Another unusual combination of names used here that
signifies that James Benjamin Franklin Shivers may
have been born into the Franklin family and then under
the same guardian/adoption scenario that surrounds
Benjamin Shivers he may have been adopted. One of the
clues involved here is in the will of Benjamin Shivers
he makes the statement (His Children) (Hur Children).
I have been looking at his as the oldest children were
most likely Benjamin Shivers and the younger children were
Nancy P Elks. There could be a couple of interpretations
of this either to previous marriages by either or both
or marital infidelity as mentioned by other researchers.
No proof has yet been established to prove either.
There is a document in my archive to be posted here
that shows JBF Shivers and S Shivers (Shadrick ?) using
their sister Margaret Almeta Shivers Jackson to sue the
estate of Benjamin Shivers for their exparte portion of
the slaves and property belonging to Benjamin Shivers.
JBF Shivers was at the time listed living in Louisiana
and married to Nancy Elizabeth Briley.

"Your petitioners Jane, Benjamin and S. Shivers by their
guardian S. F. Williford and William Jacson and wife
M. A. Jackson, formerly M. A. Shivers who has lately
intermarried with said William Jackson, children and
distributees of Benjamin Shivers deceased....
Benjamin Shivers dep[arted this life sometime in the year
1840, after having made and published his last will and
testament....Your petitioners would state that all of the
children of said Shivers have received their proportionable
share of said slaves and property except your petitioners
of whom James, Benjamin and S. Shivers are still minors ...
further state that M. A. Jackson since the death of said
Benjamin Shivers has intermarried with said Jackson,
and that the said Margaret A. has arrived to the age of
twenty-one years, and she and the said William Jackson by
virtue of his marital rights, claims a partition and
distribution of the slaves..... Recorded July 30, 1853...."
Pages 95-96-97: W. A. Briley, a minor, by his guardian
Josaih Daniel. A petition exparte for division...."This
day on this cause to be heard upon the petition and
transcript from the records of Union Parish, State of
Louisiana, and it appearing to the satisfaction that
Josiah Daniel has been duly appointed and qualified as
guardian of the said Wm. A Briley ... commissioners to
set apart to Wm. A. Briley his distirbutive share of the
negroes named in said peititon that the same may be moved
to the State of Louisiana...Petition for division of
personal estate....set apart to Wm. A. Briley his
distributive share of the estate of Jesse Briley deceased
...November 1854, Sworn to and subscribed ..first day
of Jan. 1855.
"J. B. F. Shivers heirs of Benj. Shivers, dec'd,Petition
for division..."County Court of Shelby County at Raleigh
sitting four petitioners J. B. Shivers heirs and distributees
of Benjamin Shivers and R. C. Williams by her guardian
Callerions Williams also heir and distributee of said
Benjamin Shivers estate...on or about August 1840 said
Benjamin Shivers died...appointing one James Shivers executor
to his said will who....gave bond Sept. 1840 and made final
settlement as recorded...January 1843....that said
J. B. F. Shivers ahs arrived at the age of twenty-one years
.....Petition for Division...We the commissioners appointed
at the November term of this county court of Shelby County
1854 to set apart and allot to James B. F. Shivers his
distributive share of the slaves of Benj. Shivers deceased
....Recorded March 26th 1855...."
Pages 144-145:
"S. F. Williford, Admr of Benj. A Brily, dec'd,
James Brily Jr., Piney Brily by their guardian M. E. Daniel
& J. B.F. Shivers and wife Elisabeth - heirs of Jesse Brily,
deceased...heirs at law & distributees of the estate of
Jesse Briley, deceased...respectfully submitted this 4th day
of February 1854..." There is more detail in these records,
including names of slaves.
