I give and bequeath to my Son Samuel all my land and Real Estate except what I before given to my Son John, and all my Farming Tools to Samuel and all my livestock besides what has been already been given to my Wife.
Lastly I do by these presents constitute and appoint my son Samuel Phipps of Brookfield aforesaid, sole Executor of this my last Will and Testament...." (Worcester Co. Probate)

April 11, 1809;  "Know all men by these presents That we Samuel Phipps, Gentleman Nathan Allen, Gentleman Archelaus Thomas, Yeoman all of Brookfield in the County of Worcester within the Commonwealth of Massachusetts, are holden and stand firmly bound and obliged unto Nathaniel Paine, Esq. in the full sum of Ten Thousand dollars to be paid unto the said Nathaniel Paine his successors or assigns, in the office of Judge of Probate.... That if the above-bounden Samuel Phipps Executor of the last Will and Testament of John Phipps late of Brookfield aforesaid, deceased, do make or cause to be made a true and perfect inventory...."(Worcester Co Probate)
