George W. Hampton's Will

Cherokee CO, NC, Will Book A, p. 92-93

In the name of God Amen

I George W. Hampton of the State of North Carolina being of Sound mind and memory as usual calling to mind the uncertainty of life and the certainty of death do make and ordain this my last will and testament in manner and form as follows Viz.
1st I will my soul to God who gave it and my body to earth from whence it came, to be interred in a decent Christianlike manner at the discretion of my frieands, nothing doubting that it will be raised again at the resurrection of the dead.

Item 2nd. I will and bequeath to my beloved wife Mary Ann Hampton all of my real estate consisting of lands all of my personal property of every description consisting of Horses Cattle sheep hogs and Household and Kitchen furniture and farming utensils, with the exception of a hundred Dollars worth of property according to what it was worth before the Commencement of the present war for her natural life.

Item 3rd I will and bequeath to my son Wm. Harrison Hampton one hundred and fifty dollars worth of property and the increase of the same as long as he may continue with his mother.

Item 4th I will and bequeath to my son Francis Marion Hampton one hundred and fifty dollars worth of property and the increase of the same so long as he may continue at Home with his mother. The two last bequests to H. Hampton and F. M. Hampton. The property to be va[?] to them according to the value of property before the commencement of the present war in the, heretofore United States. To also[?] equal with those of my Children that have married ____________ me.

Item 5th. I will that at the death of my beloved wife Mary A. Hampton that all of the property she may be possessed real and personal that the same be sold and divided among the lawful heirs of my body.

Item 6th I will and bequeath my sons Alburton's part of said estate to his two sons Wm. Francis Hampton and Alburton Hampton, my two Grand Children. In witness whereof I have beneath set my hand and seal This 29 day [NOTE: My photocopy from court clerk was cut off at the bottom of that page.]

A paper purporting to be the last will and testament of G. W. Hampton is Exhibited in open court by F. M. Hampton one of the devisees and the due execution thereof is proven by the oath and examination of J. H. Hennessee and M. C. King Esqus. who declare that they were well acquainted with the hand writing of Drury Weeks, now dead, and with the Handwriting of C. T. Rogers being the Subscribing witnesses to said will of George W. Hampton.

It is therefore Considered and Decreed by the Court that the said paper writing and every part thereof is the last will and Testament of the said George W. Hampton deceased. and the same is also Judged sufficiently proven and is recorded and filed in the Book of "Record of Wills" pages 92 & 93. In witness whereof I have unto set my hand and seal at office in Murphy This Dec. 17th 1889.
