Agreement and Bill Of Sale

This agreement entered into by and between Dora L. Trotter,
hereinafter referred to as Mother, and O. V. Trotter, C. E. Trotter, Ocie Trotter, Olin Trotter,
Bertrand W. Trotter and Frances T. Harrison, hereinafter referred to as Children, unless otherwise
specified on the date hereinafter mentioned.
WITNESSETH:
WHEREAS, Walter Trotter died intestate on August 2, 1958,
leaving as his heirs at law the following: Dora L. Trotter, widow, and O. V. Trotter, C. E. Trotter, Ocie Trotter, Olin Trotter, Bertrand W. Trotter and Frances T. Harrison, Children, and
WHEREAS, the said Walter Trotter died seised and possessed
of seventy-three (73) acres of land, more or less, situate, lying and being in Pickens Township, Pickens County, South Carolina, on Town Creek, and
WHEREAS, Children desire to convey their two-thirds interest in
the same to Mother, and
WHEREAS, the said Walter Trotter also died seized of the below
described personal property, to-wit: One (1), 1950 Ford Pickup Truck, bearing motor or serial number 9SRC302109, One (1) Farmail tractor, Model H. miscellaneous farm tools and equipment, miscellaneous household furniture located in the deceased's residence one savings account in the Pickens Bank of Pickens, South Carolina, in the amount of One Thousand Two Hundred Twenty and 80/100 ($1, 220.80) Dollars plus accured interest, one savings account in the name of Walter Trotter with the Sount Carolina National Bank of Pickens, South Carolina, in the amount of Two Thousand One Hundred Eleven and 21/100 ($2, 111.21) Dollars, plus accrued interest, twelve shares of the capital stock on The Pickens Bank of Pickens, South Carolina, the same being certificate No. 204, miscellaneous cattle, and any and all other personal property or chattels owned by the said Walter Trotter at the time of his death, and
WHEREAS, Children desire to convey their two-thirds interest in
and to said personal property to Mother, and
WHEREAS, the said Walter Trotter at the time of his death owned
as tenant in comon with O. V. Trotter the following chattels, to-wit: One Turner Hay Baler, one bull named :Tony" two hogs and twelve pigs, and
WHEREAS, Mother, in consideration for the conveyance of children's
above mention interest in the above mention property, both real and personal, to her, does hereby promise and bind herself to execute a will leaving all her property to her children at her death in equal shares except that Mother shall will unto O. V. Trotter one Turner Hay baler and the sum of Two Hundred ($200.00) Dollars for his one-half undivided interest in and to said hay baler, one bull named "Tony" and twelve pigs and two hogs.
NOW, THEREFORE, for and in consideration of the premises and
this written agreement, the parties herto agree as follows, fully intending to be legally bound hereby:
1. Children agree to execute a deed to Mother conveying their two-
thirds undivided interest in and to the seventy-three acres above described including all improvements situated thereon.
2. Children agree to, and do hereby, bargain, sell, convey and
set over unto their mother all the above described chattels and personal property to be hers absolutely.
3. Mother agrees to execute a will which shall provide a bequest
of $200.00 cash t O. V. Trotter, a bequest of one Turner Hay baler to O. V. Trotter and all the rest and residue of her property, both real and personal, which she may own at the time of her death unto her children in equal amounts and per stirpes. It is distinctly understood and agreed, however, that in the meantime and until her death, Mother shall have the right to sell andy and all of said propery, both real and personal, if she deems same necessary or desirable for her proper upkeep and maintenance although Mother agrees that she shall not do so in respect to the real property herein affected unless it is absolutely necessary for her proper upkeep and maintenance.
