Item 1. The Honoable Sr. Richard Everard Baron Governo Captain Gen Admirall & Comander in Chief April 29th 1728

Vol. II---1713 to 1728

The Petition of Samuel Morthey most humbly shewet that a few days agoe Yo Petition being taken into custody by John Falconer on an Admiralty Citation he applyed to the Hononble Christopher Gale Esq Chief Justice and in the Gen Court office entered his complaint of Prohibition Setting forth that he was cited by a process granted by Edmond Porter Esq Judge of the Admiralty and taken into Custody by John Falconer pretended Marshall of the said Court to appear on the Twenty fifth day of this month of April in the said Court to answer the Libell of James Trotter of Edenton Innholder for the sum of fifteen Shillings and sixpence for Victualls and drink sold the said Northey in Edenton which matter not being within the jurisdiction of the admiralty the said Northey prayed his Majestys Writ of Prohibition to Prohibit the said Judge and the officers and ministers of the said Court and the said James Trotter from proceeding any further in any manner in the said Suite which was granted and a Writt of Prohibition thereon made out forbiding the said Judge on any Acco. or manner whatsoever further to proceed or hold plea theron or Suffer and further proceedings to be had or Attempted in his said Court thereon whic Prohibition being delivered to the said Edmond Porter instead of Complying with his Majestys Said Writ having required yo Petition to plead and he refusing the said Judge did order the said Falconer his pretended Marshall to take into Custody you Said petitioner which ehe accordingly did and held in close Confinement till the next day when the said Edmond Porter Judge notwithstanding the said Prohibition did convene you petition again to answer the said suite and altho the authority of the said Court was still denyed in the said suite and the Prohibition urged yet the said Edmond Porter presumed to proceed and Adjudged you petitioner to pay to the said Trotter the sum of fifteen shillings and sixpence and the cost which were taxed so high as to amount to about fiften times the Principal debt and for not paying it granted process whereby the said John Falconer pretended Marshall took the body of yo petitioner into custody.


 

Item 2. At a Council held at the Council Chamber in Edenton the 12th day of May Anno Domini 1731

Vol. III---1728 To 1734

The first case in the Court after Judge Porters arrival was Trotter Verses Northy for 1516 bill money not of the Value of Three shillings sterling & was for a Tavern Score at an ordinary in Edenton and tho a prohibition was obtained thereon it was not regarded by the said Judge who proceeded to decree the Debt and cost and taced the costs to about Twelve pounds or upward & the poor man was put into Goal upon it in Execution while a small Vessell he was Master of lay Exposed all the while the voyage and Business hindred and Chiefly by means of this and the next suit the said Northy suffered so much that at last he broke and went of Laving a poor family in a very helpless condition.


Item 3.At a Council held at the Council Chamber in Edenton the 12th day of May Anno Domini 1731

Vol. III---1728 To 1734

Another affair in said Court was concering a Boat belonging to James Trotter of Edenton  the Judge under some slight pretence that she belong to the Bristol man cast away mentioned in the third Article foregoing tho in truth it was not so ordered his Marshall to seixe her which he did & sold her without and contestatian of Title permitted to the said Trotter tho Claim was made by him whol wholey Lost the vessel thereby.

1730-1745 Book I

1730

Awarrant from ye Honable the Govr. to apprehend the Body of Peter Young for beating Mary Trotter the wife of James Trotter was returned by orders of the Honable the Gov. ____ ___ which warrt. was read and Peter Young brought to the Bar and the evidences sworn thereon which being considd. of it is ordd. that the said Peter youn do give secuty. in the sum of L40 for his good behavior that the appear at the next court Genl. Court to be holdn for this province there to answer the said Complt. and that he be of the Peace? and good behaviour in the mean time or that he stand Comitted & pay cost.

Ordd. that James Potter be & He is hereby appd. Cons__ for the Town of Edenton in ye room of James Trotter.

Ordd. that James Trotter be Oversr. of Edenton.

Ordered that John Hanna be & he is hereby appd. Overseer of the Town Road in the Room James Trotter.

