May 29, 1809; wrote will "...of Holliston, gentleman....weak
in body..." Wife Hannah left 1/2 of household stuff and 1/2 of provisions,
and could have her choice of 2 of the cows. She would have the "use
and improvement" of the real estate they were now living in as long as
she was his widow. The property was described as lying east of the
county road and the road to Medway, also the meadow and woodland adjoining
Winthrop Pond. The east room with bedroom adjoining, the chamber
over the bedroom and the garret over the east room would be hers, plus
use of the kitchen, oven and cellar and the north half of the barn, "excepting
the cider mill". She would further have the use of his pew in the
meeting house and the use of the well water. If she was widowed
a second time, she "shall have the priviledge of returning and improving
the aforesaid real estate while she remains a widow."
He left his daughter Hannah, $500.00 plus interest
when she reaches full age with annual interest for $200.00 of the same
after 1 year, and annual interest for the other $300.00 after 4 years from
my decease. Also $300.00 to pe paid to her in 1 year "after the decease
of my wife". The 2 sons, Eli and Joseph Phipps got the rest of the
estate.
The executors were Abner Morse of Medway, Esq. and
Eli Phipps Witnesses were Elihu Cutler (niece's husband), Martin
Cutler and Alex H. Jones

January 10, 1816; She was questioned by the Holliston town selectman and found incompetant. The selectman who signed were Aaron Eames, John Mellen, Elihu Cutler, Nathan Lealand. She is ordered to appear January 12,1816 if she disputes this. (Middlesex Co. Probate)
January 12, 1816; Nathaniel Johnson, gentleman, of Holliston is appointed her guardian. $10,000.00 paid as surety by he and John Mellen, of Holliston, and John Wheeler of Cambridge. (Middlesex Co. Probate)
February 6, 1816; Attorney Eli Bullard,
attorney, speaking for Hannah Phipps says she would like to appeal the
guardianship decree at the next Supreme Court for the following reasons;
"1. On the day the decree was passed.... and was abundantly
capable of taking care of herself and directly managing her property and
concerns and this she is ready to certify.
2. That said decree was passed against her without
the ______ ______ of the selectman of said Holliston first legally had
and obtained as the law directs and this also she is ready to certify...
4. That the whole ____ was obtained by deceit
and imposition and ought therefore to be _____."

February 22, 1816 "...To Nathaniel Johnson of Holliston, in said county, gentleman... whereas it has been represented to the Honorable James Prescott, Esq. Judge of Probate in and for said county, by Hannah Phipps of said Holliston, widow, and divers other persons, inhabitants of said Holliston, that you, the said Nathaniel Johnson, at a Probate Court, holden at Cambridge in and for said county, on the second Tuesday of January, were, by the said Judge, appointed guardian to said Hannah Phipps as a person non compos mentis; that said Hannah Phipps then was, and now is, a person of sound mind and capable of taking care of herself and her property and of managing all her affairs; that the notice which she had of the complaint against her for the purpose of getting you appointed to that trust, was so short, the weather so severe, and the travelling so bad, that she could not reasonably attend said court or procure her with ___ and suitable consul to defend her against said complaint and praying that you after due notice, may be discharged from said trust and she be liberated from the restraints and disqualification of guardianship..." Captain Nathaniel Johnson was called before the Judge 2/29/1816 at 9 am.

October 24, 1822; To the court "... guardian has made no provision for her support or ever advanced her a single cent therefore, although he has been in the quiet possession of the land and other property assigned her as her dower and for her ample support nor has the said Johnson collected the just rents due to her at the times of his appointment, but has wholly neglected to do. That said Johnson has suffered the fencing stuff to be taken away from the land assigned her as dower and ____ a waste. And he committed on the same by cutting down the timber and wood thereon standing and growing and carrying the same to market. That the said Johnson has wholly neglected to pay just debts of ..... but has unjustly and inhumanely suffered her to be arrested and committed to the common goal in Concord on a small execution ____ upon a just claim and ___ without money for her support or comfort although he has received or might have received the rents and profits of her dower being of the annual value of 50 pounds..."
October 24, 1822; The 2nd inventory was approved
by the judge and signed with satisfaction by William Phipps, William Rockwood,
Levi Adams, Asa Whiting - all selectman.
Her
dower land was rented to son Eli Phipps who was keeping her
April 14, 1826; Dr. Timothy Fish paid for doctoring
her.
The 3rd inventory was approved by the judge
and signed by; Elihu Cutler, Levi Adams, John Death, William Rockwood,
James Adams - all selectman.
February 20, 1827; The 4th inventory was approved by the judge and signed by selectman; Abner Johnson, Sewall G. Burnap, Amos (?) C. Lealand, Calvin Lincoln, Hiram Coop (?).

March 12, 1840; Nathaniel Johnson asks to be discharged from his guardianship due to being sick and not expected to recover. Eli Phipps, the only living son, asked for Elijah Kingsbury, of Holliston, yeoman, to be appointed in Johnson's place. This was granted him.
March 17, 1840; $2,000 surety by Elijah Kingsbury, Eli Phipps, Aaron Phipps, all yeoman of Holliston. Witnessed by James Cutler and Sarah A.W. Phipps
