The Will of Ann Vines Of Malmesbury 1816
Ann Henly the Widow of Edward1725 Vines

I Ann Vines of Malmesbury in the County of Wilts widow being of sound and disposing mind memory and understanding praised be God for the same do make publish and declare this my last will and testament in manner and form following that is to say 

First I desire that my body may be interred in the Burying ground of the United Brethren 
at Malmesbury. I give and bequeath unto my daughter Mary Vizard the sum of one hundred pounds and to my son James the sum of twenty pounds to be paid to them respectively within one month next after my decease. 

I give and bequeath all and singular my wearing apparel and paraphernalia of my person unto my daughters the said Mary Vizard and Ann Millard. I give and bequeath unto  my son Edward Vines the sum of ten pounds and to my said daughter Mary Vizard the further sum of ten pounds for their trouble in and about the execution of  this my will and the trusts hereby in them reposed. I also give and bequeath unto my said son Edward Vines and my said daughter Mary Vizard the sum of eighty pounds upon the trusts nevertheless hereinafter expressed of and concerning the same and as to all the rest residue and remainder of my monies, securities for money, monies in the public stocks or shares and all other my estate and effects whatsoever and wheresoever of which I may be possessed interested in or entitled unto at the time of my decease. I do hereby give and bequeath the same and every part thereof unto my said son Edward Vines and my said daughter Mary Vizard upon trust that they and the survivors of their, his or her executors and advisors do and shall as conveniently after my decease sell and dispose thereof  and convert the same into ready money in such way and manner as they he or she may think proper and I do hereby give and bequeath my said trust monies and residuary estate and effects in manner following that is to say

one seventh part thereof I give and bequeath unto my said trustees Edward Vines and Mary Vizard upon trust to put and place the same out at interest upon government or other good and sufficient security or securities as do my said trustees and the survivor of their his or her executors and admons shall think fit and to receive and take the interest dividends and product thereof and of the said sum of eighty pounds heretofore bequeathed to them ??? I do hereby also order and direct to ??? ??? ??? place out at interest in like manner when and as the same shall respectively ??? ??? and payable and pay the same unto my said son James and his assigns for and during the term of his natural life to and for his own use and benefit and from and after the decease of my said son James Vines take upon trust to pay assign transfer and ??? the said trust sum of eighty pounds and seventh part or share of my residuary estate and effects equally unto ??? and ??? all and every the child and the children of my son James Vines which shall  be living at the time of my decease their executors admons and assigns to whom I do hereby give and bequeath the same accordingly

and as to one other seventh part or share of my said residuary estate and effects I do hereby give and bequeath the same unto my said trustees Edward Vines and Mary Vizard upon trust to put and place the same out at interest in like manner as hereinbefore
directed as and ??? the said last mentioned seventh part or share and to receive the interest dividends and product thereof and the same shall ??? out and payable? And
pay apply and dispose of the same or a sufficient part thereof to and for or towards the maintenance clothing support and bringing up of my grandson Samuel Vines son of my late son Benjamin Vines until the age of twenty one years and when and as he  shall attain that age then upon trust to pay assign transfer and convey the last mentioned seventh part or share unto him my grandson to and for his own use and benefit to whom I do hereby give and bequeath the same accordingly but in case of the decease of my said grandson Samuel Vines under the said age or before but then and in either of the said cases I do hereby give and bequeath the said last mentioned seventh part or share unto all and every my children Jacob Vines, James Vines, David Vines, Edward Vines, Mary Vizard and Ann Millard share and share alike as tenants in common and not as joint tenants, 

the share of my said son Edward Vines of and the same to be by my trustees hereinbefore named put and placed out at interest upon the trusts and for  the ends interests and purposes hereinbefore mentioned ???

and bequeath the same unto my children Jacob Vines, David Vines, Edward Vines, Mary Vizard and Ann Millard to be divided between them share and share alike as tenants in common and not as joint tenants and if any or either of them my said children Jacob, David, Edward, Mary and Ann  shall happen to die in my lifetime leaving issue of his her or
their body or bodies lawfully begotten then I do give and bequeath the share or shares of him her or them so dying unto such his her or their issue share and share alike as 
tenants in common  to be paid assigned and transferred unto them respectively on their severally attaining the age of twenty one years the interest dividends and product thereof to be by my said trustees in the ??? trust paid applied and disposed of in and for or towards their maintenance education support and bringing up to that age 

and I do hereby authorize and empower my said trustees hereinbefore named and the survivor of them his or her executors and admons at any time or times and from time to time during the lifetime of my said son James if they my said trustees or the survivor of  them him or her  executors or admons shall think proper but not otherwise to advance and pay all or any part of the trust monies herein before bequeathed for the benefit of my said son James and his family unto him my said son for his better support during illness or bodily infirmity such several payments to be made in small sums as the infirmity of this case may from time to time require 

and I hereby authorize and empower my said trustees and the survivor of them his or her executors and admons as from time to time as often as they he or she shall think proper to alter and change the securities which the said trust monies estate and effects shall hereafter be placed out and from time to time as often as they he or she shall think fit again to place the same out upon government or such other good and sufficient security as they he or she may deem advisable and it is my will and ??? that my said trustees or either of them shall not be liable to answer or make good any loss or losses that shall or may happen to any such trust monies estate and effects in placing out the same according to the directions of this my will or its transacting any business affairs or otherwise relating to or concerning the execution of the trusts ??? I this my will unless the same shall happen by or through their or either of their wilful neglect or default nor shall either of them my  said trustees  be answerable or accountable for the acts deeds mistakes? or disbursements of the other of them but each of them shall be accountable only for his and her own acts deeds mistakes? and disbursements and wilful neglect  or default 

and I do hereby direct that my trustees and both of them and their respective executors and admons shall and may pay to each other all reasonable and necessary costs charges and expenses whatsoever they or either of them shall or may bear pay sustain expend or be put unto in or about the execution of this my will or the trusts hereby in them reposed

and lastly I do hereby nominate constitute and appoint my son Edward Vines and my said 
daughter Mary Vizard executor and executrixof this my will and I do hereby revoke and make void all former and other will and wills by me at any time heretofore made and declare this alone to be and contain my last will and testament 

in witness whereof I the said Ann Vines the testatrix have to this my last will and testament subscribed my name and set my seal as follows vizt to the three first sheets thereof subscribed my name and set my seal this twenty second day of April one thousand eight hundred and sixteen.

Proved at London 10th April 1817 before the judge by the oaths of Edward Vines Esquire the son and Mary Vizard Mrs the daughter, executors to whom admon was granted having been first sworn by Canon? duly to administer.

                                               Note that the wife of Benjamin was Elizabeth Worcester

Inferred from this will is that son James aged 58 had some type of debilitating handicap     
which required him to need financial support. A special bequest was also made to Mary Vizard, for some unknown reason, possibly for past care and help to Ann who was aged 78 at the time of this will in 1816 and apparently living in Malmesbury. Edward predeceased her, 1785.
