Adam W. Miller, Admin. to Eliza M. Miller

This Indenture made the twenty-eighth day of May in the year of our Lord one thousand eight hundred and ninety seven between Adam W. Miller, of Washington Township, Schuylkill County, Pennsylvania, Administrator of all and singular the goods and chattels rights and credits, which were of John Miller late of the Township of Washington in Schuylkill County and State of Pennsylvania deceased, of the one part, and Eliza Matilda Miller, wife of Adam W. Miller of the Township of Washington County and State aforesaid of the other part: Whereas, the said John Miller in his lifetime, and at the time of his death, was seized in his demesne as of fee, all that certain farm situate in Washington Township, Schuylkill County and State of Pennsylvania containing 29 acres, and 70 perches of land-neat measure-a frame dwelling house and barn-hereafter more fully described. And Whereas Letters of Administration of all and singular the goods and chattels, rights and credits, which were of the said John Miller at the time of his death were in due form of law committed unto the said Adam W. Miller, of said Washington Township and whereas the said Administrator at an Orphan's Court, held at Pottsville in and for Schuylkill County presented a petition setting forth inter alia, that the personal property of the decedent was not sufficient to pay his just debts. Whereupon it appearing manifest unto the court aforesaid, that the personal estate of the said John Miller was not sufficient to pay his just debts it was considered and ordered by the said court on the 31" day of August A.D. one thousand eight hundred and ninety six that the real estate described in the petition be sold according to the prayer of the petitioner: and whereas in pursuance of the said order and by force and virtue of the law of the State in such case made and provided, afterwards to wit, on the 28" day of November A.D. 1896, the said Adam W. Miller did expose the said hereinafter described real estate to sale, at public vendue or outcry, after giving notice thereof according to law, and sold the same unto the said Eliza Matilda Miller for the sum of six hundred
and fifty ($650) dollars she being the highest bidder and that the highest and best price bidden therefor; which sale on report thereof made to the Judges of the said court on the 24" day of December A.D. 1896, was confirmed and it was considered and adjudged by the said court, and that the same should be and remain firm and stable forever; and good and sufficient security, approved by the said court, for the faithful application of the proceeds of sale, has been duly entered, as by the records of the said court more fully and at large appears: Now this indenture witnesseth, that the said Adam W. Miller Administrator as aforesaid for and in consideration of the sum of six hundred and fifty dollars to me in hand paid by the said Eliza Matilda Miller at and before the ensealing and delivery hereof, the receipt whereof I do hereby acknowledge, hath granted, bargained, sold, aliened, enfeoffed, released and confirmed, and by these presents doth hereby grant, bargain, sell, alien, enfeoff, release and confirm unto the said Eliza Matilda Miller her heirs and assigns, the following described real estate.

All that Certain messuage tenement and tract of land situate in Washington Township, Schuylkill County and State of Pennsylvania. Beginning at a chestnut tree, thence by land of John Zimmerman, south 88 1/2 degrees west 39 4/10 perches to a stone, thence by land of Leonard Reichert, north 1 1/2 degrees, west 93 perches to a stone, thence by land of Paul Lengle of which this is a part, north 81 degrees, east 60 perches to a stone, thence by land of Aaron Owens south 1 1/2 degrees east 44 1/2 perches to a stone, thence by land of Martin Miller south 88 1/2 degrees, west 19 9/10 perches to a small hickory and stone, thence by the same south 1 degree east 56 1/2 perches to the place of beginning. Containing 29 acres, and 90 perches neat measure, with the appurtenances consisting of a two story frame dwelling house, a frame bank barn & c., late the property of John Miller, deceased. Together also, with all and singular the buildings, ways, waters, water courses, rights, liberties, privileges, hereditaments and appurtenances, whatsoever thereunto belonging, or in anywise appertaining, and reversions and remainders, rents, issues and profits thereof, and also all the right, title, interest, property, claim and demand whatever, of the said John Miller in his lifetime, at and immediately before the time of his decease, in law, equity, or otherwise howsoever, of, in, and to or out of the same. To have and to hold the said buildings hereditaments and premises hereby granted, or mentioned and intended so to be, with the appurtenances unto the said Eliza Matilda Miller her heirs and assigns forever and the said Adam W. Miller Administrator doth covenant, promise, grant and agree, to and with the said Eliza Matilda Miller her heirs and assigns by these presents, that he the said Adam W. Miller hath not done, committed, or knowingly or willingly suffered to be done, any act, matter or thing whatsoever, whereby the premises aforesaid, or any part thereof, is, are, shall, or may be changed or incumbered, in title, charge, estate, or otherwise howsoever. Joseph Weitzel & Wife to Peter K. Fisher, July 8th, 1848

