"Lewis Co. Lawsuits, File 2780 James Clark vs. Joshua Clark and others, Mar. 1842

James Clark states that he is one of the children of George and Nancy Clark of Lewis Co. and that his mother, Nancy Clark (late Nancy Veirs) was the daughter of William Veirs, dec. of Montgomery Co., Maryland. One June 25, 1811, William Veirs (grandfather of James Clark) made his last will and appointed Levi Veirs (of Montgomery Co., Maryland) as his sole executor.

The will of William Veirs specified that after the debts were paid, the estate was to go to Mary Veirs, his wife, for her use during her life and widowhood. At her death or remarrige, the residue of the personal estate was to be equally divided amongst his children: Elijah Veirs, Wm. Veirs, John Mason Veirs, Edward Veirs, Hezekiah Veirs, Solomon Veirs, Nancy Clark's children Dorcas Fletchell and Levi Veirs.

James Clark states that his granfathers' will was admitted to probate in Montgomery Co, Md., Nov. 7, 1811. After the widow, Mary Veirs, died, Levi Veirs settled the estate completely.

Nancy Clark had 13 children. Joshua Clark was appointed guardian of the infant heirs on Aug. 16, 1830, by Lewis Circuit Court. John M. Clark and John West were his securities.

James Clark claims that Joshua Clark has never paid him his share from his mother's inheritance.

Joshua Clark is now (1842) a non-resident and John West has depaarted this life, and his widow, Mary West, has been appointed his administratix.
