Report of a porol partition
Wednesday, 16 November 1916

Now comes Lorena Stewart, Guardian and Curator of said minors, and files her report of a porol partiton, stating that her former husband, Joel [James] O. Thorp, died possessed one half interest in certain real estate of One hundred eleven acres and ten hundreds of an acre, said real estate being more fully described in said petition, and known as the Joel C. Thorp farm, and under or by the will of said Joel C. Thorp, deceased, his said real estate was to be divided among his two Sons, L. B. Thorp, and J. O. Thorp in equal shares, after the death of his widow, Margaret Thorp, under provision in said Will, said L. B. Thorp and J. O. Thorp, each of said two Sons, had to pay certain named legacys [sic], various amounts named and specified in said will; and that said J. O. Thorp and L. B. Thorp had in the life time said J. O. Thorp, now dec'd, divided said real estate, but were prevented from passing deed to each other in the life time of their mother, but after the death of their mother, Margaret Thorp, the legatees demanded their money, and threatened to have said real estate sold as for closure [sic] in said Will.

Therefore, said petitioners pray the Court to confirm said report in all particulars.

The Court having examined said report and heard the evidence offered in said behalf, is sadisfied [sic] that it is to the best interest of said minors and all others interested in said matter, if said parol partition be confirmed and approved.

It is therefore ordered by the Court, that the said Report be, and the same is hereby confirmed and approved, and that Lorena Stewart, as such Curator, is hereby authorized to make such conveyances that may be deemed necessary by the parties in interest to pass said minors title in said undivided one half to said L. B. Thorp.

Court now adjourns until to-morrow morning at 9 o'clock.

Order of sale of real estate
Thursday, 16 November 1916

On this day comes Lorena Stewart, Guardian of the person and Curator of the estate of Homer Thorp, Blanch Thorp, Edgar Thorp, Irene Thorp, and Salina Thorp, minors under the age of eighteen years, and files her petition for the sale of real estate, of said minors therein described, setting forth that said minors have no personal estate, and owe besides over two hundred dollars for legacies which are liens on said real estate in said petition described, and therefore no personal estate in hand for support and maintainance of said minors, and the rents and profit in said land are wholly insufficient to pay the charges and expenses necessary to support and educate said minors, and asking an order for the sale of the following real estate, or as much thereof as shall be necessary to complete the education of said minors, the said reals estate lying and situate in the County of Perry and State of Missouri, and described as follows, to wit.:

20 acres in Survey No. 665, Twp. 36 N R. 11 E, beginning at the corner of Surveys Nos. 665, 116, 2079, and 1322, at a stone; thence N. 13 degrees E 16.95 chains to a post, thence N. 76 1/2 W 11.79 chs. to a post; Thence S. 13 degrees W. 16.96 chains to a stone; Thence S. 76 1/2 degrees E. to the place of beginning;

Also an other part of said Survey 665, beginning at the N. E. corner of the last above described tract; Thence N. 13 1/2 degrees E. along original line of said Survey 700 chains to a post; Thence S. 69 1/2 degrees W. 12.25 chs. to a stone on North line of said 20 acres tract; Thence S. 76 1/2 degrees E. 10.26 chains to the place of beginning, containing 3.69 acres;

Also part of Survey No. 2079, Twp. 36 N R 11 east, beginning at the corner of Surveys Nos. 665, 2079 and 1322, at a stone; Thence S. 12 degrees W. 22.17 chains to a post at a branch; Thence W. 75 degrees W. 5 chains with said branch; Thence S. 75 degrees W. about 4 chains with said branch to the intersection of a second branch running from north to south; thence with the meanderings of said second branch in a northeasterly directon about 24 chains to the S. W. corner of the 20 acre tract in Survey No. 665 above described; Thence S. 76 1/2 degrees E. with the south line of said 20 acre tract to the place of beginning.

And the Court having heard the petition and evidence in relation thereto, is sadisfied [sic] that said order should be granted. It is therefore ordered by the Court that said Guardian be and is hereby authorized and empowered to sell the said real estate, at either public or private sale, first having had the same appraised according to laws for not less than three-fourth of the appraised value thereof, on the following terms, to-wit.:

Twenty percent of the purchase money to be paid down, the balance in three month from day of sale, purchaser to give his Note for deferred payment, with interest at 6 percent per annum, and secure the same by good personal security, and that said Guardian report said sale and her proceedings thereon to this Court at the next regular term thereof.

The report of sale of real estate of said minors filed on this day, is ordered filed and approval is continued to Friday, February 23rd 1917, as provided by law for such approval.

Report of sale of real estate confirmed & approved
23 February 1917

On this day in open Court comes Lorena Stewart, Guardian and Curator of the persons and estate of Homer Thorp, Blanche Thorp, Edgar Thorp, Irene Thorp and Salina Thorp, minors; and reports to the Court that in obedience to the order of this Court, made at its November Term 1916, directing her to sell at private sale, the real estate in said order described, and situate, lying in the County of Perry and State of Missouri, as follows, to-wit:

20 acres in Survey No. 665, Twp. 36 N R. 11 E, beginning at the corner of Surveys Nos. 665, 116, 2079, and 1322, at a stone; thence N. 13 degrees E 16.95 chains to a post, thence N. 76 1/2 W 11.79 chs. to a post; Thence S. 13 degrees W. 16.96 chains to a stone; Thence S. 76 1/2 degrees E. to the place of beginning;

Also an other part of said Survey 665, beginning at the N. E. corner of the last above described tract; Thence N. 13 1/2 degrees E. along original line of said Survey 700 chains to a post; Thence S. 69 1/2 degrees W. 12.25 chs. to a stone on North line of said 20 acres tract; Thence S. 76 1/2 degrees E. 10.26 chains to the place of beginning, containing 3.69 acres;

Also part of Survey No. 2079, Twp. 36 N R 11 east, beginning at the corner of Surveys Nos. 665, 2079 and 1322, at a stone; Thence S. 12 degrees W. 22.17 chains to a post at a branch; Thence W. 75 degrees W. 5 chains with said branch; Thence S. 75 degrees W. about 4 chains with said branch to the intersection of a second branch running from north to south; thence with the meanderings of said second branch in a northeasterly directon about 24 chains to the S. W. corner of the 20 acre tract in Survey No. 665 above described; Thence S. 76 1/2 degrees E. with the south line of said 20 acre tract to the place of beginning.

She did on the 10th day of February 1917, (having first had the same duly appraised by Lawrence V. Hubers, J. H. Kiesler, and Chas. A. Killian, three disinterested householders of said County, who were first duly sworn as such appraisers), sell the said real estate above described to Julius G. Margraf, on the terms mentioned in said order, to wit.:

Twenty percent of the purchase money to be paid down, the balance in three month from day of sale, purchaser to give his Note for deferred payment, with interest at 6 percent per annum, and secure the same by good personal security.
