Ex Parte petition for division of slaves and other personalty
To the Worshipful the County Court of Shelby County, Tennesse.
Your petitioners S. Williford administrator of 
Benjamin A. Briley [sic] deceased, Jesse Brily [sic]  Jr. & 
Piney Briley [sic] by their  guardian M. E. Daniel 
& J. B. F. Shivers & wife, Elizabeth, heirs at law and 
distributees of the estate of Jesse Briley, deceased would 
respectfully reprsent to your worships that some time since 
the said Jesse Briley [sic] died in said County, that his 
estate was duly administered on and settlement made as the 
law directs and that thereby it was ascertained that six 
certain slaves, viz: Esther, John, Winney and her two 
children, Julia & T. W. & Willard and the sum of _______ 
dollars remained of said estate to be distributed among your
petitioners as the heirs and distributees of the same, and 
that sometime in the month of July 1853 the said 
Benj. A. Briley heir and distributee as aforesaid and before
distribution of the estate of the said Jesse Briley had been 
made, departed this life and that said S. Williford administered 
on his said estate and in the course of his administration
various debts were ascertained to be due, outstanding against 
said estate and that there were no assets found herewith to pay 
said debts, and in order trhat said administrator may be enabled 
to pay off said debts a distribution of the share of said 
Benj. A. Briley, dec'd in the personal estate of said Jesse Briley, 
deceased is absolutely and indispensably necessary.. The premises 
considered your petitoners pray your worships to appoint 
Malcolm McCollum, James Neel & C. S. Polk commissioners as the act 
of asembly has made and provided to take into consideration the 
negroes and moneys aforesaid and allot and set apart the share 
of said Benj. A. Briley therein according to values and make 
report thereof at the next term of this court as in duty bound 
your petitioners will ever pray, etc. Bayne &Stewart, Sols

Ex Parte petition for division of slaves and other property

Be it remembered that this cause came on this day for hearing 
upon the petition herein filed and it is ordered that 
Malcolm McCollum, James Neel & C. G polk be commissioned to
set apart and allot to S. H. Williford, Admr of Benjamin A. Briley 
dec'd heir and distributee of Jesse Briley deceased his distributive 
share of said property set forth in the peititon, and report to the 
next term of this Court.

Exparte petition to divide property

Be it remembered that this cause came on this day for further 
and final hearing upon the report of the commissioners theretofore 
appointed which report is in the words and figures following to wit: 
we the undersiged commissioners having been appointed at January 
term 1854 to set apart to S. A. Williford, Admr. of Benjamin A.
Briley deceased heir and distributee of Jesse Brile deceased his 
distributive share of said negroes. We have set apart to the 
said S. A.  Williford, Admr. ofbenjamin A. Briley deceased,
Esther and John and her child, valued at twelve hundred dollars 
his distributive share is $975.00. We also state that the said 
Williford pay over to the guardian of the other heir $225.00 all of 
which is respectfully submitted this the 4th day of Feb. 1854. 
Malcolm McCollum; james Neel; C .G. Polk. Which report being heard 
and understood is in all things confirmed by the court and it is 
therefore considered that all the right, title, and interest of 
the heirs of Jesse Briley dec'd in and to the said slaves, Esther, 
John and child of Esther be divested out of them and be vested in 
the said S. A. Williford as administrator of the said 
Benj. A. Briley deceased after the payment of the $225 allotted by 
the commissioners to the guardian of the other heir, and that the 
said Admr. pay the costs of thisnproceeding. Recorded Aug. 1, 1854
