click for bigger image In the Name of God Amen I Sarah Stockley of Tingewick in the County of Bucks Widow Do make and ordain this my Last will and Testament as follows First I give devise and bequeath unto my Sister Abigail Taylor wife of Richard Taylor of Middleton China Butcher One Annuity or Yearly Rent Charge of Twenty Pounds of lawful Money of Great Britain free and clear of all Taxes and Deductions whatsoever to be imposed thereon or taken thereout by Authority of Parliament or otherwise howsoever to be issuing paid and payable out of and charged and chargeable upon the Messuage Lands and Hereditaments hereinafter by me devised by half Yearly Payments (that is to say) The Feasts of the Annunciation of the Blessed Virgin Mary and Saint Michael the Archangle in every year by even and equal Portions during the Term of the natural Life of the said Abigail Taylor which said Annuity or Yearly Rent Charge in such Portions as aforesaid I do direct shall be paid unto and into the proper hands of the said Abigail Taylor for her sole and seperate use and benefit exclusively and without being subject to the Debts Controul Forfeiture Disposal or Engagements of her said present or any after-taken Husband And that the Receipts and Discharges of the said Abigail Taylor and of such Person or Persons as she shall from time to time direct or appoint to receive the same shall notwithstanding her Coverture be good and effectual Releases and Discharges for the Monies therein expressed to be received. The First of the said half yearly Payments to be made on such of the said two Feasts or days of Payments as shall first and next happen after my Decease And further that if it shall happen the said Annuity or Yearly Rent Charge of twenty pounds or any part thereof shall be behind or unpaid for the Space of fourteen days next over or after either of the said days on which the same is directed to be paid as aforesaid that then and so often as it shall and may be lawful to and for the said Abigail Taylor and her Assigns into and upon the Messuage Lands and Hereditaments hereinafter devised or any part thereof to enter and distrain and the Distresser then and there found to take carry away and impound and the same in pound to detain and keep until the said Annuity and all Arrears thereof for which such Distress or Distresses shall be made as aforesaid and all Costs and Charges touching or concerning the taking and detaining such Distress or Distresses xxx xxx xxx and paid or otherwise upon such Default made in Payment as aforesaid to enter into retain and keep and receive the Rents and Profits of the said Messuage Lands and Hereditaments until she and they shall therewith and thereby be fully paid and satisfied the same Annuity and every part thereof then behind and unpaid and all Damages Costs Charges and Expences occasioned by the Nonpayment of the same
Also I give and bequeath unto the said Abigail Taylor the Sum of ten Pounds of like lawful Money of Great Britain to be paid her within one month after my Decease which said further Sum of ten pounds is by me also given and intended for her sole and separate Use and to be paid into her own proper hands Whose Receipt or Discharge for the same only in such manner as hereinbefore is expressed respecting the said Annuity by me devised to her shall be sufficient and valid notwithstanding her Coverture
Also I give and bequeath unto the Children of Elizabeth Brimley Daughter of Elizabeth Kibbles and Wife of Richard Brimley of Stowe alias Stowe nine Churches Farmer the Sum of Sixty Pounds of like lawful Money to be equally divided between and amongst them Share and Share alike and to be paid to them within Twelve Months next after my Decease
Also I give and bequeath unto the three Children of my Sister Elizabeth Kibbles of Badby in the County of Northampton Widow (viz*) Anne, William and Samuel, the Sum of twenty Pounds apiece of lawful Money of Great Britain to be paid to them respectively within two Years next after my Decease
Also I give and bequeath unto William Stockley Edward Stockley and George Stockley sons of my late Husband's Kinsman William Stockley of Tingewick aforesaid Yeoman the Sum of ten Pounds apiece of like lawful Monney to be paid to them when and as they shall attain their respective Ages of twenty one Years or be bound Apprentice which shall first happen after my Decease
Also I give devise and bequeath unto my said late Husband's Kinsman William Stockley All that my Copyhold Messuage or Tenement in which I now dwell situate in Tingewick aforesaid with the Outhouses Yard Garden and Appurtenances thereto belonging And also all that my Copyhold Allotment or Plott of Land and all other my Copyhold and other Messuages Lands and Hereditaments lying and being in the Parish of Tingewick aforesaid with their respective Rights, Members and Appurtenances (the Copyhold parts whereof I have this day Surrendered to the use of my Will) To Hold to the said William Stockley and his Assigns for and during the Term of his natural Life And from and immediately after his Decease I give and devise all and singular my said Messuages Lands and Hereditaments with their Appurtenaces unto Thomas Stockley son of the said William Stockley and to his Heirs and Assigns for ever Subject and charged and chargeable nevertheless to and with the Payment of the said Annuity or yearly Rent Charge of twenty Pounds and also the said several Legacies or Sums of Money hereinbefore by me given and to such Power of Distress and Entry respecting the said Annuity as hereinbefore contained And I do hereby make subject and charge All and singular my said Messuages Land and Hereditaments with the Payment of the said Annuity and of the said several Legacies or Sums of Money at the times the same are directed to be paid accordingly And my Will further is and I do hereby also direct that the Rent and Profit of the Premises hereinbefore by me devised after Payment and Discharge of the said Annuity shall be paid in Discharge of the Legacies by me given as aforesaid in the order in which they stand in this my Will And that if such Rents and Profits should not be sufficient in the Life time of the said William Stockley or before the full Age of the said Thomas Stockley his Son fully to pay and satisfy the said Legacies as the same respectively become due and payable that such of the Legatees who shall not receive their said Legacies at the time they shall so become payable by Virtue of this my Will shall be allowed Interest for the same at the rate of four Pounds per Cent per Annum and that the payment thereof shall not be delayed at the furthest longer than the time of the full Age of the said Thomas Stockley
And Lastly all and singular my ready Money Household Goods and Personal Estate whatsoever after payment of my just Debts and Funeral Expences I do hereby give and bequeath unto the said Thomas Stockley to be applied to and for his Use and Benefit in Case of his Minority
And I do hereby nominate and appoint the said William Stockley the Elder full and sole Executor of this my last Will and Testament hereby xxx xxx xxx xxx I do direct and desire that my Executor will place decent Grave Stones over the Graves of myself and my late Husband and have a Sermon preached at my Funeral And in Case of any Deficiency in my Personal Estate to pay my just Debts together with such Expences as aforesaid I make Subject and charge my real Estate hereinbefore devised with the payment thereof And I do also constitute appoint and desire of my Friend Humphry Smith of Charlton by Newbottld Shopkeeper to be a Trustee and to see to the due Execution of this my Will and the payment and performance of the Legacies and Requests herein contained. In Witness whereof I the said Sarah Stockley have to this my Last Will and Testament contained in two Sheets of Paper to each of the same Sheets set my hand and Seal this fourteenth day of November in the seventeenth year of the Reign of our Sovereign Lord King George the Third over Great Britain &c And in the Year of our Lord One thousand seven hundred and seventy [seven]
