will is difficult to read and the following omits a part which is lengthy
and wordy legalese of the day.
The Will of Joseph Vines
of Stockham Marsh Farm Foxham 19th May 1829
This is the last will
and testament of me Joseph Vines of the Parish of Bremhill in the
county of Wiltshire, yeoman. I direct that all just debts funeral and testamentary
expenses shall be fully paid by my executrix and executors hereinafter
named so soon as it may be convenient to do so after my decease.
I give and bequeath
unto my son William Vines the legacy or sum of one hundred
pounds and I give unto him all my stock of horses, cattle, pigs, waggons,
carts, harness and dairy utensils and all other of my farming stock of
what kind so ever upon the farm at which I now reside on and rent of the
Marquis of Lansdowne situated at Stockham Marsh in the Parish of Bremhill
aforesaid.
I give and bequeath
unto my grand daughter Elizabeth, the daughter of my late son Joseph
Vines the legacy or sum of one thousand pounds, the same to be a vested
interest in her on her attaining the age of twenty one years or on her
marrying before that age with the consent of my daughter Ann Vines
and I authorize and require my executrix and executors hereinafter named
to place out the said sum of one thousand pounds at interest on Government
or real security in England, until my said grand daughter shall attain
the said age of 21 years or marry with such consent as aforesaid
and I empower them to apply the interest dividends and annual proceeds
thereof towards the maintenance and education of my said grand daughter
during her minority or otherwise to permit the same to accumulate for her
benefit
Provided nevertheless and
I do hereby declare that if my said grand daughter Elizabeth Vines
shall depart this life before attaining the said age of 21 years and unmarried
and either during my lifetime or after my decease Then I declare that my
said executrix and executors hereinafter named shall stand possessed of
the said sum of one thousand pounds in trust as to three hundred pounds
part thereof for the benefit of all and every the children of my son
William Vines in equal shares and proportions
As to four hundred pounds
further part thereof in trust for all and every the children of my
late son in law Benjamin Pegler of Foxham aforesaid equally to be
divided between them share and share alike.
And as to the sum of three
hundred pounds remaining part of the said sum of one thousand pounds
in trust for all and every the children of my son in law William
Lester (Lessiter on marriage register entry) equally to be divided
betweem them, share and share alike.
I give and bequeath unto
my grand daughter Ann Lester (Lessiter) daughter of the said
William
Lester the legacy or sum of five hundred pounds the same to be vested
interest in her on her attaining the age of twenty one years or marrying
before attaining that age with the consent of my daughter Ann Vines and
I authorise and require my executrix and executors hereinafter named to
place out etc .
... In trust for all and
every the brothers and sisters of the said Ann Lester equally to be divided
between them share and share alike
I give and bequeath unto
my daughter Ann Vines, my nephew Charles Vines of Spirthill
yeoman, and my friend John Morris of Foxham yeoman, the sum of one
hundred pounds upon trust, that they or the survivor of them or the executors,
administrators or assigns of such survivor do and shall place out the same
at interest in the funds or some other security and do and shall expend
yearly from the said principal sum and the interest thereof the annual
sum of ten pounds in the purchase of coal and I direct them to distribute
such coal at their discretion amongst the most deserving poor families
residing within the tything of Foxham in the parish of Bremhill aforesaid.
I give, devise and
bequeath to the said Charles Vines and John Morris a legacy
of twenty pounds each and I give devise and bequeath all my freehold estates
whatsoever and wheresoever and all my household goods and furniture and
all other my personal estate whatsoever and wheresoever unto my daughter
the said Ann Vines etc
And I appoint the said Ann
Vines and Charles Vines and John Morris as my executors

This is a codicil to the
will of me Joseph Vines of the Parish of Bremhill yeoman, bearing
date nineteenth day of May one thousand eight hundred and twenty nine.
I confirm the legacy of one hundred pounds bequeathed by me to my son
William Vines and I revoke and make void the bequest to him of my stock
of horses, cattle, pigs waggons carts harness dairy utensils and all other
my farming stock upon the farm which I rent of the Marquis of Lansdowne
and I give and bequeath the said stock of horses, cattle, pigs waggons
carts harness dairy utensils and all other my farming stock unto my daughter
Ann
Vines for her absolute use. I release acquit and discharge my said
son William Vines of and from all debts, sum and sums of money which he
may owe me at the time of my decease and I give and bequeath unto my grandson
Richard
the son of my said son William the legacy of one hundred pounds for
his absolute use. In all other respects I confirm my said will.
In witness thereof I have
hereunto set my hand and seal this tenth day of December one thousand eight
hundred
and twenty nine.

I Joseph Vines, declare
this to be a second codicil to my will which bears date the nineteenth
day of May last, whereas I have by my said will given a legacy of one thousand
pounds to my grand daughter Elizabeth the daughter of my late son Joseph
to become a vested interest in her on her attaining the age of twenty one
years or marrying before that age with the consent of my daughter Ann
Vines and in case of her dying bfore acquiring a vested interest therein
I have disposed of the said sum of one thousand pounds in the manner mentioned
in my said will. Now I hereby declare that the said legacy of one thousand
pounds shall be subject to the sum of two hundred pounds being retained
thereout by my executors and executrix during the natural life of Elizabeth
Vines the mother of my said grand daughter Elizabeth, the said
two hundred pounds to be held by them upon trust to pay and apply the interest
thereof for the use and benefit of the said Elizabeth Vines the mother
during her natural life. In case the said Elizabeth my grand daughter
shall happen to die before acquiring a vested interest in the said legacy
the persons to whom I have given over the same shall during the natural
life of the said Elizabeth Vines the mother have a proportionate
abatement made from their respective legacies, but the same to be made
by the application of the two hundred pounds for that purpose upon the
decease of the said Elizabeth Vines the mother. In witness whereof
I have hereunto set my hand and seal this thirteenth day of January one
thousand eight hundred and thirty.
