My gggrandfather was Nathan Gregory. He and his brothers, Tilmon, and
William, and possibly two sisters, Amanda, and Adelia, had come from TN, to
St. Francis Co., which later was Jackson Co., and then Woodruff Co.. In the
late 1840's they were in St. Francis Co. I knew that Tilmon married Parmelia
Shivers on Sept. 24, 1838, Shelby Co., TN. I have not been able to find out
the parents of these Gregory's, or exactly where they had come from in N. C.
My family, (Nathan Gregory) still live and farm at Gregory, AR, ten miles
south of Augusta. I just happened to look in the Shivers surname, because I
was at a dead end on the Gregory's.

I can't believe it? Under Gregorys, I found where my gggrandfather came from
in N. C. I had just E-mailed you, and then went to yourweb site. Under the
Gregory name, I found several that I can help you with. Noel Kennady , son
of wm. Nathan, died Feb. 11, 1994, my father, Richard Edward died Nov. 15,
2000, My brother, Wm. Noel, born Dec. 6,1945, my brother Richard Edward, Jr.
born Sept. 23, 1943, I am Mary Eleanor Gregory Galloway born Sept. 2, 1939.

The Gregory family in Augusta is mine. My brothers, Ed and Bill, my cousin
Nathan, and his mother, Margaret. My Uncle Noel died in '94. They are the
only ones in Augusta. Nathan has two brothers, Noel, Jr., and Minor(named
after Minor Gregory),and Betsy, and they all have children--26 and under. My
brother Bill has 3 children 26, 23, and 17. There are plenty of Gregory's
from Nathan G. line.(Tilmon's brother) There is only one son with the last
name of Gregory on my side, Ihave two sons but they are Galloways. Uncle
Noel had three sons, and they have 6 sons between them. If ,on your trip to
MS,you are going to be near Jackson, and have the time, give me a call.
Yazoo is 50 m. from Jackson, and about 50 from Vicksburg. Takecare. ME

"I was born in Carroll County, Tennessee. My mother was owned by Houston. She said when war was declared he was at a neighbor's house. He jumped up and said, 'I gonner be the first to kill a Yankee.' They said in a few minutes he fell back on the bed dead. My father owner was Tillman Gregory. After freedom he stayed on sharecroppin'. From what he said that wasn't much better than bein' owned. They had to work or starve. He said they didn't make nobody work but they didn't keep nobody from starvin' if they didn't go at it. They was proud to be free but that didn't ease up the working.

"My people stayed on in Tennessee a long time. When I was nineteen years old they was making up a crowd to come here to work. Said the land was new. I come wid them. It was a big time. We come on the Hardcash (steamboat). I farmed and cleared land all my life. I sold wood, hauled wood. I've done all kinds of farm work. I get $12 from the Welfare Association.

The 1842 probate, No. 84, mentions wards of Martin Powers, all minors, Pamelia Gregory
[married by age 17] along with Katherine, Caroline, William Henry, James B., Alamda and
Repsey - no mention of minor child John Allen Marklin [was he deceased, or not under
Martin Powers' authority?]. The 1843 probate, No. 109, shows Thomas Allen as guardian,
and mentions R. J. P. Shivers [who had already married Amy Caroline, who would have
been age 16 or 17 at marriage in 1842], and Shadrack Shivers who so far as we know did
not marry any of Benjamin's daughters. Shadrack is noit mentioned as a minor - he would
have been at least 18 by 1843. It also mention, without designation, Jesse M. Shivers,
known to be Benjamin's son, Nancy Shivers, Ben's widow, and MINIOR children Evelina
Pamelia Gregory, Amy Caroline, Margaret Allenette, James B. F. and Repsey Charlotte.
Need to see what the actual probate record says.
It would also be interesting to see 1848 Probate No. 4 wherein Roderick is a guardian
to the minor children, and 1853 Probate No. 540 in which Roderick's minor children
receive a guardian.

