MARIA SWINSCOE 1874

This is the last will and testament of me Maria Swinscoe of Kniveton in the County of Derby Widow of William Swinscoe late of Kniveton aforesaid farmer deceased, and now the wife or reputed wife of Thomas Swinscoe of Kniveton aforesaid Farmer the Brother of the said William Swinscoe I appoint Edward Oakden of Doveridge in the said County Farmer and Henry Robotham of Offcote and Underwood in the said County Farmer Trustees and Executors of my Will I devise and bequeath All that my undevided ? half part of share of and in an Estate at Kniveton aforesaid now in the occupation of the said Thomas Swinscoe and all other my real Estate whatsoever and whresoever Together with all my personal estate whatsoever and wheresoever unto the said Edward Oakden and Henry Robotham their heirs executors and administrators upon trust to pay the rent of my said real estate and the interest or annual proceeds of my said personal estate unto the said Thomas Swinscoe for his natural life and from and after his decease upon trust to sell and dispose of my said real Estate and to divide the proceeds thereof together with my personal Estate equally between such of my two children Emily Swinscoe and Hugh Swinscoe and my four children by the said Thomas Swinscoe namely Emily Georgina, William and David and Maria Jemimah as shall be living at the decease of the said Thomas Swinscoe and who shall attain the ageof twenty one years and the child or children of any of the said children who shall be then dead who shall attain the age of twenty one years But so that the child or children collectively of my deceased child shall take only the share which his or her parent would have taken if living And I declare that the share or shares of any female or females under this my will shall be for her or their separate use And I devise all Estates vested in me as trustee or mortgagee unto the said Edward Oakden and Henry Robotham subject to teh equities affecting the same respectively And I revoke all other wills by me made and declare this to be my last, In witness whereof I have hereunto set my hand this nineteenth day of March one thousand eight hundred and seventy three Maria Swinscoe Signed and acknowledged by the said Testatrix as and for her last will and Testament in the presence of us present at the same time who at her request in her presence and in the presence of each other have subscribed our names as witnesses Saml Coleman Solicitor Ashborne John Fearn Farmer Kniveton Proved at Derby 30th day of June 1874 by the oaths of Edward Oakden and Henry Robotham the executors to whom Administration was granted The Testatrix Maria Swinscoe was late of Kniveton in the County of Derby Widow and died on the 1st day of August 1873 at Kniveton aforesaid Effects under £200
