Now if we the said James Perryman and Sarah EJV Perryman shall make or cause to be made to the said W. F. Young and S.P Shaw their heirs and assigns a good and sufficient title to said land in fee simple with general Warranty of title thereto upon the payment of Said Sum of One Thousand Dollars, then this obligation to be Void otherwise to remain in full force and effect. Shaw their heirs and assigns in the Sum of four thousand Dollars for the payment of which will and truly to be made. We bind ourselves, our heirs and personal representatives, Sealed with our Seals and dated this 25^th day of January 1860. The condition of the above obligation is Such that if the Said James Perryman and Sarah EJV Perryman Shall Make or cause to be made a good and Sufficient title in fee Simple with general Warranty in and to Said Land described in the foregoing Bond to Said W. H. Young and S.P. Shaw and deposit the Same with the Judge of The Probate Court of Tishmingo County and State of Mississippi to be delivered to Said Young and Shaw theirs heirs or assigns upon the payment of Said Sum of One Thousand Dollars as therein provided within Three Months from and after the 1^st day of January 1861, then this obligation to become void otherwise to remain in full force and effect.

Know all men by These Presents that we James Perryman and wife Sarah E.J.V. Perryman are held and firmly bound unto W. F. Young and S.P. Shaw in the Sum of Four Thousand dollars for the payment of which will and truly to be made to them their heirs and assigns we bind ourselves our heirs and personal representatives Sealed with our Seals and dated this January 25^th 1860.

The Condition of the above obligation is Such that whereas the above bound James Perryman and Sarah E.J.V. Perryman have this day by their Attorney in Fact I.P. Lowry bargained and Sold to Said W.F.Young and S.P. Shaw the following described Land Situated in the county of Tishomingo and State of Mississippi known and designated upon the plan of Survey of the Chickasaw Cession as the South West quarter and the West half of the South East quarter of Section No Twenty-five (25) in Township No. Five (5) of Range No Six (6) East for the Sum of Two Thousand Dollars, One Thousand Dollars of which has this day been paid in cash to Said I.P. Lowry Attorney in act as aforesaid and the receipt of which is hereby acknowledged and the Said W. F. Young and S.P. Shaw have given their obligation under their Seals to pay to Said I.P. Lowry as Attorney in fact for the use of Said Sarah E.J.V. Perryman (formerly Sarah E.J.V.Lindsey) to whom Said Land descended

• 15 Jul 1861, James joined the Confederate Army at age 25, Mt. Carmel, Smith County, Texas. Civil War Records: shows he served with E Company 14, Texas Infantry (Clark's Reg. and Texas Inf.) He was apparently discharge about 1863. Records also show he "served with distinction.
Other records show he was sworn in at the front of the Post Office in Mt. Carmel, Texas.

• Land Records: 19 Sep 1871, Smith County, Texas. James Perryman bought ? acres in Smith County for $1,000 (14 miles from Tyler on the Sabine River (Survey #235), September 19, 1871.
I assume that he paid for this land with money he and Sarah received from the sale of her inherited land in Mississippi. (25 Jan 1860, Court Records: James Perryman & wife, Sarah E.J.V. Perryman sell land to W.F. Young & S.P. Shaw, Tishomingo County, MS. survey of the Chickasw Cession as the SW qtr. & W 1/2 of South East qtr. of Sec. 25 in Township (5) of Range No (6) East for the Sum of Two Thousand Dollars, One Thousand Dollars of which has this day been paid in cash. T5RGE pg 22 & 23)

James married Sarah Elizabeth J. LINDSEY, daughter of William P. LINDSEY and Elizabeth A. ROBINSON, on 5 May 1858 in Smith County, Texas.¹ (Sarah Elizabeth J. LINDSEY was born between 1839 and 1840 in Mississippi and died about 1867 in Smith County, Texas.)
