TITHE APPORTIONMENT INDEX - 1839

CORNWALL TITHE APPORTIONMENT,
1839

Whereas an Award of Rent Charge in lieu of Tithes, in the Parish of Saint Austell, in the County of Cornwall, was, on the eleventh day of April, in the Year One Thousand Eight Hundred and Thirty-nine, confirmed by the tithe Commissioners for England and Wales, of which award, with the Schedules thereunto annexed, the following is a copy:

KNOW ALL MEN BY THESE PRESENTS ---

That I, George Louis, having been duly appointed and sworn an Assistant Tithe Commissioner, according to the provisions of the Act for the Commutation of Tithes in England and Wales, ..., do hereby award as follows; that is to say –

Whereas I have held divers meetings in the said parish...

Whereas I have duly considered all the allegations and proofs tendered to me by all
parties interested...

Whereas I find that the undermentioned Land of the said Parish, that is to say – MENACUDDLE,containing by estimation Seventy-one Acres, Two Roods, and Thirty-eight Perches, of which Sir Joseph Sawle Graves Sawle, Baronet, is Owner; and William BARNICOAT is the present Occupier, are, by prescription or other lawful means, exempt from payment of all Tithes, both Great and Small...

And Whereas I find all the Lands of the said Parish, except as aforesaid, are subject to the
payment of all manner of Tithes in kind:

And Whereas I find that the estimated quantity, in Statute Measure, of all the Lands of the said
Parish which are subject to the payment of Tithes, amounts to Eight Thousand Six Hundred and
Seventy-eight Acres, One Rood, which are cultivated as follows: That is to say –

- Five Thousand One Hundred and Forty one Acres, Three Roods, as Arable Land

- Forty-four Acres as Pasture

- Nine-two Acres as Gardens and Orchards

- Two Hundred and Seventy-eight acres, and Three Roods, as Wood Land

- And One Thousand Five Hundred and Eighty-two Acres are used as Common Land

- And One thousand Five Hundred and Thirty-nine Acres, and Three Roods, as Furze
          and Heath

 

And Whereas I have estimated the clear Annual Value of the said Tithes.. and have also taken into account the Rates and Assessments paid in respect of such Tithes during the Seven Years of Average, prescribed by the said Act:

And Whereas I find that Several Persons mentioned in the schedule hereto annexed, are Impropriators or Owners of the Great or Rectorial Tithes of the said Parish, except as aforesaid, and also except the Glebe and the Tithe of Hay, in the proportions and in respect of the several Lands specified in the said Schedule in connexion with the names of the said Tithe Owners, respectively and jointly, or severally, as therein mentioned:

And that the Vicar of the said Parish for the time being is entitled to all the Small Tithes thereof, except as aforesaid, including the tithe of Hay;

And that the Annual Sum of Five Hundred and Thirty-seven Pounds, Ten Shillings, also by way of Rent Charge and subject to the provisions of the said Act, shall be paid to the Vicar of the said Parish for the time being, instead of all the Small Tithes, including the Tithe of Hay, arising from all the Lands of the said Parish (except the said Lands called Menacuddle, and also except the Glebe.)

And that the further Annual Sum of Ten Shillings shall be paid to the Vicar for the time being, by way or Rent Charge, subject to the provisions aforesaid...of the Glebe Lands of the said Parish, when any quantity less than the whole may at any time not be in the occupation of the Vicar himself.

In Testimony whereof I have hereunto subscribed my hand, this Thirty First Day of January, in the Year of our Lord One Thousand Eight Hundred and Thirty-nine.

Now We, THOMAS BISHOP of the Parish of Tintagel, and WILLIAM SEARLE, of the Parish of Lanreath, both in the County of CORNWALL, having been duly appointed Valuers to apportion the total Sum awarded to be paid by way of rent Charges in lieu of tithes, amongst the several Lands of the said Parish of Saint Austell, do hereby apportion the Rent Charge as follows:

Gross Rent Charge payable to the Tithe Owners in lieu of Tithes, for the parish of Saint Austell, in the County of CORNWALL, (including Tithe of Glebe,) ONE THOUSAND AND FORTY POUNDS: viz -
