Gardner Wills and Probate Records

Will of Thomas Gardner, 1827
Warren Co., NC

In the name of God Amen, I Thomas Gardner of the County of Warren & State of North Carolina, Being of sound mind & memory (blessed be God), do make & Publish this my last will and Testament, in the manner following that is to Say,

Item
I give and bequeath to my son John W. Gardner to him, his heirs & assigns forever all my Land & the following named negroes, Old Peter, Caroline, Burton & Washington, also two Beds & furniture, he to take choice of these that may belong to me at my death, also one horse to be his choice.
Item
I give & bequeath to my daughter Francis Gardner, to her, & her assigns forever, the following named negroes Bob, Milly, Mavid, Nat, Polly, Lucy & William, also two Beds & furniture, she to take her choice, after my son John Gardner the two given him.
Item
I give & bequeath to my daughter Martha P. Tally to her, her heirs and assigns forever, the following named negroes Ephraim, Sarah, Dillah, Scilla, Sam, Tom & Casy.
Item
I give & bequeath to my Grandson James M. Balthrop to him, his heirs & assigns forever, negro Boy Lewis.
Item
It is my will & desire that all my Estate not herein before given away shall be equally divided between my three children above named.
Item
I confirm the title to whatever property I may have heretofore given to my other children who this the said children be now living or dead.
Item
I hereby make and ordain my above mentioned Son John W. Gardner Executor of this my last will & Testament. In witness whereof I the said Thomas Gardner have this my last will & Testament set my hand & Seal this 21 day of March Anno Domini 1827.

This last will and Testament of Thomas Gardner was offered in open Court for Probate, and the Execution thereof being duly proved by the oaths of Nathl Macon, Hardy Myrick, and Mark W. Sledge, the subscribing witnesses thereto and on motion was ordered to be Recorded. Whereupon come John W. Gardner the Executor therein, into open Court, and qualified according to Law & took upon himself the ____ of the Execution of Said Last will and Testament.