William Jackson & wife and other heirs. No. of 68. Benjamin Shivers. Petition to divide slaves.
To the Worshipful the County Court of Shelby County. Your petitioners, Jane [sic],
Benjamine [sic] and S. Shivers by their guardian S. F. Williford and William Jackson and
wife M. A. Jackson, formerly M. A. Shivers who has lately intermarried with said
William Jackson, children and distributees of Benjamin Shivers deceased would most
respectfully represent unto your Qorshipful Body that Benjamin Shivers departed this
life sometime in the year 1840, after having made and published his last will and testament
which has been probated and entered of record as required by law. Amongst other provisions
in said will appears the following to wit: 'The balance of my negroes shall be hired out and
as my children come of age they shall receive their proportionable part; the balance of my
property with the exception of the above named slaves be sold, and the money shall be
equally divided between my children.' Your petitioners would state that all of the children
of said Shivers have received their proportionabhle share of said slaves and property except
your petitioners of whom James, [sic] Benjamine [sic] and S. Shivers are still minors, would
further state that M. A. Jackson since the death of said Benjamine [sic] Shivers has intermarried
with said Jackson, and that the said Margaret A. has arrived to the age of twenty one years,
and she and the said William Jackson by virtue of his marital rights, claims a partition and
distribution of the slaves not otherwise disposed of in said will. The following are the slaves undisposed of by said will, and which remain since the rest of said children have arirved to the
age of 21 years and received their respective shares, or parts, together with their increase
to wit: Arcemo & two children, Manerva and two children, Harriet and child, Sofa and Mariah,
Job and Aaron, which slaves have been hired out ever since the death of said Benjamine [sic] Shivers. Premises considered petitioiners pray your worshipful body that M. McCollum, Dr. Samuel Bond and Scott Baye may b appointed as commissioners to partition and divide said slaves,
fairly and equitable [sic] and to assign and set apart to said William Jackson and wife M. A. Jackson
their share in the remaining slaves of said Benjamine [sic] Shivers deceased,also to ascertain and
set apart to them their share of the hire of said slaves from the death of said Ben [sic] Shivers
up to the time of making this division, and that said commissioners meet on the premises of
Nancy Shivers to effect said division on the 27th of December 1852, and as in duty bound

Your petitioners S. Williford administrator of Benjamin A. Briley [sic] deceased, Jesse

Shivers & wife, Elizabeth, heirs at law and distributees of the estate of Jesse Briley,
deceased would respectfully reprsent to your worships that some time since the said
Jesse Briley [sic] died in said County, that his estate was duly administered on and
settlement made as the law directs and that thereby it was ascertained that six certain
slaves, viz: Esther, John, Winney and her two children, Julia & T. W. & Willard and the
sum of _______ dollars remained of said estate to be distributed among your petitioners
as the heirs and distributees of the same, and that sometime in the month of July 1853
the said Benj. A. Briley heir and distributee as aforesaid and before distribution of
the estate of the said Jesse Briley had been made, departed this life and that said S.
Williford administered on his said estate and in the course of his administration
various debts were ascertained to be due, outstanding against said estate and that
there were no assets found herewith to pay said debts, and in order trhat said
administrator may be enabled to pay off said debts a distribution of the share of said
Benj. A. Briley, dec'd in the personal estate of said Jesse Briley, deceased is
absolutely and indispensably necessary..
The premises considered your petitoners pray your worships to appoint Malcolm McCollum,
James Neel & C. S. Polk commissioners as the act of asembly has made and provided to
take into consideration the negroes and moneys aforesaid and allot and set apart the
share of said Benj. A. Briley therein according to values and make report thereof at
the next term of this court as in duty bound your petitioners will ever pray, etc.

Be it remembered that this cause came on this day for hearing upon the petition herein
filed and it is ordered that MalcolmMcCollum, James Neel & C. G polk be commissioned to

distributee of Jesse Briley deceased his distributive share of said property set forth
in the peititon, and report to the next term of this Court.

Be it remembered that this cause came on this day for further and final hearing upon
the report of the commissioners theretofore appointed which report is in the words and
figures following to wit: we the undersiged commissioners having been appointed at
January term 1854 to set apart to S. A. Williford, Admr. of Benjamin A. Briley deceased
heir and distributee of Jesse Brile deceased his distributive share of said negroes. We
have set apart to the said S. A. Williford, Admr. ofbenjamin A. Briley deceased,
Esther and John and her child, valued at twelve hundred dollars his distributive share
is $975.00. We also state that the said WEilliford pay over to the guardian of the
other heir $225.00 all of which is respectfully submitted this the 4th day of Feb.

