Text of will of Jacob Matthias:

In the name of God Amen. I Jacob Mathias of Carroll County in the State of Maryland being advanced in years and weak in body, but of sound and disposing mind, memory and understanding, considering the certainty of Death and the uncertainty of the time thereof, and being desirous of settling my worldly affairs, and be thereby the better prepared to leave this world when it shall please god to call me hence, do therefore make and publish this instrument of writing as my last will and testament, in manner and form following.

That is to say first and principally I commit my soul into the hand of the Almighty God who gave it unto me, and my body to the earth to be decently buried at the discretion of my herinafter named executor. And my personal estate I dispose of as follows. I give and bequeath unto my beloved wife Catherine Mathias my rockaway buggy and harness, and the privilege of taking as much of my household and kitchen furniture as she may make choice of. Also fifty Dollers in cash to be paid to her by my Executor as soon as that amoung may come into his hands.

And all the remainder of my personal property I order and direct my Executor to sell at public sale as soon as convenient after my death, and after all is converted into money and my outstanding notes and accounts collected and my Just debts and funeral charges paid out of it as well as the fifty dollers paid to my widow as before directed, I order and direct that the remainder of the proceeds be equally divided among all my children from the oldest to the youngest share and share alike.

I give, devise and bequeath unto my son Josephes Mathias a house known as my tenant house together with a tract of land ? of for tha purpose being a part of my home farm. And being a part of that tract of land called "? Intention? situate lying and being in Carroll County in the state of Maryland. Beginning ? outlines to include said parcel of land at a stone standing at the end of the second line of the fifth parcel of land described in a Deed of conveyance from Jacob Geemin(?) to Jacob Mathias bearing date the 21st day of April 1845. And running whence bounding on the 3 line therof to correspond with the same South sixty three degrees West thirtynine perches to a marked hickory sapling whence by line of division now fixed and agreed upon the two following courses, 1st South twentyfive and one fourth degrees, East thirty perches to a stone now planted. 2 North sixty four degrees East fortythree and four tenth perches until it intersects the 2 line aforesaid at the end of thirtyone perches reversely or said line whence bound. Thereon to the first place of begining containing seven acres three roods and eight perches of Land more of Less, together with all the buildings and improvements thereto belonging, nevertheless upon the following terms and conditions, that is the said Josephes Mathias shall pay at the rate of fity dollers per acre, to be paid in installments of fity dollers annually without Interest until due each payment to be equally divided among all my children including himself. Paid parcel of land shall at all times be subject to a right of way through it on the bed of road now used for the purpose of hauling limestone to the farm.

I further give and bequeath unto Josephes Mathias (?) rails and pos sufficient to make the line fence between said tract of land and my home farm. And the said Jospehes Mathias shall put up the fence at his expence. I further order that if said Josephes Mathias shall at any time dispose of said property he shall give the person owning my homefarm at the time the first chance to purchase the same, providing he will give him as much for it as he can get from other persons.

I devise and bequeath unto my son Jeramiah Mathias all the land belonging to my home farm not herein before Devised. Also my wood lot lyeing on bottom run, together with all the building and improvements belonging to the differnet tracnts, nevertheless upon the folowing terms and condition, that is the said property shall be surveyed and the whole of it to be included in one set of courses and a plat made of it at the expence of my estate. And said Jeramiah Mathias shall pay at the rate of fifty dollers per acre for the home farm and twnety dollers per acre for the timber lot, to be paid in the following manner, that is two thousand dollers whall be and remain in the farm dureing the natural lifetime of my widow and the intereste thereof to be paid to her anually, said two thousane dollers to be a lien upon the property until paid. And the remainder of whatever the property will amount to he shall pay as follows, one thousand dollers to be paid on the first day of April after my Death and then one thousand dollers anually until all is paid. Each payment to be paid as follows, viz - one fifth part thereof to my Daughter, Ellen Bixler, one fifth to Edward Z.(?) Mathias, one fifth to my Daughter Juliann Little, one fifth to Joseph Mathias and one fifth part the said Jeramiah Mathias shall retain for himself. And after the death of my widow the two thousand dollers above mentioned shall be paid in five equal anual enstallments, each payment to be equally divided among all my children the same as the other payments. And said Jeramiah Mathias shall give unto my widow the use of the room and kitchen that I now occupye. And after the death of my widow I order my executor to sell all the property herein given to her, and the proceeds thereof to be equally divided among all my children.

And Lastly I do hereby constitute and appoint my son Jeramiah Mathias to be the sole Executor of this my Last Will and teatment revokeing and anulling all former wills made by me, ratafying and confirming this Instrument of writeing as my last will and none other. In witness whereof I hereunto set my hand and affix my seal this third day of July Eighteen hundred and sixty two.
