I.Plaintiff alleges that on 13 Feb 1879 Alexander Seymour was indebted to Edward Finch in the sum of $300 and to secure the payment, Alexander executed a mortgage to the said Edward Finch. He used 135 acres of land, more or less, lying in Chatham on the waters of the Deep River, adjoining William Harris, Gorgas lands & others. The mortgage was registered in Deed Book AX, page 510-511
II.On 4 July 1885, Edward Finch died leaving a last will and testament, under it this plaintiff, W. H. White, acquired and became possessed of all the estate of said Edward Finch.
III.Alexander Seymour also died in the year 188_, intestate, leaving surviving him the said Betsy Seymour his widow & 3 children to wit: Eliza J. Lea, wife of Thomas Lea of GA, Georgia A. Seymour and Robert Seymour.
IV.That after the death of Alexander Seymour to wit, in the year 1888, the plaintiff being at that time the owner of the mortgage, and $200 still being owed, was going to foreclose, but at the earnest solicitation of the defendants Betsey Seymour & Eliza J. Lea, the plaintiff took a new mortgage upon the lands, signed by Betsey Seymour and Eliza J. Lea, and her husband, the undertaking to act for the minor children of the said Alexander Seymour.
V.The sum of $200 is due, with interest on 13 Feb 1888, which the defendants refuse to pay though often requested to do so.

Georgia A. Seymore & Robert Seymour are minors under the age of 21 & their mother Betsey Seymour was appt. their guardian ad litem, by the court.

·Alex Seymore died intestate in the year 1887. He died possessed of a certain tract of land situated in Cape Fear TWP containing 135 acres on Deep River, adjoining the lands of the heirs of the late Major Jno. W. Scott & the Lockville NC Power Corp.
·That the female plaintiff Eliza Jane Lea and the infant defendants Allie Taylor & Boysy Taylor are the only heirs at law of the said Alex Seymore the female plaintiff being his dau. and the said infants being his grandchildren and children of his deceased daughter Geogriana, who intermarried with the defendant Richard Taylor.
·The defendant Betsy Seymore is the widow of said Alex and has never had her dower allotted to her, but has lived on said land and had the sole & exclusive use of the land except for about 10 acres where the plaintiffs have lived the last 13 years.
·That the said Betsey Seymore has committed great waste upon said land, having sold cross ties & timber
·That the female plaintiff is entitled to ½ of said land, and the 2 infant defendants the other half, after the death of their father Richard Taylor
·The two infant daughters are under the age of 14 and have no guardian
27 March 1909 - It was ordered that the estate be divided in to 1/3 shares…with 1/3 for Eliza Jane Lea, 1/3 for the infant heirs, and 1/3 for Betsey's dower value
