Last Will and Testament of Joel Calvin Thorpe

Know all men by these Presents, That I Joel Calvin Thorp of the County of Perry and State of Missouri being of sound mind and memory do make and publish this, my last Will and Testament, in manner and form following:

As to my worldly estate, and all the property real, personal and mixed of which I shall die seized and possessed or to which I shall be entitled at the time of my demise, I devise, bequeath and dispose of in the manner following to wit:

All my just debts and funeral expenses shall first by my Executor hereinafter named be paid out of my Estate as soon after my death as shall by them be found convenient.

I give, devise and bequeath to my beloved wife Margureth Catherine Thorp, for her use during the Term of her natural life, all of my right & title to the real Estate of which I die seized and possessed and also all of my household and Kitchen furniture, also all of my livestock consisting of horses, mules, colts, cows, calves, hogs, shoats, bigs and poultry, also all of my farming Machinery, consisting of Binders, mowers, rakes, wagons, plows, harrows, drills, Buggy, harness, gears, etc. also all the growing crops and grain, hay.

It is my wish and desire that my wife, M. C. Thorp shall sell at public auction after my death enough of the personal property to pay all of my just debts and as above mentioned , and to pay over to each of my children One Dollar in cash, as their share of the Estate whilst my wife their mother is living.

At the death of my wife, it is my wish and desire that my real Estate be equally divided between my 2 Boys, L. B. Thorp and J. O. Thorp upon conditions that my said son L. B. Thorp pays to my daughter Mattie Thorp Three Hundred (300) Dollars; and that my said son J. O. Thorp pays to my daughter Elle M. Figle Fifty (50) Dollars and to my daughter Ora Counts One Hundred and Fifty (150) Dollars; and that the personal property that she (my wife) at the time of her death may be seized and possessed to be sold and equally divided between my five children
Louis B., James O. Thorp, Ora Counts, Elle M. Figle and Mattie Thorp.

And I further provide that if my said sons L. B. and J. O. Thorp does not comply with the provisions herein set forth or if either of them fails therein, it is my wish and desire that the whole farm* be sold and that my said daughters be paid their respective shares out of the proceeds first and the remainder be divided equally between my two sons L. B. and J. O. Thorp after the costs and expenses of selling are paid. *The word farm mentioned above refers to all the Real Estate in my name.

And last, I constitute and appoint Margareth Catherine Thorp to be the Executor of this my last Will and testament, revoking and annulling all former wills by me made, and ratifying and confirming this and no other to be my last Will and Testament.

Proof of Will

In the Vacation of the Probate Court.

Be it remembered, that on the 26th day of December A. D. 1905 before me Chas. A. Weber, Judge of the Probate Court in and for the County and State aforesaid, personally appeared Joseph S. Phillips and August Klump who are the subscribing witnesses to the annexed Will of Joel C. Thorp deceased, and being by me first duly sworn, depose and say that the said Joel C. Thorp, the testator, subscribed the same in their presence and published and declared said will or instrument of writing to be his last Will and Testament, and that at the time of signing the same he, the said testator, was of sound and disposing mind and that said deponents attested said Will as witnesses thereto, by subscribing their names thereto the same in the presence of the testator and of each other, and at the request of the said testator. They further state, that the said Joel C. Thorp departed this life in Perry County, Missouri on Decbr 15, 1905. -

In the vacationing of the Probate Court.

I, Chas. A. Weber Judge of the Probate Court within and for the County and State aforesaid, having examined the forgoing instrument, purporting to be the last Will and Testament of and signed and executed by Joel C. Thorp late of Perry County, Missouri on the 15th day of December 1905 deceased and having heard the Testimony of Joseph S. Phillips and August Klump subscribing witnesses thereto in relation to the Execution of the same; do declare and adjudge said instrument to be the last Will and Testament of the said Joel C. Thorp deceased as aforesaid in Testimony where I have hereunto set my hand and affixed the seal of the Probate Court of Perry County at office in Perryville this 26th day of December 1905.

Margaret C. Thorp
Executrix of Joel C. Thorp dec'd.

We Margaret C. Thorp as Principal and James O. Thorp and James O. Thorp and Vincent C. Moore as securities are held and firmly bound unto the State of Missouri in the sum of Eight hundred dollars, for the payment of which we bind ourselves, our heirs, Executors and Administrators firmly by these Presents.

Sealed with our seals and dated at Perryville, Mo. this 26th day of December A. D. 1905. The condition of the above Bond is , That if the said Margaret C. Thorp Executrix of the last Will and Testament of Joel C. Thorp deceased, late of Perry County, Missouri, shall well and faithfully execute the said last Will and Testament and shall make true and faithful Inventories, returns and Settlements of accounts of the Estate of the said Testator according to law and shall moreover do and perform all other matters and things touching the Execution of the said last Will and Testament as are or shall be prescribed by law or enjoined on her by the order sentence or decree of any Court having competent Jurisdiction there this obligation to be void and of no effect, otherwise to remain in full force.

Signed and executed in my presence approved by the court and recorded this 26th day of December A. D. 1905.

The State of Missouri to all persons to whom their presents shall come. - Greeting: -

Known ye that the last Will of Joel C. Thorp deceased, hath in due form of law been exhibited, proved and recorded a copy of which is hereto annexed; and inasmuch as it appears that Margaret C. Thorp has been appointed executrix and by the said last Will to execute the same and to the end that the property of the Testator may be preserved for these who shall appear to have a legal right or interest therein, and that the said last Will may be executed according to the request of the Testator, we do hereby authorize her, the said Margaret C. Thorp as such executrix to collect and secure all and singular the goods and chattels, rights and credits, which were of the said Joel C. Thorp at the time of his death, in whosesoever possession the same may be found and to perform and fulfill all such duties as may be enjoined upon her by said Will, so far as there shall be property: and the law charges her and in general to do and perform all other things which now are or hereafter may be required of her by law.

In testimony whereof, I Chas. A. Weber, Judge of the Probate Court in and for said County of Perry have hereunto signed my Name and affixed the seal of said Court, at office this 26th of December A. D. 1905.
