In the Surrogate Court of the Midland

District

Hannah Horn of the Township of

Wolfe Island, Widow, Makes Oath and says, that she verily believes

that George Horn late of the township of  Wolfe Island died

without leaving a will; that She will exhibit or cause to be exhibited into the Registry

of the Surrogate Court for the Midland District on or before the Second day of

February next ensuing, a just, true and perfect inventory of all and singular

the goods, chattels and credits of the said George Horn deceased; that

She will pay all the debts of the deceased, as far as the goods shall extend, and the law

shall bind her; that she will well and truly administer according to law; and

further that  she will make or cause to be made, a true and just account of her Adminis-

tration of the personal estate of the deceased, when she shall be lawfully called upon so

to do.

2.        UPPER CANADA.

Know all Men by these Presents, that we

Hannah Horn of the Township of Wolf Island in

The Midland District, widow, and John Fisk, Merchant,

and Samuel Moen?, Yeoman. Both of the Town of Kingston

in the District & Province aforesaid, are held and firmly

bound unto Sir John Colborne K.C.B. Lieutenant Governor

of the said Province in the sum

of Two, hundred pounds current money of the said Province, for which Sum well and truly

to be paid unto the said Sir John Colborne his certain

Attorney, Heirs, Executors, Administrators and successors, in office, we bind ourselves jointly

and severally, each for himself and each for the whole, and our and each of our Heirs, Executors

and Administrators firmly by these presents; Sealed with our Seals, and dated the

day of July in the year of our Lord one thousand eight hun-

dred and thirty two and in the third year of His Majesty’s

Reign:

 

The Condition of this Obligation is such, that if the within bounden Hannah

Horn Administratrix

Of all and singular the goods, chattels and credits of George Horn

deceased, do make, or cause to be made, a true and perfect inventory of all and singular the

goods chattels and credits of the said deceased, which have or shall come into the hands, posses

sion or knowledge of her the said Hannah Horn

or into the hands and possession of any other person or persons for her and the same

so made, do exhibit or cause to be exhibited into the registry of the Surrogate Court

for the Midland District, on or before the Second day of

February next ensuing, and the same goods, chattels, and credits, and all other

the goods, chattels and credits of the said deceased, at the time of his death, which at

any time after shall come into the hands or possession of the said Hannah Horn

or into the hand and possession of any other person or persons for her do well and

truly administer according to law, and further do make or cause to be made, a true and just

account of her said Administration, at or before the Second day of

July; 1833 and all the rest and residue of the said goods, chattels and cre-

dits, which shall be found remaining upon the said Administrator’s account, the same being first

examined and allowed by the Judge of the Court, for the time being, shall deliver and pay unto

such person or persons respectively, as the said judge by his decree or sentence, conformably to

the provisions in a certain Act of Parliament, entitled, “An act for the better settling intestate

estates,” and passed in the twenty-second and twenty-third year of the reign of Charles 11, and

also in a certain Act passed in the first year of King James 11, contained, shall limit and appoint,

and if it shall hereafter appear, that any last will or testament was made by the deceased, and

the executor or executors therein named do exhibit the same unto the said Court, making request

to have it allowed and approved accordingly, if the said Hannah Horn

within bounden, being thereunto required, do render and deliver the said Letters of Administra-

tion (approbation of such testament being first had and made,) in the said court then this obli-

gation to be void and of none effect, or else to remain in full force and virtue.
