September 6, 1832; "This indenture made the sixth day of September
in the year of our Lord one thousand eight hundred and thirty two Between
James Johnson Jr. of the town of Oppenheim in the County of Montgomery
and State of New York of the first part and Shuler C. Higbie and Abi A.
Phipps of the place aforesaid of the second part, Witnesseth that the said
party of the first part, for and in consideration of the Sum of seven hundred
& fifty dollars to him in hand paid by the said parties of the second
part the receipt whereof is hereby confessed and acknowledged hath bargained
sold released and Quit Claimed and by these doth bargain, sell, release,
and Quit Claim unto the said parties of the second part, in their actual
possession now being and to their heirs and assigns forever All of the
equal undivided half of ____ of that certain lot piece or parcel being
within the Limits and bounds of a certain tract of land granted by
Settlers Patent to Sarah Magin and others the 3rd March 1761 and is known
and distinguished in said tract by lot number three being a subdivision
of the large lot number forty five and begins at the North West corner
of lot number two of said subdivision and runs from thence along the East
bounds of the aforesaid lot number two of said subdivision South thirty
two degrees West fifty two chains and twenty five links to the South bounds
of said larger lot, number forty five thence along the same North fifty
eight degrees West twenty five chains then North thirty two degress East
fifty two chains and twenty five links, then South fifty eight degrees
East twenty five chains to the place of beginning. Containing one
hundrend and thirty acres two roads and twenty pieces of land strict measure.
Also the equal undivided half or ___ of the westerly equal half of lot
No. two of the large lot No. 45, in said Sarah Magins Patent bounded as
follows Beginning at the North East corner of No. three of No. forty five
thence South fifty eight degrees East twelve chains and fifty eight links
thence South thirty two degrees West fifty two chains and twenty five links
to the South bounds of the number forty five, thence north fifty eight
degrees West twelve chains and fifty links thence to the place of beginning
estimated to contain sixty five and a half acres of land. Together
with all and singular hereditaments and appurtenances thereunto belonging
or in any wise appertaining and the reverse and reversions remainder and
remainders, rents, ____ and profits thereof and all the estate right or
equity of in and to the above bargained premises with the hereditaments

April 1860; Voted to Executive committee of 5 for Smithfield Republican Club at the 1st meeting held at the Fay house on Saturday eve, March 24th, 1860. Others present were A.C. Stone, Jesse Watson, William A. Stone, Charles Cutler, John N. Woodbury, Joseph E. Morgan, Jeremiah Eisaman, Austin A. Moore, Anzi S. Hungerford, etc. Purpose was to promote causes of Republican party and officials.
September 1, 1862; Abi issued a license to carry on a wholesale business in the town of Canastota, Madison Co., N.Y.. $50.00 licensing fee. (business license)
December 24, 1866, Clockville, Madison Co., N.Y.; Abi Phipps of Peterboro,
Madison Co., N.Y., entered into a purchase agreement with H.H. Hathaway
and wife Nancy, to buy a house and lot of 1 1/2 acre for $2,1050.00, located
in Clockville, Madison Co., N.Y.. This was part of Lot # 11 of the
Oneida Purchase of 1802, east of the 2 mile strip. (then town of
Lenox, now town of Lincoln.) (This property 10/1/1852 purchased by
Ralph May from Silas Spaulding for $300.00; sold 5/6/1858 to Robert C.
Ellis of Clyde, N.Y. for $750.00; to Nicholas N. Kilts 1859; sold 3/22/1860
to Rachel Thompson for $700.00; 3/16/1863 sold to H.H. Hathaway for $700.00;
3/26/1867; sold to Abi A. Phipps. Hathaway had rebuilt house.)

son Alton at her death. On Alton's death, his sister remained in the house
until the 1960's when she could no longer maintain it. The house

Purchase of 1802 - this being a piece of land heretofore deeded by Reuben

April 24, 1876; Abi and Diana sold to Charles Keeney of Clockville,
Madison Co., N.Y., the parts of Lot # 5 and 6 in the 1802 Oneida Purchase
that had been purchased from John M. White in 1870. (deeds)
November 11, 1876; purchased property in Smithfield from James G.
Messinger and his wife Ann Elizabeth Phipps Messinger (daughter of Abi
and Lydia Kibbe), for $4,000.00. This property was located south
of Peterboro, part of Lots # 26 and 33 in the New Petersburgh Tract, covering
50 acres more or less, intending to cover all the land conveyed by Milton
L Dennison and wife to James G. Messinger on June 2, 1873. This same
property was returned into the hands of James G. Messinger on March 22,
1877 for the original purchase price of $4,000.00. (deeds)

Purchase east of the 2 mile strip in the town of Lenox for $375.00 - 2
acres. This was sold on mortgage foreclosure and filed Feb. 15 1881.

March 20, 1893; Abi purchased from wife M. Gena Parkhill Phipps for
the sum of $350.00, in the town of Lenox, part of Lot # 6 of the tract
of land lying east of the 2 mile strip on the south side of the late Senecca
Turnpike and bordered north by the turnpike, south by the road leading
from Quality Hill by the late Nathaniel Hall residence, and east by the
premises formerly owned by the deceased John Miles, opposite public
square in said Quality Hill near Sylvester Beecher's lot. This being
the same property conveyed by Ziba Cloyes to Gardner Smith on 4/6/1850.
This property covered 1 32/100 acres. On Abi's death this property
reverted to M. Gena again, and on August 8, 1901 she sold the property
for $450.00 to Patton and Stafford Co. They retained the property
until August 31, 1906 when it passed into the hands of William H. Morris.
Milton Delano acted as receiver for Patton and Stafford Co. (Patten
and Stafford started in 1882 to make wheel rakes in Clockville taking over
the manufacturing business of Joseph L. Mansfield in a building that had
formerly housed a woolen factory 40 years earlier. Patten and Stafford
moved the business to Canastota on purchasing this property.)
In 1910 this property was the Tuttle Motor Co.. (Madison Co. Deeds)

The undersigned, Elizabeth Messenger, one of the next of kin of the said
decedent, hereby contests the validity of the disposition of the Real and
Personal Estate of the said decedent, of which he died seized and possessed,
containing ______certain paper wirting, bearing date the 20th day of _____
1895, and puported to be his last Will and Testament, ___ted to and now
before this Court for probate, as a Will of Real and Personal Estate and
for answer to the Petition of Gena Phipps for the probate of said will,
she avers, upon information and belief, as follows:
1st. - That said paper is not
the last Will of said decedent and that the alleged execution thereof,
was not his free unconstrained or voluntary act.
2nd. - That neither at the time
said paper purported to have been executed, or at any time when it was
executed (if so executed) was he of sound mind, memory and understanding.
3rd. - That said decedent was
unduly influenced in the alleged execution of said purported Will by Gena
Phipps, one of the legatees named in said Will and if said decedent executed
said will, he did so while he was under the undue influence exerted upon
him by said Gena Phipps, and did not execute the same as his own free,
unconstrained or voluntary act.
Wherefore, the above named, Elizabeth Messenger, contestant, prays that
probate of said Will may be denied and the proceedings be dismissed with
cost.
