The Register of the County of Frontenac


A memorial of an Indenture of Bargain and Sale made between
John Ferguson of the Township of Kingston in the County of Frontenac and
Province of Upper Canada Esquire, of the one part, and Richard Hutren Smithers
of Point Frederic in the County x Province aforesaid, Shipwright of the other
part, whereby the said John hath granted, bargained, and sold unto the said Richard
and to his heirs and assigns for ever, All that certain tract or piece of Land situate
lying and being on Wolfe Island in the County and province aforesaid, being
a part of a tract of Land nearly opposite to Kingston, heretofore granted to the
said John Ferguson by the late David Alexander Grant and Patrick Langan
both of the City of Montreal in the province of Lower Canada Esquires deceased?
which tract of Land is commonly known by the name of Ferguson’s Part, commencing
at a poplar tree blazed on the Bank of the River Saint Lawrence or Cataraqui and
at the South west side of what was formerly the King’s Shipyard thence in a straight
line upon a course nearly South fifteen Degrees East to the Edge of a Creek
Commonly known by the name of Ferguson’s Creek at the Distance of ten chains
(about South East) from the Boundary line of Mary Kyles land and Mary Wilkensons
land or rather the limit between the same thence up the said Creek but at right
angles to the said straight line twenty three Chains to a stake planted at the Edge of
the said Creek, thence northerly in a line parallel to the said straight line to
the Bank of the said River Saint Lawrence or Cataraqui thence Southwesterly
along the said Bank twenty three Chains to the place of beginning, con-
taining Two hundred acres or there abouts, be the quantity more or less;
which Indenture of Bargain and Sale is Dated the First Day of December
in the year of Our Lord One Thousand Eight Hundred and Twenty
Three, and is witnessed by John W. Ferguson of the Town of Kingston
Esquire, and Magdalene Anne Ferguson of the same place Spinster
Which said Indentures is required to be Registered pursuant to the Statute
In that case made and provided by me John Ferguson the Grantee in the
said Indenture mentioned; As Witness my hand and Seal this third day of
December in the year of Our Lord One Thousand Eight Hundred and Twenty Three

The Execution of the foregoing Memorial was duly proved before me the
