Catherine Cassidy Will

This is the Last Will and Testament of me Catherine Cassidy of the township of Howe Island in the County of Frontenac and Province of Ontario widow of the late John Cassidy made this fifteenth? day of January in the year of our Lord one thousand eight hundred and ninety four.

I Revoke all former Wills or other Testamentary Dispositions by me at any time heretofore made and declare this only to be my last Will and Testament.

I Direct all my just debts, funeral and Testamentary expenses to be paid and satisfied by my Executors hereinafter named as soon as conveniently may be after my decease.

I Give, Devise and Bequeath all my Real and Personal Estate of which I may be possessed in the manner following that is to say

I give and bequeath to my sons William Cassidy, Donald Cassidy and John Cassidy each the sum of one hundred dollars. I give and bequeath to my daughter Maggie Cassidy the sum of two hundred dollars and I give and bequeath to my daughter Catherine, wife of Nelson White, one cow.

I give devise and bequeath to my son Duncan Cassidy al my Real Estate of every nature and kind soever of which I shall die seized or possessed subject however to the following proviso

Namely- It is provided that should my son John Cassidy wish to take the West half of my lands situate on the North Range of Howe Island. I think Lot number eight, and assume and pay off eleven hundred dollars of the mortgage now standing against the whole of my said lands. It is my will that he shall enjoy the same and take possession and assume said mortgage as aforesaid within three months after my decease, and have eleven hundred dollars of said mortgaged discharged as far as the East half of my said lands is concerned said son John elect within the said three months whether he will so accept the lands in above condition or not and if accepted he is not to have the said bequest of one hundred dollars.

I give and bequeath to my said son Duncan Cassidy all my personal property of every nature and kind and the said Real Estate devised to him subject to the said provision as to my son John taking the west half, and subject to the payment of the aforesaid bequests to my sons and daughters.

Said Real estate being held by lease by me, and it is my will that my lands should descend as a lease hold to my son or sons as above stated, and all my rights title and interest in the same to their respective heirs and assignees.

And I nominate and appoint my friends George Baillie and Angus McDonald both of Howe Island aforesaid farmers to be Executors of this my last Will and Testament.

…Nelson White make oath and say…that on or about the forth day of January in the year one thousand eight hundred and ninety four I and Joseph Beaubien of the said Township of Howe Island… were both personally present …

I Maggie Cassidy of the Township of Howe Island … spinster, make oath and say that I am a daughter of the said Catherine Cassidy named in the paper writing now hereunto annexed purporting to be and contain the last will and Testament of Catherine Cassidy.. who died on or about the ninth day of January 1894 at said Township of Howe Island …the same (Will) is now in all respects in the same state, and condition as when placed in my custody at the time it was signed by said Catherine Cassidy… all respects same

I James Matier of the Township of Wolfe Island in the County of Frontenac, Yeoman do make and publish this my last will and testament as follows:

It is my will that my debts personal and testamentary expenses be first paid.

I give and bequeath to my son James Matier one hundred dollars to be paid to him thirty days after my funeral.

Subject thereto I give and bequeath will devise all the rest and residue of my estate both real and personal and wheresoever situate to my son William Matier absolutely.

I nominate and appoint my said son William Matier and William Brown Card the exectors of this my will.

Estate of Edward Smith

In the Estate of Edward Smith deceased. I Louisa A Smith of the Township of Wolfe Island in the County of Frontenac, widow make oath and say That I am the widow of the said Edward Smith deceased. That the said deceased died on or about the thirteenth day of November in the year of our Lord one thousand eight hundred and ninety three at said Township of Wolfe Island and that the said deceased at the time of this death had a fixed place of abode at said Township of Wolfe Island in the said County of Frontenac, leaving him surviving myself and nine children, three of whom are infants under the age of twenty one years.