A petititon exparte for division

This day came on this cause to be heard upon the petition and transcript from the
records of Union Parish, State of Louisiana, and it appearing to the satisfaction that
Josiah Daniel has been duly appointed and qualified as guardian of the said Wm. A
Briley and it further appearing to the court that the facts set forth in the petition
are true. It is therefore considered and ordered by the court that M. McCollum, C. G.
Polk & James Neel be appointed commissioners to set apart to Wm. A. Brily his
distributive share of the negroes named in said petition that the same may be moved to
the State of Louisiana to the possession of his guardian Josiah Daniel and that said
commissioners report to the next term of this court until the cloming in of which
report all other matters are reserved.

This cause came on this day to be heard upon the report of commissioners heretofore
appointed which is in the words and figures following to wit: We the undersigned Com
appointed by the County Court at the Nov. term to allot and set apart to Wm. A. Briley
his distributive share of the estate of Jesse Briley deceased, report that after having
all of said slaves of said estate before us and valuing same and being under oath give
to said Briley (Wm. A.) one negro boy named Hilliard valued at one thousand dollars
being more than hiks share of said estate - we order that said Wm. A. Briley pay to the
estate and other distributees one hundred and sixty-six 66/100 and 2/3 dollars. This
November 1854.
Sworn to and subscribed before me this first day of Jan. 1855. C. G. Polk; James Neel;

Which report being heard and no exceptions thereto is in all things confirmed, and itis
ordered and adjudged and decreed by the court that all the right, title and interest of
the remaining heirs of Jesse Briley deceased in and to the said slave Hilliard be
divested out of them and vested in the said Wm .A. Briley and his heirs forever,
reserving a lien upon said slaves in favor of the remaining heirs until the payment of
the amount which he has receievd beyond his distributive share and that the guardian of
said minor pay the costs of this proceeding together with a fee of ten dollars due
Bayne & Stewart, for which let execution issue.

To the Worshipful the County Court of Shelby County, Tennesse.
Your petitioners S. Williford administrator of Benjamin A. Briley [sic] deceased, Jesse
Brily [sic] Jr. & Piney Briley [sic] by their guardian M. E. Daniel & J. B. T.
Shivers & wife, Elizabeth, heirs at law and distributees of the estate of Jesse Briley,
deceased would respectfully reprsent to your worships that some time since the said
Jesse Briley [sic] died in said County, that his estate was duly administered on and
settlement made as the law directs and that thereby it was ascertained that six certain
slaves, viz: Esther, John, Winney and her two children, Julia & T. W. & Willard and the
sum of _______ dollars remained of said estate to be distributed among your petitioners
as the heirs and distributees of the same, and that sometime in the month of July 1853
the said Benj. A. Briley heir and distributee as aforesaid and before distribution of
the estate of the said Jesse Briley had been made, departed this life and that said S.
Williford administered on his said estate and in the course of his administration
various debts were ascertained to be due, outstanding against said estate and that
there were no assets found herewith to pay said debts, and in order trhat said
administrator may be enabled to pay off said debts a distribution of the share of said
Benj. A. Briley, dec'd in the personal estate of said Jesse Briley, deceased is
absolutely and indispensably necessary..
The premises considered your petitoners pray your worships to appoint Malcolm McCollum,
James Neel & C. S. Polk commissioners as the act of asembly has made and provided to
take into consideration the negroes and moneys aforesaid and allot and set apart the
share of said Benj. A. Briley therein according to values and make report thereof at
the next term of this court as in duty bound your petitioners will ever pray, etc.

Be it remembered that this cause came on this day for further and final hearing upon
the report of the commissioners theretofore appointed which report is in the words and
figures following to wit: we the undersiged commissioners having been appointed at
January term 1854 to set apart to S. A. Williford, Admr. of Benjamin A. Briley deceased
heir and distributee of Jesse Brile deceased his distributive share of said negroes. We

Esther and John and her child, valued at twelve hundred dollars his distributive share
