Will of Helen Sigston, Wakefield, Widow, 1858

"This is the last will and Testament of me Helen Sigston of Wakefield in the county of York widow . . . I give and devise all that estate situate in Northgate in Wakefield aforesaid known as Sigston's Villas in the occupation of Mr. William Kitching and myself. And also all that my pew in the organ gallery in the parish church of Wakefield aforesaid unto and to the use of my nephew Thomas Smith and his assigns for his life with remainder . . . I give and bequeath unto my said nephew Thomas Smith all my shares in 'The Sheffield Rotherham Burnsley Wakefield Huddersfield and Goole' and 'Caledonian' railways. I give and bequeath unto my brother Richard Smith of Sandal Magna in the said county of York the sum of five hundred pounds... and upon further trust to permit and empower my nephew John Smith and his assigns to receive the annual income of the said monies or the stocks funds or securities whereon the same shall be invested during his life . . . and upon further trust to permit and empower my niece Sarah Grierson and her assigns to receive the annual income of the same monies or the stocks funds or securities whereon the same shall be invested during her life free from the control debts and engagements of her present or any future husband with whom she may intermarry . . . and upon further trust to permit and empower my nephew Henry Smith and his assigns to receive the annual income of the said monies or the stocks funds or securities whereon the same shall be invested during his life . . . and I appoint the said George Roberts and Joseph Roberts executors of this my will. In witness whereof I have to this and the four preceding sheets of paper set my hand this twenty ninth day of April one thousand eight hundred and fifty eight."

First codicil signed 29 October 1861.

Second codicil, signed 15 March 1862, states niece Sarah Chisholm incorrectly named Sarah Grierson in will. ". . . I give and bequeath unto Ledger Smith and Ellen Smith, the son and daughter of my said nephew Thomas Smith the legacy or sum of one hundred pounds each. I give and bequeath unto Peter Chisholme and Ellen Chisholme, the son and daughter of my said niece Sarah Chisholme the legacy or sum of one hundred pounds each. I give to Thomas Sigston Smith, son of nephew Henry Smith the legacy or sum of one hundred pounds . . . to my niece Sarah Chisholme nineteen pounds ten shillings . . . ".
