Geo Hetich a witness says he wrote the testators will and that he always said that his dau w/o Adam Wolf should never have any part of his estate.   Christian Grove a witness said he had known testator about 25 years and he had been blind about 9 yrs and that he died the 1st of Jul. 1803.  Stephen Rigler testified.   Martin Wengert testified he had known the testator about 25 yrs.  Adam Wolf, present had no testimony

McDowell Nathan   Book B, page 171 who is married to Jane Irwin and John Sterrett who is married to Martella Irwin.  Daus of Joseph Irwin, late of Peters Twp, deceased enter a caveat against the probate of a paper purporting to be the last will of Joseph Irwin, deceased, alleging that the same was obtained by undue influence, and that he was of unsound mind 6 oct. 1803.   Robert McDowell testified that on Wednesday morning at 11 o'clock previous to the death of Joseph Irwin, who died the Sunday following, he was sent for to see him and he seemed in his senses.   he had a will to some parts of which he objected.   He suggested that i write another wherein he would give his wife the power of dividing his estate.  During the latter part of the day and all night he was out of his senses; next morning he was able to converse; said he wanted his estate left to his wife.   I decided to see my father and Archibald Bard.   I wrote a will for him and read it to him, but he was too sick to sign it.  James irwin, Esq. happened in and suggested the family sign their approbation.   Archibald Bard testified.   isaac Bard testified; Margaret McDowell testified and said she had conversed with deceased, who said you trouble yourself too much, keeping the flies off me.  Elizabeth McDowell, sister, testifed.  Violet Irwin, widow, renounced the right to administer the estate of her husband and ltrs of Adm on the estate of Joseph Irwin were granted to Archibald Bard and Joseph Irwin, 19 Oct. 1803. Caveat entered by Samuel Bagle and Peter Heck against the probate of above will, James Brotherton Esq attorney for the executors and James Orbison, Esq attorney for the cavetors.  Wm Minor sworn and said he was present when testator made his mark and that he was of sound mind.  Deceased said his family had always been disputing and he was afraid it would be so after his death.   Jacob Weldy, Wm Nichols, Philip Reed, Samuel Royer, and Robert Crooks testified as to the sanity of the deceased.
