RICHARD FOXWELL'S WILL

"Richard Foxwell of Barnstable" made his will 7 April, 1668. Bequests were as follows.  

"The remainder of that land that my son Samuell Bacon had of me .... on the North side of the highway over against the Land of Mr. Nathaniel Bacon I give unto my son Hugh Cole as also all my meadow ground at Sandey necke; my house and that land which I have left unto it I Doe give unto my son and Daughter Nelson I Doe give also my wearing Clothes unto my son Samuell Bacon I Doe give one of my Cows unto the Church of Barnstable to be Improved for the use of the poor thereof.... according as Mr. Hinckley and Mr. Bacon shall see good or such as they shall appoint;"


"What Cattle or swine I have left I Doe unto my sons Hugh Cole and Samuell Bacon; only my will is that they pay out of them nineteen shillings unto Mr. Adams a woolen Draper which Did Dwell at the lower end of Gracious street in London;"

"I Doe give all my pewter and brasses and bedding and what other things I have unto my sons Samuell Bacon and William Nelson equally"
   

"I Doe make my Loving sons Hugh Cole and Samuell Bacon my executors"
   

The will was witnessed by Nathaniel Bacon.    

On 19 May, 1668, a codicil was added. As he has been ill several weeks and there have been sundry expenses,  

"and also Considering my son Nelson hath had a good portion with my Daughter Ruth; I Doe alter that phrase in my will thus expressed (My house and that Land I have left unto it I Doe give unto my son and Daughter Nelson) And my will now is That in the first place all such Charges "shall be" paid out of my house and land and if there be more then will pay my expenses .... My son and Daughter Nelson shall have it"
   

The codicil was signed by a mark. The witnesses to the codicil were Nathaniel Bacon and Susanna Shelley (by a mark).   
The will and codicil were probated at Plymouth on 3 June, 1668, "on the oath of Mr Nathaniel Bacon"    

"July the 7th 1668, Memorandum That Hugh Cole and Samuell Bacon refusing to stand executors .... Of Richard Foxwell Deceased; were ordered by the Court to Administer on the said estate"    

Richard Foxwell's inventory was taken 30 May, 1668, by Henry Cobb and Thomas Huckens, and was presented to the court at Plymouth on 3 * June, 1668, "on the oath of Samuell Bacon" The real estate was: "about six acres of land and a sorry house" £7; "about one acre and an half of land and about three acres of Marsh" £5. "More in household stuff in the possession of William Nelson .... which is mutually agreed to be his part thereof"    

"Samuell Bacon was Deposed to this Inventory the 17th * of June 1668, before me Thomas Hinckley Assistant;"
