Bef 1831; Before his marriage he bought a sawmill in Oppenhiem, Fulton Co., N.Y. and engaged in the lumber business. Learning the trade of carpentry while running the mill he took contracts to frame buildings and afterselling the mill engaged in that trade for a time before turning to farming. (Madison Co. 1837; Assessed for 100 value of personal property Town of Oppenhiem. (Town Tax Rolls)
1838; Assessed for 200 acres at a value of 800 in town of Oppenhiem. (Town Tax Rolls)

1861; He moved to Oneida and purchased various commercial properties, including those along Madison Street to improve and resell, 1st forming a partnership with S.H. Farnham with whom he purchased a property on Madison Street which was kept as a warehouse for 2 years, it being then sold and converted into stores. (Madison Co. 1899; He owned 2 houses, one a double house on Spring
Street - now McArthur Parkway. The smaller house was rented for $8.00
a month. There were numerous receipts for repairs made to these houses
after his death during the year 1900.
Personal Inventory of David Phipps at death
The will was contested by M. Gena Parkhill Phipps, widow of Abi Phipps, who engaged T. A. Devereau as attorney from September to November 1899. She stated that she was acting in the interests of her fatherless children, Allie and Alton, niece and nephew of the deceased.

"In the Matter of Proving the last Will and Testament
of
David H. Phipps, deceased
Objections to Probate of Will
To the Surrogate's Court of the County of Madison:
-
Alton Phipps and Allie Phipps,
heirs at law and next of kin of David H. Phipps, deceased, infants, by
T. A. Devereux, their special guardian in this preceeding, hereby object
to the probate of the alleged will of David H. Phipps dated July 13, 1896,
and heretofore presented to this Court, and allege as reasons for such
objection the following grounds, viz:
1st. That said alleged Will
is not the last Will and Testament of said David H. Phipps.
2nd. That the signature to
said Will is not the signature of said David H. Phipps, and said will is
not signed by him.
3rd. That at the time
said alleged Will purports to have been executed said David H. Phipps was
not of sound mind or memory, or capable of making a last Will and Testament,
or of disposing of real or personal property by Will.
4th. That said alleged
Will was not the free and voluntary act of said David H. Phipps, but that
if the same was ever executed by him, such execution was obtained and made
through fraud and undue influence on the part of the executor and some
or all of the legatees named in said alleged Will, and also on the part
of Delos Stebbins and Ida Stebbins, the witnesses to said alleged will,
and particularly on the part of Volney Isbell and Mrs. Abbie Dygert.
And the said Alton Phipps
and Allie Phipps, by their said special guardian, also object to the probate
of the alleged codicil to said alleged will, which codicil is dated July
16, 1896, and was heretofore presented to this Court, and they allege as
reasons for their said objection the following grounds, viz:
1st. That said
codicil is not the codicil to the last Will and Testament of said David
H. Phipps, deceased.
2nd. That at the date
of the alleged execution of said codicil said David H. Phipps was not of
sound mind or memory, or capable of making a last Will and Testament, or
of disposing of real or personal property by Will.
3rd. That said
alleged codicil was not the free and voluntary act of said David H. Phipps,
but that if the same was ever executed by him, such execution was obtained
and made through fraud and undue influence on the part of Volney Isbell
who was names as executor in said alleged will, and some or all of the
legatees named in said alleged will.