On motion of Dorothy Shervin, John Arthur, James Trotter, James Mitchell, James Wallace, Elizabeth Slaughter & Peter Young praying Liberty to keep Ordinarys and thereupon the Court taking the same into their consideration ordered that they have Liberty to keep Ordinary first giving Security according to Law and thereupon Dorothy Shevin entered Captain John Cambell as her Security which is aproved of by the Court and James Mitchell for his security entered Captain Miles Gale, whic is aproved of by the Court John Arthur entered Joseph Blount his Security which the Court aproved of James Trotter entered William Lewis his Security which the Court approved of James Wallace entered Security which the Court approved of and Peter young entered john lewis his Security which the Court approved off and it is thereupon ordered that the Clerk take the Bonds according to Law and then make out a Licence for the aforementioned persons with a copy of the rollowing rates (Vizt):

The Commissioners of Edenton acknowledged a Deed of Sale of Water lotts in the said Town to Mr.James Trotter in open Court & on Motion is ordered to be registred.

James Trotter vs. James Dowel Assault, Order vs Sheriff, Mr. Hodgson Demurs to the Declaration & Joynder.

Ordered that Mr. James Trotter be Overseer of the roads in the room & District of James Craven Esqr. issd. (James Craven is the grandson of James Trotter)

Mary Dunston vs. James Trotter her Guardian, Ordered that the accounts be refered to Mr. Blackall & Mr. Payne & that Mr. Trotter pay his account before them. Contind & refered to the same persons.

Mary Dunston vs. James Trotter her Guardian, Ordd. that the accounts be Refered to Mr. Blackall & Mr. Payne & that Mr. Trotter lay his accounts before them. Ordered unless Mr. James Trotter lay his accounts before the Refferees between this & next Court and attachment for Contempt issue.

On Motion of Mr. Jas. Trotter praying to have letters of administration on the Estate of Martha Trotter which upon the Consideration of the Court is contind.

1735-1738 : 1746-1748 Book II

Oct. 1736

Thoms: Drewery vs. Thos: Holt Not executed for want of time Jas. Trotter

Thoms: Maddin vs. James: Trotter  From ye Judgement of Two Justices,  agreed Dismist Fees paid.

Upon the Complaint of Mr. James Trotter made against Joseph Ming for stoping of Youpim Road by pretence of an order from this Court it is the oppinion of this Court that the order and proceedings thereon are alegal. It therefore ordered by the Court here that the said Joseph Ming immediately upon notice pull down all fences and inclosers errected on the old road and that the same be laid open as before the said order was obtained and upon refusal of the said Ming so to do it is hereby recommended to the Attorney General to prosecute him according to Law.

Wm. Arkell,  petition for a Mill,  Ordd. that Jas. Craven, Saml. Stillwell, Joseph Blount & James Trotter Value and acre of land & ca & since Contind the persons appointed to appraize one acre of land have now returned the same which is filed in this Courts office.

Mr. James Wallace is appointed overseer of Edenton Streets in the room of Mr. James Trotter, ordered he forthwith repair the same particularly the bottom where Jno. Hull Esqr. lives.

Christian Pratt vs. Hezek. Singleton, Refered by consent to Messrs. Peter Payne & Jas. Trotter & their award to be a rule of Court. Award retd. Judgmt. pursuant to the award.

On the petition of James Trotter praying to be appointed Guardian to William Coltraine orphan of David Coltraine Decd. granted, ordd. that he give Security in the sum of two hundred pounds proclamation money, Joseph Blount & Jas. Wallace Sec. Ordd. the Clk prepare the Bonds &ca.

Read the petition of James Trotter, praying an order for a licence to keep Ordinary granted and he thereupon entered into Bond with Joseph Harron & Thomas Corprew as the Law directs and took out his licence accordingly. recd. L10:12:6

Wm. Arkill undertakes to attend the lower Warehouse as Inspector for the ensuing year at L20..Bills & produced Messrs. James Craven & James Trotter his Sec. ordd. the Clk. prepare the Bonds &ca.

Ordered that the Accot. of Mr. Jas. Trotter late Guardian of Eleonor Dunston, be refer'd to John Hull & John Halsey Esqrs. and Mr. Walt Kipping, or any two of them to examine, state & report to the next Court, and they have full power to call Mr. Trotter or any oyr. person before them and to examine him or them upon oath, relating to the said account.