This Indenture, made the 29th day of April in the year of our Lord one thousand eight hundred and forty eight between Joseph Weitzel of Lower Augusta Township Northumberland County and State of Pennsylvania and Sarah his wife of the one part and Peter K. Fisher of the same place of the other part. Witnesseth that the said Joseph Weitzel and Sarah his wife for and in consideration of the sum of three hundred and twenty dollars good and lawful money of the United States of America unto them well and truly paid by the said Peter K. Fisher at and before the sealing and delivery of these presents the receipt whereof is hereby acknowledged have granted, bargained, sold, aliened, enfeoffed, released and confirmed, and by these presents do grant, bargain, sell, alien, enfeoff, release and confirm unto the said Peter K. Fisher and to his heirs and assigns all the herein after described tract part piece or parcel of land situate in Lower Augusta Township County and State aforesaid bounded and described as follows to wit beginning at stones on a piece of land belonging to the heirs of Henry Colp deceased thence by land of Sarah Kean South nine degrees east thirty two and nine tenths perches to a post thence by the same north eighty one and a half degrees east twenty five and five tenths perches to stones thence by land of William Miller south eight and a half degrees east four and five tenths perches to a stone thence by land of the said Joseph Weitzel or part of the same tract south sixty five degrees west, west twenty four and three tenths perches to a white oak thence by the same north seventy five and a half degrees west thirteen perches to stones thence by land of William Weitzel, it being part of the same tract and surveyed off of the tract the same day that this was, north twenty one degrees west two perches to a white oak tree thence by the same south fifty five and a fourth degrees west seventeen and two tenths perches to a red oak tree thence by the same south twenty eight and three fourths degrees west twelve and two tenths perches to a dead spruce tree thence by the same north fifty three degrees west fifteen and five tenths perches to a maple tree thence by the same north eighty three and a fourth degrees west twenty seven and two tenths perches to a white oak tree thence by the same north four and a half degrees east twenty three and five tenths perches to a white oak tree thence by land of Frederick Haas and Jacob Smith and along the mannor line north eighty and three fourths degrees east twenty perches to __ thence by land of Jacob Smith, Samuel Lantz and the heirs of Henry Colp deceased and along the mannor line North sixty five degrees east forty six and five tenths perches to stones the place of beginning. Containing fifteen acres and one hundred and twelve perches strict measure. It being part of a larger tract of land surveyed on application Number 2891 of John George Bower on the 7th day of April 1769 called Pine Ridge and the said John George Bower conveyed the same to John Musser to whom it was pattented on the 11th day of January 1773 and recorded in Patent Book AA Vol. 13, page 340 and by divers good conveyances and appurances duly had and executed in the laws of this Commonwealth the same became vested in John Weitzel who died seized of the same but first made his will in writing duly proven and recorded in the Registers Office at Sunbury on the 13th of October 1835 bequeathed the same to his son Joseph Weitzel one of the parties hereto by reference to the several conveyances and records may more fully and at large appear together with all and singular the buildings and improvements ways, waters, water courses, rights, liberties, privileges, hereditaments and appurtenances whatsoever thereunto belonging or in anywise appertaining and the reversions and remainders, rents issues and profits thereof and all the estate right, title, interest, property claim and demand whatsoever of them the said Joseph Weitzel and Sarah his wife in law equity or otherwise nowsoever of in and to the same and every part thereof to have and to hold the said fifteen acres one hundred and twelve perches strict measure hereditaments and premises hereby granted or mentioned and intended so to be with the appurtenances rents and profits unto the said Peter K. Fisher his heirs and assigns to and for the only proper use and behoof of the said Peter K. Fisher his heirs and assigns forever. And the said Joseph Weitzel for himself his heirs executors and administrators do by these presents covenant grant and agree to and with the said Peter K. Fisher his heirs and assigns that he the said Joseph Weitzel his heirs all and singular the hereditaments and premises herein above described and granted or mentioned and intended so to be with the appurtenances unto the said Peter K. Fisher his heirs and assigns against him the said Jospeh Weitzel his heirs and against all and every other person or persons whomsoever lawfully claiming or to claim the same or anypart thereof of the said fifteen acres one hundred and twelve perches strict measure shall and will warrant and forever defend in witness whereof the said parties to these presents have hereunto interchangeably set their hands and seals. Dated the day and year first above written.

On The 29th day of April Anno Domini 1848 before me the subscriber one of the Justices of the Peace in and for the County aforesaid personally appeared the above named Joseph Weitzel and Sarah his wife and in due form of law acknowledged the above Indenture to be their act & deed and desired the same might be recorded as such; and the said Sarah being of full age and separate and apart from her said husband by me thereon privately examined and the full contents of the above deed being by one first made known unto her did thereupon declare and say that she did voluntarily and of her own free will and accord sign, seal, and as her act and deed, deliver the above written Indenture, Deed, or conveyance, without any coercion or compulsion of her said husband witness my hand and seal the day and year aforesaid.
