second. I give and devise unto my beloved wife Margaret, an annuity of Eighty Dollars, to be paid to her annually so long as she remains my Widow, (unmarried) further I will that a comfortable house be erected within one year after my decease, on my farm, being part of the East Half of Lot Number Thirty Seven, of the German Company Tract, of the Township of Waterloo, for the sole use and behoof of my said wife so long as she remains unmarried as foresaid. She shall also be at liberty to retain out of my household furniture, or my said Executors to procure for her the necessary furniture to furnish said house. My son Isaac shall provide my said wife with sufficient fire wood ready for use, delivered at her door during the term of her natural life, or so long as she remains unmarried as foresaid.

Third. I will and devise unto my beloved Daughter Emma, the wife of John Brighton, The sum of Two Hundred Dollars to be paid to her or her legal representatives within two years after my Decease.

Fourth. And the remainder of all my Real and Personal Estate I will and devise unto my beloved son Isaac to have and to hold to him, his heirs and assigns forever.

Fifth. And I further will, that after the death of my said wife, or the event of her again marring, the property devised to her shall revert to my said son Isaac, or his legal representatives.

And I do hereby nominate and appoint my trusty friend William Pipe of the Town of Berlin aforesaid Physician and my son Isaac of the Township of Waterloo in the said County Yeoman Executors and my said wife Margaret Willson Executrix of my last Will and Testament and I do hereby authorize and empower them or the Survivors or Survivors of them, or the Executors or Administrators of such Survivor to execute all such Deeds or Conveyances as my be requisite and to collect or cause to be collected all my outstanding debts, dues, Mortgages, Bonds, Bills, Notes, Book, accounts and all other claims and demands whatsoever and to adjust, compromise, compound for and settle all matters and things depending between me and any person or persons whomever, and to grant Releases and acquittances in as full and ample a matter as I might or could do.

Hereby Revoking, canceling and annulling all former wills be me at any time heretofore made. I declare this only to be my Last Will and Testament.

In witness whereof I have hereunto set my hand and seal this Seventh day of June, in the year of our Lord One Thousand Eight Hundred and Seventy Two.
