Transcription of the Recording of the Will of Jonas Spiva

In the name of Good Amen I Jonas Spivey of Maddison county State of Missouri
being of sound Mind but calling to mind the certinty of life, and being disposed
to so equetable my worldly affairs as to prevent any disattisfattion of my effects
contrary to my desire I do hereby declare the following to be my last will and
testament--That is to say I give and beqeath to my daughter Nancy Spiva one
sorrel mare three years old las spring one Bead and furniter one cow and earlen
the Ballance of my property with debts due stock of every discription house hold
or kitchen furniter and every kind of q---lty qallety of property that I possess I
give and beqeth to my beloved wife Bethany Spivy and after hear death the
property to be eaqally divided if she be the longest liver, amongst my children
Kizah hicks Elizabeth, Sary, Mary Curey William Spivy Elisha Spivay, Hanah
Martin Rhody Moor, Cyntha Bridges Sally Martin James Spivay Dovy Johnson
Nancy flanry and I do hear by revoke and renounce all former will here to fore made
by me. In testimony whereof I do set my hand and fix my seall this seventh
day of febury I[n] the year of our Lord one thousand eight hundred and twenty
eigt signed Jonas Spiva

State of Missouri, county court of Madison county November Term 1828. This day came in open court Bathena Spiva and here in court a paper purporting to be the last Will and testament [of] her deceased husband, Jonas Spiva, and prayed that the same might be proven and admitted to Record. And thereupon Joseph Bennett, William B. Campbell, and John Perringer, who [are] the subscribing witnesses to said instrument, and who being sev sworn, upon their oaths declare, that they saw the said testator, the said last will and testament, and that they were called up as witness by said testator, that they heard him acknowledge and pronounce the same as his act and deed and that they subscribed their names as witnessess in the presence of said testator, and in the presence of each other and further state that they considered said testator, of at that time of sound and disposing mind ordered therefor by the court that said Will is herein fully proven and admitted to record.

I Thomas Moseley Jr Clerk of the County Court of said county do certify the foregoing to be a true copy of the proof of this Will of Jonas Spiva desd in said county court at the November Term thereof year 1828. As the same now remains of record in my said office.

Given under my hand & private seal there being no seal of said court yet Done at office in Frederick Town this 12th November 1828.
