JOHN SWINSCOE 1684

In the name of God Amen the sixteenth day of February anno domini 1684. I John Swinscow of Fairfield being in the parish of Hope in the county of Derbyie husbandman weak in body but whole of mind and perfect of remembrance thanks be to God do ordain and make this my last will and testament in ? and form following First I commit my soul to almighty God my creator and to Jesus Christ my redeemer by whose death and blood shedding I ? believe to attain immortality and life everlasting and as touching the disposition of all such temporal estate as it hath pleased almighty God to bestow upon me I give and dispose thereof as followeth First I will that my debts and funeral charges shall be paid and discharged Item I give and bequeath unto Henry Swinscoe my son one acre and a rood of land by estimation (that is to say) one halfe acre lying on a place called the lower ? one half acre lying on a place called the ? and one rood lying on a place called bra? hole. with their ? all which land I have and hold by ? of a lease for a thousand yearss, of and from the said Henry Swinscoe my son he the said Henry Swinscoe paying to Mary Swinscoe my daughter the sum of twenty pounds within one whole year after my decease and if it shall happen that the aforesaid Henry Swinscoe my son shall neglect in paying and discharging my the aforesaid sum of twenty pounds in part or in all within the time limited to the said Mary Swinscoe my daugher or her assigns them my will and mind is that this bequest shall be void and that the said Mary Swinscoe my daughter shall have the before mentioned lands with ? in lieu of her twenty pounds Item I give and bequeath unto Mary Swinscoe my said daughter twenty pounds which Mr John Brough of the Swingates in the county of Stafford owes me. Item I give and bequeath unto Mary Swinscoe my said daughter ten ewe sheep five whereof she calls her own. Item I give and bequeath unto Helen Hanley my daughter eight pounds to be paid to her by my executor hereafter named within two whole years after my decease if she be then alive and if it shall happen that Helen Hanley my said daughter shall die before the time of payment doth come then I give and bequeath the aforesaid sum of eight pounds to the child or children of Helen Hanley my said daughter, equally to be divided amongst them when they shall be able to give and discharge according to law. Item the rest and residue of my personal estate goods chattels whatsoever I do give and bequeath unto the said Henry Swinscoe my son whom I do constitute ordain and make full and sole executor of this my last will and testament. And I do hereby revoke disanull and make void all former wills and testaments by me heretofore make. In witness whereof I the said John Swinscoe to this my last will and testament have set my hand and seal the day and year above written. From before the sealing and signing of this my last will and testament I give and bequeath to Hana Swinscoe ten shillings. Sealed signed and allowed in the presence of William Fearn Edward Swann
